WELL, of course, Karl Rove did it. He may not have violated the Intelligence Identities Protection Act of 1982, with its high threshold of criminality for outing a covert agent, but there's no doubt he trashed Joseph Wilson and Valerie Plame. We know this not only because of Matt Cooper's e-mail, but also because of Mr. Rove's own history. Trashing is in his nature, and bad things happen, usually through under-the-radar whispers, to decent people (and their wives) who get in his way. In the 2000 South Carolina primary, John McCain's wife, Cindy, was rumored to be a drug addict (and Senator McCain was rumored to be mentally unstable). In the 1994 Texas governor's race, Ann Richards found herself rumored to be a lesbian. The implication that Mr. Wilson was a John Kerry-ish girlie man beholden to his wife for his meal ticket is of a thematic piece with previous mud splattered on Rove political adversaries. The difference is that this time Mr. Rove got caught.

Even so, we shouldn't get hung up on him - or on most of the other supposed leading figures in this scandal thus far. Not Matt Cooper or Judy Miller or the Wilsons or the bad guy everyone loves to hate, the former CNN star Robert Novak. This scandal is not about them in the end, any more than Watergate was about Dwight Chapin and Donald Segretti or Woodward and Bernstein. It is about the president of the United States. It is about a plot that was hatched at the top of the administration and in which everyone else, Mr. Rove included, are at most secondary players.

You would think that someone at the NYTimes would sit up and say, "jeez, Rich makes so much sense and bobo is an idiot." But no.

And I think the only way that happens is if there's a gigantic media scandal, i.e., evidence that the media has been covering up serious government malfeasance, like the deliberate outing of a CIA agent, or sending us to war on false pretenses.

If it somehow comes out that the media has been covering for the administration on both counts, then maybe, just *maybe*, there's a chance for some sweeping changes.

But I'm not holding my breath.

bingo, It's the same point as for criminal prosecution at the local level.

If you've got some scofalaws running around, breaking into people's houses, killing folks, and mugging the weak on the streets, a prosecuter needs to do his job applying punishment, to reduce the crime wave. If he doesn't it will continue and even increase.

Criminal behavior in high office is the same. Letting it happen without any consequences, encourages the worst of the thugs to get into office.

I think the key here is how contained the blast radius of this is. If it takes down Rove and/or Bush but leaves the Republican party and its lapdog media standing, is that going to be sufficient in the long run?

Again, Bush is gone in 2009, regardless. If the GOP can amputate him and save its skin, what have we really won?

GravatarSen. Sensenbrenner interfered in a Illinois case to demanded the maximum sentence for drug courier convicted in a police corruption trial prosecuted by Fitzgerald's office. He also asked the DOJ to investigate why Fitzgerald's office didn't ask for the maximum sentence.

Maybe someone should ask the Senator if he thinks maximum sentences should be applied in criminal contempt convictions, too.

GravatarI just read an old post by Mark Kleiman. Pay particular attention to his fourth point.

First, there seems to be no doubt that the leak occurred, that some of Bush's top people were responsible, and that Plame was undercover. That means that at least two people close to the President are facing potential ten-year prison sentences.

Second, the source for this story (a "senior Administration official" but not a "top White House official," which probably means either from the CIA or from the Justice Department, more likely the former) refused to identify the two leakers "for the record," which clearly implies that he did identify them off the record. Since the story mentions Joseph Wilson's use of Karl Rove's name, it would be natural for the reporter to have hinted that Rove was not in fact one of the guilty parties, had that been the case. But there is no such hint. Of all the people in the White House, Rove is probably the one Bush can least afford to lose, and the one who gives Bush the least deniability.

Third, the source is clearly prominent enough that any FBI investigation would have to include him. Having told the truth to a reporter, he's not going to lie to the FBI, which itself would be a crime. That means that the leakers are likely to find themselves, in fairly short order, confronting first the FBI and then a grand jury. (Any thought Ashcroft might have had of stifling this just vanished.)


Fourth, the leakers peddled the story to six other journalists, none of whom took the bait, and any of whom might confirm the identity of the leakers.

If TalkLeft is correct, and Miller is found guilty of contempt, she will likely be sentenced in accordance with the guidelines for obstruction of justice.

At first glance, the guidelines would give her an offense level of 14-17. (Anyone know what that translates to in years?)

But it's also possible that she could be sentenced as an accessory after the fact, to whatever Fitzgerald is trying to charge the leaker with.

If, as Billmon noted, that charge is espionage, the sentence for being an accessory to espionage could well be life.

That's not likely, but I hope Miller's at least thinking about the possibility.
