But he failed to return a questionnaire needed for the F.B.I. to conduct a background check, and he never received that clearance."

That's really a helluva thing to forget, isn't it? You're the head police officer in New York City on 9/11. And in the weeks and months after that, preventing another attack is priority numbers 1 through 100. And you don't get around to returning the form that will take care of the background check that will get you the highest level clearance possible? The access to the most detailed and most highly classified information?

Think about that. It's extraordinary.


But wait, it gets even worse...

Drip, drip, drip. WNBC in New York is reporting that Kerik may never have filled out the proper forms that would have allowed for a background check for him to become police commissioner either.

that's like snoozing on a highway on-ramp.

obviously a tragedy, but i seriously doubt that this was purposeful. also, bergamo has made major democratic contributions so pulling on this guy might not be such a good idea.

She was lying on the ramp in the parking lot.

Let me guess - if she had thrown herself into the path of an Amtrak train, you would want the railroad indicted for war crimes.

Honorary police badge for offering ones body so the police commissioner can unwind and relax in the middle of his taxing duties -- this is a fresh touch.

Gravatarum, sorry, but this is not uncommon for drivers to get off in situations like this. there are even more extreme examples; in my former home town in california there are many cyclists, so there were bike lanes built along the right side of the road. a driver that fell asleep at the wheel of his car nailed a cyclist in the bike lane and killed him. it was labled a freak accident and the driver was let off. i believe that it is very difficult to charge manslaugter in these "freak accident", cases and even more so in this case with homeless lady.

I find this very hard to believe. If the driver was asleep, s/he was clearly negligent and would have faced some penalty for that.

It's not hard to charge manslaughter in "freak accidents" when someone is negligent. I don't know why this case would be any harder to prosecute than any other in which someone is unintentionally killed by a driver--except that he had a buddy heading up the police force.
