this should be getting more coverage, but at the same time, it doesn't seem like he's actually been 'cleared of all wrongdoing' -- the National Archives wasn't the one investigating him for making off with classified documents. Regardless of whether the 9/11 commission has seen all the docs or not and if they were photocopies, he still seems to have removed them when he shouldn't have. It's a small offense but let's be clear here..

There were never any charges filed against him, it was merely an investigation into the matter. The investigation yielded no matter in which he could be charged therefore he was cleared.

You can't try and spin it that even though they didn't charge him he was still guilty of wrongdoing. That's the premise of Guilty until proven innocent, Our legal system is based upon the opposite premise. If it wasn't then we would be within our rights as citizens to arrest and detain the entire Bush administration. They certainly look guilty.

Actually, Ralph is right, RSR. The short brief only refers to the WSJ article, which does not go so far as to suggest that Berger has been exonerated completely.
The title of the WSJ article, which media such as Diane Rehm and this link have picked up on is "Berger Cleared of Withholding Material From 9/11 Commission."
No more, no less. It seems that the radio station was a bit sloppy. If they had more information than the referred to WSJ, they didn't mention it.
However, the fact remains that the SCLM should be picking up on this rather conclusive WSJ article.

A recession is defined as two consecutive quarters of negative growth in GDP. The Third Quarter of 2000 (under Clinton) saw negative growth, the Fourth Quarter of 2000 (under Clinton) saw positive growth, the First Quarter of 2001 (under Bush) saw negative growth, and the Second Quarter of 2001 (under Bush) saw negative growth.
So, we did indeed experience a recession in 2001 and it was on Chimpy's watch.

Folks.. the leak said that the Justice Department was doing a criminal investigation into the allegations that he removed documents from the National Archive. We have not yet heard from said Justice Department that the investigation is over, so how can he have been cleared of all wrongdoing, unless the National Archive made the complaint and has the power to withdraw it? This has nothing to do with 'innocent until proven guilty'; the question is whether an investigation is ongoing, and until told otherwise, shouldn't the assumption be that it is?

Well... let's not totally make Berger a martyr here. I'm still a little ticked off that he would stay close to the Kerry campaign with an active investigation going on. Berger knew the neo-cons would eventually leak this mess, and he should have stepped away from the Kerry campaign to keep it clear of controversy.
Sandy Berger did some stuff with docs that wasn't real smart. It wasn't criminal, but he's probably going to have his security clearance affected before all is said and done.

Well, I *have* read all the articles (apology accepted, refugee). I've just been trying to sort all this out. Just because KYW1060 says something, it doesn't make it the true or complete story.
And certainly, anything that's on NewsMax isn't worth the electrons it's transmitted with.
I've never believed the socks story either, but it's completely plausible to me that Berger, preparing for his testimony before the commision, would review the material he's about to give testimony about. But taking written notes away (and copies of docs) is sloppy and wrong. And I think Berger has admitted as much.
But there's been so much sloppy reporting and wild spinning of this issue, it's hard to know what the truth is.

WASHINGTON (Reuters) - Not only was the U.S. recession in 2001 the shallowest on record, it may not have been one at all -- at least in the classic sense of two straight quarterly declines, new government data show.
Short story: revision of numbers by the Commerce Department removed a decline in the 2nd quarter of '01.
Seems to me this is one less thing that they can blame on Clinton.

The Berger story never made any sense . The documents in question weren't particularly important and nobody ever came up with a plausible nefarious motive for taking them. That was crystal clear from the outset. Incidentally, the current fallback position of claiming that Berger was guilty of sloppiness is similarly bogus because there was no special reason for him to be careful about these particular documents and no nonpartisan reason for getting upset about nominal infractions after the fact.
Sliming highly respected and patriotic people like Sandy Berger for temporary political advantage is pretty low behavior.

Thanks Wolf, yes in fact it does not look as though charges will be brought against Sandy Berger at this time. High ranking officials at the Justice Department tell CNN that the original documents thought to have been stolen by Berger have in fact been located.
Why he stole the photocopies by surreptitiously hiding them in his socks and secreting them out of the National Archives is not known at this time. Some say that Mr. Berger did not know that these were mere copies and that stealing and destroying them would not thwart the 9/11 commission's investigation.
Some say that in his desire to help Senator Kerry in his bid for the White House Mr. Berger may not have looked too closely at the documents until he had them out of the Archive.
There remain many questions still swirling around the Justice department as to the potentially nefarious actions of Mr. Berger. Although he has been offically cleared the Justice department is taking a wait and see attitude. Wolf.

The Bush regime chose to re-define the word, in such a way that only those who actually died in the field of battle were counted as casualties.
What words actually mean is irrelevant to these people. They'll distort and twist and manipulate something as simple as the definition of a word, to suit their purposes.

Jim Harrison...I'm with you. When the story broke, I and many others commented extensively that the story didn't make sense. Why would Berger, knowing the rules about handling classified documents, intentionally take them out of the archive? Why would archive employees, according to the news reports, watch Berger take the documents and not stop him before he left the building? There were gaping holes in the story from the beginning. Why would the Archives turn this over to the Justice Department and then say "oops, everything's here, never mind" before Justice makes any determination? Something ain't right.

This was a smear job of the worst sort and it was obvious from day one. It was leaked by the WH, which first denied even knowing anything about it, and it was leaked just in time to smear Kerry right before the convention. The right played it to the hilt -- to the HILT. They didn't sit around making prim little moues of disapproval over the rush to judgement and essentially make our talking points for us.
Now, after the convention, it turns out to be total bs, but Berger, who served this country honorably, has been smeared in a way that will never completely go away.

Just checked the Dept. of Commerce Bureau of Economic Analysis site. They have indeed revised the second quarter 2001 numbers upwards. They also revised the third quarter 2001 numbers downwards. So there were still two quarters in 2001 in which GDP growth was negative, but they are no longer consecutive quarters.
It strikes me as odd that they are revising numbers that are three years old.

1) The radio station was wrong to say that Berger is completely in the clear without giving any indication where that news comes from. The only reference is to the WSJ, which says that he is in the clear from withholding materail from the 9/11 Commission. No more, no less.
2) Who gives a flying fuck about what newsmax says? The WSJ has a goddmam quote from Susan Cooper. What more do people want? Scot Paltrow is a pretty good journalist, and he ain't just making shit up.
3) Until we hear something more authoritative than what the radio station came up with, all we can assume is that Justice is still looking into the matter. Which essentially means stalling as long as possible before saying "all is clear."

Berger said he inadvertently removed the classified document which, unknown to him, was mixed up with his own papers and put into his briefcase. Stealing requires intent, which makes a difference. Let me give you an example.
Suppose a President, hypothetically, takes a nation to war on false information. If he knew it was false, he would be lying and subject to impeachment. But, it is entirely possible that he was simply careless, stupid, incompetent, negligent, or reckless.
Of course, in Mr. Berger's case, there is now no question that no harm was done, as all the documents have been accounted for and seen by the 9/11 commission. In the case of the hypothetical president, there would be all that wasted money and needless carnage. Fortunately, it was just a hypothetical.

Here is the press release regarding the revised GDP numbers for 2001. GDP growth for the second quarter of 2001 was changed from -0.6 percent to + 1.2 percent.
While technically the revised numbers indicate no recesssion that year, if you dig deeper you realize that the revisions are not necessarily a good thing for the Chimpster:

He planned and executed the whole primary season quite well; primary debates went well; the convention was fabulous. And he raised tons of money.

Oh, neither do I, really. There hasn't been a plausible case made that anything he did affected anything in any way that matters. You could make a case he negatively affected a perception of Kerry campaign among people who think Bush is the greatest president ever, but that's not hard to do.
The simple fact is that if there had been info that reflected badly on Kerry, BushCo would've leaked it. But if they didn't leak it, Berger couldn't have covered it up by stealing photocopies. And if he wanted to get info to Kerry, all he had to do was write new notes from memory upon leaving the Archives. Or alternatively, Kerry could've gone and read the goddamn things himself. His security clearance is more than high enough for that, I believe.
I'm really wondering when the wingnuts will notice that Berger was carrying secrets out IN HIS HEAD...secrets that as 4legs says, he either wrote or commissioned. Make him give his head back to the Archives! Get a vacuum hose and suck them out of his skull...America's future is at stake.
Meanwhile, a few billion $$$ go missing in Iraq, and 27 criminal investigations are underway into misuse of taxpayer funds. But as long as none of our money went into anyone's socks...who cares, right?

I am writing to you today regarding L. Brent Bozell's Live From... interview with anchor Miles O'Brien on July 27.
Although I am concerned that O'Brien did not inform CNN viewers that Bozell, like the organization that he runs, is staunchly conservative, I am more interested in the issue of CNN providing comparable air time to groups with different views on the media than those of Bozell. One of the reasons that conservatives dominate the debate over the politics of the media in our country is that, all too often, organizations like Bozell's are given the stage to themselves while progressives are sidelined.
Unlike your cable competition, I will be the first to recognize CNN's largely successful attempts at presenting both sides of an issue. But this effort should extend to media watch dog groups as well. Bozell's Media Research Center, according to the Washington Post (6/28/04) has raised $2.8 million to counter what he sees as a liberal jihad against President Bush.
I would request that my organization, Media Matters for America -- a progressive, Web-based, not-for-profit research and information center dedicated to comprehensively monitoring, analyzing, and correcting conservative misinformation in the media -- be given equal air time, beginning with CNN's coverage of the Republican National Convention.

Tom Ridge has to quit because he can't put his two kids through school, even though he's pulling down $175 thou a year. My parents made barely a fifth of that and nevertheless managed to put two sons through school (with the help of us working at the time and scholarship money). Now, granted, collge tuition is outrageous these days, and I doubt Ridge's kids would be content with schools like the University of Florida or the University of North Alabama. But still, come on...

Yeah. But that thing about "stay at home a few more days"...it's surprising how few people who weren't living in NYC understand that the smoke was pouring out for about two solid MONTHS.
I actually got stuck driving past Ground Zero one night about two weeks after 9/11...the clouds of smoke, and the stench, were INDESCRIBABLY bad. I had to wash all my clothes and take a shower to get the smell out. But before and after, the plumes were huge and continuous...Brooklyn Heights and thereabouts got the worst of it most days, but it shifted around with the wind, of course.
What we were dealing with there, in addition to asbestos (and I think this is a case where they're focusing on one problem to distract from others), was literally--I repeat, literally--TONS of volatilized heavy metals (mainly lead and mercury). In the case of lead, I believe the estimate was 250,000 tons' worth. In addition, when you incinerate chlorinated aromatic hydrocarbons (i.e., solvents or other compounds that contain a benzene ring and chlorine), you end up forming dioxins, which are considered by the EPA to be about as toxic as it gets.
I was once caught in a rather small cloud of smoke from PCB combustion...the authorities took all my clothes for "testing," gave me no test results, and tried to get me to accept a cash settlement in return for giving up any right to sue (which I didn't do). Comparing the dioxin cloud I encountered with the one at the WTC is like comparing a campfire to Hiroshima. Environmentally speaking, the WTC collapse probably rivaled Chernobyl as a disaster that'll have persistent health consequences.

As someone who's been a fan of country music since he was a wee little heathern, I must defend Toby Kieth...somewhat. Yeah, he did that rancid "Ugly American" tune, but when asked recently about Iraq (back in March, I think), he said - and I'm paraphrasing here - "A lot of things don't add up. There's no WMD's, so I'm wondering why we went."
His wasn't the worst country song to come out of the War on Terror (and Common Sense). Nor, quite frankly, was Darryl Worley's idiotic "Have You Forgotten", which directly says we're fighting in Iraq because we were attacked on 9/11. And, frankly, it wasn't Charlie Daniels' incredibly racist "This Ain't No Rag, It's A Flag". No, the worst came from Clint Black, a guy who made two really good albums when he first started back in the '90s. It's title: "Iraq And I Roll". No, Clint, you sing and that's it. Singers aren't badasses, sorry.
Why was it the worst? Because it sucked, that's why. Crappy crafty, shitty production, idiotic lyrics and poor overall performance. A clear-cut example of a guy who's trying to buy one extra minute on the merry-go-round.
But, beyond that...Toby Kieth sucks long and hard. Some of the worst shit the Nashvegas hit machine has ever produce has spewed forth from his mouth.

Ya mean Merle Haggard? I wouldn't bet on it. For one, the Hag doesn't care to be used by politicians. I've interviewed him before, and he says that particular song wasn't so much his views at the time as it was from what he felt his dad's point of view was.
Beyond that, Merle told me - and this was just before the war started - that while he supports the President as the leader of the country, he has serious doubts about the current CiC's truthfullness and ability. For more evidence, check out the lead-off single to his latest album Like Never Before. It's called "That's The News", and basically blasts the mainstream media directly and the administration indirectly for more or less moving on after "Mission Accomplished", even though kids are still fighting and dying in Iraq.

Zogby had a new poll out that Kerry went from 48-46 over Bush to 48-43 during the first three days of the convention. Bush lost support to the undecided column. I think that after Kerry's mojo last night, Zogby would probably find about a 49 or 50 Kerry to a 40 to 41 Bush.
I think Kerry's support is very firm, and all he will need to do is get just a decent amount of undecideds. Look for a possible blowout!

MSGOP did focus groups with icky Republican pollster Frank Luntz and even he could not hide the bad news.
Bush has lost half his republican support and all of the independents (well all but one nut) They think Bush duped them and changed his agenda once elected -especially women. (that's why they are hiding man hands)
These groups were in Southern Ohio and if Bush is losing it there --he is losing it everywhere
And people know who Kerry is and liked him despite the punditry.

I've seen the Hag about eight times, and he's only done "Okie" twice. Both times were serious redneck-heavy crowds. The last time was last Fourth of July at Stone Mountain. Scary crowd. I'd say about 75% of 'em had those "Confederate Outfitters" shirts on and most of the younger crowd had buzzcuts shorter than my bro's high-tight-and-sides home 'do. The few longhairs were old bikers, and just before Merle did "The Running Kind" he asked how many ex-cons were in the audience. Well over half the guys - and quite a few of the women - applauded. My bro and I were both stoned as shit, so it was quite freaky.
Awesome show, though. Merle Haggard is the Honky-Tonk Avatar, and walks out on the stage like he knows he's the baddest mother in the joint. Personal favorite annecdote: during the interview with him, I jokingly asked if he ever got around to smoking pot, in reference to the line in "Okie" ("We don't smoke marijuana in Muskogee/We don't take our trips on LSD"). He said, "Son, Muskogee is the only place I didn't smoke it back then."

You know, this is probably a bit too TF for all y'all...but that HAARP Project really IS bad news. I know the more wild suggestions about it--controlling the weather, broadcasting "voices" directly into people's heads, and so forth--but the fact is, the stuff they ADMIT they're doing sounds pretty goddamn dangerous to me. In fact, even just the local environmental effects are bad news.
As for the chemtrails...well, when I was a couple months old, they were spraying NYC and SF with bacteria, just in order to see what kind of coverage they could get in a bioattack. They used "harmless" bacteria, apparently. (Good article on this in Scientific American, possibly available on their site...otherwise, I've got the issue info somewheres). Anyway, I wouldn't be surprised if some of the stuff people are seeing is the result of similar sorts of tests.
So I think they're both areas of interest, at least...but the Bell people have taken that and run pretty far...seems to have a lot of traction with rural libertarian types, especially. Kind of like the "Montana guillotine warehouses" do with the fundies...

Removing even copies of classified documents without authorization is a serious offense that can get you thrown in jail for many years. What has been effectively put to rest are the accusations of the wing-nuts that he was somehow trying to hide information from the 9/11 commission.
Regardless of the outcome, however, Berger will never hold another position requiring a security clearance.

First, let me explain what how this list came about--I attempted to post a longer list on atrios earlier today but continue to be blocked by a firewall, apparently, while at work. So I forwarded the list for posting so that those who really wanted to make some noise now could get started.
Second, the names are hardly the definitive list of movers and shakers. It wasn't intended to be. It was compiled to reach many of the regular folks in newsrooms as a way of generating some noise. Nothing, and I mean nothing, scares newspaper editors as much as what looks like a groundswell of complaints about coverage. Guess what? When editors and reporters start hearing from lots of people, senior editors think they've messed up. But senior editors often have their emails screened and thus don't necessarily see what people have to say.
Assigning editors and reporters are absolutely not the only people who
determine what gets into the paper. Copy editors and news desk editors at most papers write the headlines, photo captions, do the final editing of stories, and determine how stories are played.
The idea of providing the email names was to generate noise in newsrooms, a subtle or not so subtle way of saying, hey! how come your paper didn't print X? Or how did you let Y bias get into print? They are the ones working tonight, putting together the paper, rounding out coverage from the wires, asking the assigning editors or reporters about missing angles to stories, and thus are in the position
to say, wait a minute, maybe we missed this.
This is no small thing. It is a truism of newspapers that copy editors represent the last line of defense, the last chance to give the readers the best coverage the paper can provide, and eliminate the bias, before the paper is delivered to readers.
And given the complaints I read on this site everyday about newspaper coverage, anything that will help journalists pay attention, stiffen the spine, understand what the complaints are about coverage, is a good thing.
Believe me, news desk people--and some of them are copy desk chiefs--have a great deal to say about what readers actually read.
By no means is this a complete list. But no one ever said it was. It's just a start.

You should learn to keep quiet when you don't know what you are talking about. I'm not a lawer, but As someone who has held a US security clearance for about 15 years now, I know exactly what they drill into you regarding the handling of classified material.
First, it's all classified, even copies. Second, no, Sandy Berger is not a spy - did I say that? Didn't think so. Next, Did he have a clearance - he had to have in order to even be allowed to see the documents. Last, It doesn't matter who wrote the documents - they are classified.
I did not make the charges, it is the whole basis for the investigation, and the penalty is a statement of fact - it does not mean that even if he is charged with mishandling classified materials that he will do any time, it is just a possibility - unlikely in my estimation, but nevertheless, it is there.
Why hasn't he been charged with anything - the original investigation is still ongoing the only thing that was revealed today was that no original documents were removed or lost - as far as the charge of misshandling documents goes, that issue was a sideline and was only germaine to wing-nuts trying to score political points.

Oh, and by the way, if the thing you do with classified material more serious than the terror speculations Berger glanced at happens to be giving it to a foreign state's embassy, you get rewarded with a pay raise and tenure. Ask Dougie Feith.
(Notice: Giving classified material to foreign countries other than USrael will probably not result in this. Thee are foreign countries and then there are foreign countries.)

The reason you aren't seeing corrections is that Berger hasn't been cleared. Removing the documents was a serious violation - whether or not any docs were destroyed is utterly irrelevant. If a non-celebrity pulled what Berger pulled, it would be a minimum of 20 years in federal prison.
