If Davis gains 40% against recall and Cruz gets the plurality in the replacement vote,
why not do this:
1. Cruz appoint Gray as Lt Gov -- confirmed by a majority of the legislature
2. Cruz resigns so Davis gets back the Gov seat.
3. Then Davis appts Bustamante as Lt Gov.
After all the hoopla, the results of the 2002 election stand.

Not a bad idea, but I doubt if Cruz (who really doesn't get along with Davis) wins, he'll have anything to do with Davis.

Great idea, as it would give Dems a least a week or two in the Governer's mansion before another 1.7 million signatures would be gathered and Davis and Cruz both given walking papers.
Playing cute with the Constitution is a Republican game. My position is that if the people of California don't like their governer then the next highest elected official, and designated successor should take over. That's Cruz. No on Recall, Yes on Cruz is the best way to honor the wishes of the voters last fall.
While the Legislature is confirming Gray as Lt. Gov, why don't they just redistrict the Repubs out of existence? It is just as important to be a democrat as a Democrat.

Not if the Game Show Network has anything to say about it:
As I've said before, here and elsewhere, this is Cruz's race to lose. Given the dynamics of California politics, and the number of Republicans in the race, for Cruz not to get at least 1/3 of the vote would be amazing.

The recall will be rejected, and Bustamante will get the plurality.
If S. can't even get a clear lead after all of the hype, his goose is cooked.

I dunno, people. The four top Republicans are totalling 44% to Bustamante's 25%. If the national GOP can twist arms hard enough to get Simon or McClintock or both out of the race, I think we're in deep trouble.

Squeaky - everyone who's in the race is *in the race*. You can't withdraw, even if you want to.

"If the national GOP can twist arms hard enough to get Simon or McClintock or both out of the race,..."
They would risk having Simon's and McClintock's supporters stay home and see the recall fail.

"Everyone who's in the race is *in the race*. You can't withdraw, even if you want to."
I know you can't get your name off the ballot, and that's important. But announcing that you're out would make a substantial difference.
"They would risk having Simon's and McClintock's supporters stay home and see the recall fail."
That's a good point, too, but Yes on the recall is polling much much higher than any candidate -- upper 50's, I think.

Well if they do, maybe they can report on Bustamente's involvement with Aztlan -- a vicious hate group tracked by the Southern Poverty Law Center. Or ask why tends to call African-Americans the "n-word" during speeches.

I can't find any evidence that Bustamante is in the lead from the linked article, atrios.
