In some ways, the United States is witnessing a repeat of Election 2000 where Bush first frustrated Al Gore’s demands for recounts in Florida and then had five Republicans on the U.S. Supreme Court block a recount ordered by the state Supreme Court. Finally, the five Republican justices in Washington required that a reorganized Florida recount be conducted in two hours, a clearly impossible task that handed the presidency to George W. Bush.
Placing national unity as a priority over democracy, the U.S. news media stepped in after Election 2000 to sweep away any lingering doubts about Bush’s legitimacy. The unity message was that the United States needed to put the contentious election in the past, even though Bush was the first popular-vote loser in more than a century to move into the White House.

Basically we covered Standing, Commerce Clause (normal and dormant) and the 1st and the 14th amd with a couple of other things thrown in. The doctrine of intergovernmental immunities might have taken up 10 minutes of class time and may warrant a multiple choice question if I'm so lucky.

The fiancee and I (she's a law student too) are doing heavy research into doing a visiting third year in a nice, pleasant clime (i.e., not the northeast, which is crushing my soul and whose cold winters are exacerbating a nerve/pain disorder on her part).
/not wanting a Red State lecture right now.

I found similar data referred to as "triple hex" but no concise chart like that yet.

I hate it when I screw up a tab. Was trying to say I've moved from NPR to Pacifica as I get older. But since one is supposed to grow more conservative as one ages, I must be Merlin, because I seem to be aging in reverse.
Really is time to finish grinding that coffee.....

UNM has a very creditable law school. It's chilly in winter, but not the bone-shattering cold of the NE. It's sunny, anyway, even if cold sometimes (this am, it's about 25F in Abq)...

WPKN is a challenge for the new listener. We've been carefully taught to expect all radio stations to be consistent and predictable, and WPKN is simply not that kind of radio. WPKN's programmers enjoy extraordinary freedoms. They conceive and deliver their programs without interference from funding sources or concerns about popularity. Despite all of the interest in respecting "Diversity", our culture actually has no real interest in that which is regarded as "too obscure." This is nothing new, of course. Money has always called the shots, and that which is commercially successful is worshipped. Noncommercial radio was supposed to stand apart from The Marketplace, but ever since the professional consultants got their claws into it, the trend has been toward more and more of less and less. Finally, the open-minded listener is denied the experience of the unfamiliar.

I support KUNM, an outlaw, community radio station here, for their fine local programming....
I tried to get elected to the radio board last election, so as to try to drag the station away from the toils of NPR. They could drop it completely, without any noticeable effect upon the audience: NPR could easily be replaced by Pacifica...But there's resistance in the management...Nice thing about KUNM, tho, is that the volunteers have a LOT of power (too much, for the NPR maiknstreamers).

Yeah, I read it last night, 'cause a post linking to his photograph had that column underneath it. I posted about it (2:42) with a comment I'd like to repeat here.
That it's not bad enough, all the small-minded nativist crap he spews, but at the end of it all, you've at least gotta be consistent and loyal to those you count as your friends.
This guy is supposed to be a pundit, in his own mind, which implies a minimal knowledge of recent history. Then how could he not know that we went and asked the Hmong's, in the '60's, to concern themselves with a fight that was none of their affair, i.e. to come out of their hills and fight the Vietcong alongside us?
In gratitude, we helped settle many of them here. You know. A little payback to friends of the freedom-loving cause, so we could look ourselves in the mirror afterwards.
But people like Francis have no qualms about forgetting things like that. No consistency. No gratitude. Use 'em up, turn your back.
To wit, he writes (about an local gov't attempt to reach out and explain our customs to Hmong immigrants):

Ours was Roger Groot, sort of a 6'3" brushcut ex-Marine Lewis Black character.
During orientation, the upperclassmen invariably warned us about him.
Sure enough, first day of Criminal Law, he calls on me. My answers weren't sufficient. Let's just say he "set the tone" on classroom preparation on me in front of 65 classmates.
I felt like Fred Flintstone getting smaller and smaller.
I've often though that the White House Press corps needed a person like Roger Groot.
Shrub would be microsopic after two minutes.
It turns out, Groot is a great guy and donates much of his valuable time personally defending indigent clients and prevailing.

Aw, I know law's not for everybody, but I love my job. Great pay. Interesting work. Good outlet for those of us with, shall we say, a competitive streak. And, the chance, once in a while, to do some real good. One day early in my career I was sitting in the firm's law library and looked up, realized that I was getting paid to sit in a library and read, and knew I'd died and gone to heaven.

I fibbed when I said I never looked back after changing careers.
I'm proud of my law school friends who stuck with it and did a lot of good for people over the years.
Also, most of them are partnered-up by now and living kinda large.
It just wasn't for me.

I was so angry I wanted to burn my evidence textbook in front of his office door in one of the ubiquitous metal wastebaskets found around the law school. My friends stole my book so I couldn't do it.

George Tenet is my neighbor. I guess it's ok to say this, since he's no longer Mr. Director. Never actually saw him, but there are often one or two black SUVs outside his house or a few guys in suits and IDs around their necks standing in his driveway, waiting for him I guess, even after he left. I thought they were CIA, but now I think they are Secret Service.

I haven't had any truly fearsome professors, but when I took civ pro I was completely overwhelmed. I didn't even know what I was learning. I lived in constant terror of being called on. I made it through my first recitation and then decided to go on the offense by asking a question per class. The idea was to make the professor so sick of me that she wouldn't ask me for another recitation. It worked. It was my worst grade in law school, but I passed and that was enough for me.

Fenian, I still don't know what to think about the guy. He did preside over the destruction of the CIA. But OTOH, my own view is that it was a system that was twisted past the breaking point by Cheney and the neocons. No matter how good or "reformed" an organization is, it can be broken if it is abused. But that slam-dunk comment, if true, goes a long way in forming my opinion of Mr. Director.
I read once that in meetings with Bush, Tenet would discuss baseball. I thought this was a shrewd thing to do. Now I think he probably really was interested in baseball.

Episcopal churches tend to have the best music around here but they have the worst thrift shops, for men's clothes at least. Last time I went into one there were some really awful things that looked like some golfer had died. I thought of joining after fleeing the Catholic church but am enjoying free floating for now.
If I wasn't so old I'd go to law school. At my age it would be tempting fate to try anything that long term.

Glad you enjoy your job. I enjoyed particularly tieing an opposing law firm's tail in notes with obscure procedural questions once, when I was a law clerk. Ran 'em in circles for months on an issue of standing. Found the obscure stuff that nobody was sure was right, but it always was.
Made me the theologian I am today.

I am not in disagreement with you except for this: know your enemy. The Repugs will do whatever they can get away with; it is the way they are. How are they getting away with it is the operant question. The answer is simple but elusive:it is simply the news media in general. I would suggest we start there. Picket your local news stations with a thousand people demanding they tell the truth. Have examples printed up of their lying and toting the admininstrations water. If a thousand is not enough, get ten thousand. Go to the source of the Repug's power - the complicity of the news. Refuse to buy the local rag. Picket them daily till they begin to tell the truth.
Push them into confrontation, make them arrest someone and then fight it with everything we have till it become the "Scott Peterson" story of the moment.
I see little hope in reforming the system for the system is the way it is: I see hope of spreading sunlight on the nefarious lies of this bunch of cretinous sycophants.

How are they getting away with it is the operant question. The answer is simple but elusive:it is simply the news media in general. I would suggest we start there. Picket your local news stations with a thousand people demanding they tell the truth. Have examples printed up of their lying and toting the admininstrations water. If a thousand is not enough, get ten thousand. Go to the source of the Repug's power - the complicity of the news. Refuse to buy the local rag. Picket them daily till they begin to tell the truth.
Push them into confrontation, make them arrest someone and then fight it with everything we have till it become the "Scott Peterson" story of the moment.
I see little hope in reforming the system for the system is the way it is: I see hope of spreading sunlight on the nefarious lies of this bunch of cretinous sycophants.

What I enjoyed was helping people. What I was doing, was getting paid to bash on someone else, in the name of helping my client.
Children, especially, were the battlefield. The last straw was when I sat with pictures of what a teenage boy looks like after his father takes a golf club to him in a fit of rage, listening to the father's lawyer on the other end tell me the wife (my client) just wanted the divorce for the money.
My client just wanted out. I was forbidden to tell him what I knew. I had to take the afternoon off after that phone call.

There is a difference between feeling good an affecting change. The other day I was offered a seminar in the middle of January. I refused. The thing would have been at some Bible-thumping church in Grand Rapids and I refuse to further the intermixing of church and state and I am simply not going to spend my time and money in a place that supports that asshole in the People's house.
But if you want to have change, you must attack at the weakest point. The news media is complacent only because their cooperation elicits positive responses from the powers that be and not much negative (if any) from anyone else. If we can convince them that the path of least resistence is in supporting the wishes of the people and to begin being truthful (Which this poor sad souls thing of themselves as being anyway) I believe that change is possible. Bashing a Bushite, while satisfying, is not much better than masturbating for procreation.

Yep. All the horror stories you've heard are true. But for truly weird and procedurally complicated, this was my favorite.

I don't know about Robert M. Jeffers, but I've done some pro bono family law work and, I'll tell you, you've never seen bitter antagonists who will literally cut off their own nose to spite their face until you've done family law.

With all this lawyer comment, will add my two cents. I have several lawyers in the family, prosecutors and civil and defense. Do not neglect the prosecutorial side. Maybe in big cities its all about ambition, but remember the prosecutors are on the side of justice when they do it right and they get the bad guys off the streets. The way some people refer to them they are slime, throwing totally innocent people in jail. Check out some of the victims of crime and get a different pov. Also, don't neglect business law because its all crooked cuz then you're giving it all away to ambitious repugs. We need decent moral people in business but they are all getting chased away by the dishonesty of it all.

I hail from the good ole days of SAC...Peace was Our Profession...War was just our Hobby.
Odd thing is that in times of Peace I can find ample work in the Techie field, but when War breaks out, I loose my employability in the civilan workforce. And for some strange reason, I get a call outta nowhere from someone I haven't heard from in years that's "aware" I'm on the lamm and need some "work" to hold me over until "things pick up". I really can smell the napalm in the morning air sometimes.
On the flip-side, what's interesting is to listen to the "news" American's are fed and really "seeing" the truth. For instance, the dollar to Euro rate is said the be a boon for US manufactures to sell American products abroad....too bad they neglect to mention that Europe in in a deep recession and can't afford to buy the cheaper American-made products.
I'm still waiting to hear a sound plan of attack for the Democrats to take our country back from the Republicans...the rest of the world is waiting to hear something positive too. Satelite dipping under the horizon...gonna loose my link.

As for family law, judging by the things I see at the courthouse, the most fucked are the Juvenile hearings with Domestic close behind. Our so-called justice system really, truly is bent. I have to leave the courthouse due to my wife's having found a job in Arizona after 13 months of layoff and I won't be sorry not to have to see 10-year-olds in handcuffs on a frequent basis.

Don't I fuckin wish...I ache in places, and for reasons, which i never experienced before...like, when I bend for too long sideways, i develop this incredible, almost incapacitating stitch in my side...also, i seem to have become afflicted with sciatica, mostly on the right side, but sometimes on the left too...a friend just died this week at age 51, of liver cancer... it's a bitch, but life's just short...
