Maybe we're missing part of the story, but from what I've heard, it sounds like it wasn't the teacher's fault. I'd appeal the decision if I could. This seems totally ridiculous.
If anything, blame the IT guy that's supposed to keep the stuff off the systems.

This decision is insane, in my not so humble opinion.
I would not be surprised that the school district network etiher suffers from th DIGG effect or gets seriously hacked to instill porn pop ups on all the admininstrators computers. Maybe even include the local newspaper, courts and police.
What are they going to do then? Accuse themselves of it.
Maybe an outpouring from the security community to the BIG news groups, telling it like it really is and how most of these get prOn on their computers and/or networks.
Anyone have the links to the schools and courts and newspapers?

I've been keeping an eye on this one since I first read about it a few weeks back - sadly I knew it'd come crashing to a completely stupid conclusion.
Obviously we don't know the full story, but from what I've read so far it all seems rather OTT.

Sounds like there's a dearth of qualified experts to testify on the hapless teacher's behalf. If the obnoxious spyware/pr0n pop-up infestations can happen to my elderly mother, it could happen to anyone....
Love to see a pic of the judge falling asleep though - wouldn't that clinch the grounds for appeal?

jeezz .. where's the EFF or at least the ACLU on this ... any beginning computer/security tech should have be able to figure out she'd been hijacked if that was the case

1. Appeal, eventually someone with common sense would see how unjust this trial was, if the rumors are true.
2. Sue the school district as well as the 'computer expert' that investigated the matter for gross negligence and lible.
3. Retire to Hawaii!

Yep. that's telling. Both these organizations are shills for perverts and child molesters. Their absence in this case speaks volumes.
In other words, if the EFF or ACLU are present, you know the defendant is guilty. If these organizations are absent, it's a good clue that the defendant is not guilty.

Heck, the other day, I was working on someone's computer that had previously been spyware infested. I found a bunch of wmv files which I didn't know what they were. When I opened the first one.....porn. The computer was a bit laggy and the vid didn't shut off right away. I ended up reformatting the system to make sure it was clean...of malware, and...other stuff.
So, had the family's young kid been in the room, would it have been my fault for DELIBERATELY exposing him to porn? No, it was the stupid spyware that downloaded it.
If this is a precidence, people that have a spam bot program installed on their computer through spyware will be found guilty for violating anti-spam laws. Totally ridiculous.

Common sense? When was the last time you've actually seen that?
When I got here, I thought I could become rich if only I could bottle common sense and sell it. However, not too much later it dawned on me that I would go broke. Who would even recognise common sense???
I had something similar happen with a customer. A manager called and wanted to know how to determine if the user had actually downloaded porn. He was ready to have the user fired because the laptp had porn on it. After looking over the laptop, we found it had been infected with a worm. And if anyone should be fired it was the manager for not taking care of making sure the laptop was up to date on patches, AV and such before lending the laptop to the user.

Its just crazy that this thing even got as far as a police investigation let alone a trial. In most civilised countries it would be handled as a disciplinary process under her employment contract, and the worst that would happen is getting fired. Even that, on the evidence available, would be hard to sustain.
