Gravatar Actually, it doesn't seem like many people on the right or the left is in favor of this decision. That's pretty encouraging- liberal insistance on nanny-stateism only runs so far, I guess.

Perhaps the worst problem is that this single case isn't an aberration, but, as Eugene Volokh said, a minor extension of existing law and precedent. That being said, it still underlines the importance the next two Supreme Court vacancies will hold.


Gravatar I do not feel we can wait for a new Supreme Court justice. All of us must encourage our state legislators to pas laws to exclude eminent domain for the purpose of economics.

Gravatar The solution isn't in waiting for someone else to take care of the problem, a new Supreme Court justice that is violently opposed to the Kelo decision would make little difference. And why should we have to influence hundreds of legislators in 50 different states to get back the protection that was taken away from us by 5 lawyers who are appointed for life? Support the Judicial Amendment (see my homepage) and help me put the power back into the hands of the people. Help spread the word.
