I've worked with rape victims for nearly 20 years. Of course there is no typical reaction. Some are hysterical (the expected response, I guess) but some are numb and their affect is flat. Not surprisingly. Many break down in private while they cannot do so in public.
Those of us who work with victims have been horrified for a long time about how rape victims are treated. All too often this happens, but generally not so blatantly or openly. Generally the prosecutors just refuse to bring a case, and maybe threaten a false report if no evidence was collected.
When the hell will this change? Never?

I just couldn't let myself comment earlier as I feared the rage that would spew out. Just as a little test in the psychology of rape, perhaps we could arrange for the judge to undergo a similar experience and video his responses - just so we would have a norm. This is an outrage. I'll contact ACLU and Planned Parenthood, both groups deal with this type of incident. Let you know what I find out.

The New York Times this morning has a link to The Proceedings of the Old Bailey, London 1674 to 1834, where there are records of over 100,000 criminal trials. Because of having read your posting last night, the first search I did was on "rape" and the first return was this:
"There was a French Man also tryed for a Rape; pretended to be Committed on his Maid-Servant, upon the Tryal she gave Evidence that she was one Morning about her business, and her Master arose and as she said took her Virginity from her, being askt what she meant by that, she answered her Maidenhead; but it appearing to the Court, that she had not acquainted any one of it till three days after it was pretended to be done, nor had not accused her Master for it till above three weeks after, he was found not Guilty, and so acquitted."

After I read about this I decided to call the Washington County Prosecutor's Office to give them my opinion loudly. I don't think I am the only one who has tried to do that because I got a message saying they are not receiving calls as this time....cowards.

You’ll have to forgive me here, because I have only had a quick skim through the posts relating to this story (too obsessed with doing my own writing today) .. but am I right in summing this case up as follows:
a 17 year old girl is convicted on purely circumstantial evidence (and flaky circumstantial evidence at that), simply because the prosecutors didn’t want to believe her original rape allegation … and not because there was a single scrap substantial of evidence to suggest that her actual allegation was false?
If so, I am totally gob smacked.

I don't understand what the problem is. 3 stories that match from 3 different individuals versus 1 story from 1 individual that was inconsistant and unbelievable.All of the resonses voicing dismay should think about the children and Fathers separated by the UnConstitutional V.A.W.A. or the child abusive, female gender biased so called Family Law. I personally find this case incredible because 1) the girl was 17 at the time, 2) the guys apparently admitted that the sex took place while saying that she consented to the sex, but 3) under Oregon law, a person under 18 is deemed NOT CAPABLE OF GIVING CONSENT. In Oregon, sex with someone under 18 is statutory rape.

(1) A person is considered incapable of consenting to a sexual act if the person is:

Now, why didn't this come up in the decision not to prosecute the rape but instead to prosecute the child victim?
Could it be because of the legal idiocy and incompetence of the prosecutor and the judge?

The reality is that at a MINIMUM 45 to 50% of all rape allegations filed by women are false. And transversly, as all of our laws are gender neutral, how many women have ever been charged with raping juvenile boys??? Serious question.
Do you believe men accused of rape should be simply locked up without a trial? I say that because in this case not only was there no evidence against the accused men but the woman was found guilty beyond a reasonable doubt. However despite this due process of law you assume the woman is innocent and the men must be guilty.
So why bother with a trial? What possible good is a trial if it is only a risk of getting the "wrong" result and letting a man go unjailed?
Or do you think simply locking men up would look bad and it´s better to have a show trial as long as the result is a foregone conclusion?

You don't know much about rape cases, do you? What evidence do you expect there to be? Real life is not Law and Order or CSI, there isn't always clear evidence to help a woman prove her case. The only evidence in this case appears to be a stunning, and somewhat typical, lack of evidence for all the parties-- no concrete evidence of guilt or innocence for either side.
Unfortunately this kind of rape case is far too common-- woman says she was raped, the man (or men) say she wasn't. It's her word against theirs. This is one of the many reasons women don't come forward after being assualted or raped, the bulk of the case depends on whether or not she can convince others of her version of events-- a pretty horrific task that must be repeated over and over. They guy will say she wanted it, she has to prove that she didn't. At the end if she loses the case due to lack of evidence she's a slut who lied about a rape, it's a lot to risk.

What feminist bigots don't want the rest of us to discover is that while the rate of false accusations is under 2% for most crimes, for rape it is 30% to 60%. While false accusers often send their victims to prison for decades, they are rarely sent to prison even when they are uncovered.
Its time for bigots to stop whining that they're victims and need more priviledges. That tactic doesn't work any more.
And by the way, it is perfectly acceptable for rape accusers to have their motives and history with the accused explored. The current law on ananymous accusations and rape evidence is lopsidedly designed to maximise false convictions in a way that hasn't been since the Inquisition in the Dark ages.

You didn't really answer my question.
A lot of feminists do think that men are all guilty because of their gender. Especially on sexual issues, famously there's the whole "all sex is rape" crowd. Most feminists feel men are guilty of maleness in some sense -- that's the essence of feminist philosophy.
No, you didn't say in so many words that men should be locked up without a trial, but it was the implication of what you and the rest have said. Namely you have said that even when a woman who makes an accusation is proven beyond any reasonable doubt in a court of law to have lied -- a very rare and extreme case -- even then we must assume that she was telling the truth and the men are rapists. In oither words there's no standard of evidence you'd accept to prove or even make you consider the possibility that the woman was the criminal and the men were the real victims.
If you are not saying men who are accused of rape should be locked away without a trial then what are you saying? That the trial should be a show-trial? If only a guilty verdict (for the man) is acceptable to you then you are fundamentally opposed to the concept of a trial and evidence, justice, courts and so on. For men.
You don't appear able to face the logical implications of your own sexist remarks.
I wasn't really sure what you'd say in reply to my question but after reading your reply, yes, I would guess that you think all men are guilty. No, that's not what you said. It's a fair interpretation of what you've said and what you've refused to say.
