Agreed on your post. I would take it one step further - Juan Cole had an excellent post last week on the wall that the Israelis are erecting in Jerusalem. It seems that the effect - intended or otherwise - of the wall is to enflame the Muslim world against the Jewish state AND those states that support them.

Instead of worrying about how to fight terrorism as a primary exercise, why don't we consider what it is that we are doing to make them so dedicated to our destruction? I know that the kneejerkers will chortle with joy over that comment because for them, President Dumbnuts saying, "Evil - they are just evil" is enough for them. But I am not one who accepts dogma from any quarter.

I believe that we do not need Karen Hughes to run a PR campaign, I believe we need a realistic assessement of what the government of the US and others are doing to enflame Muslim's passions.

If we understand, maybe we can ameliorate. If we can ameliorate, maybe we won't have to give an innocent man the five shots in the head . . . .

And I recall US taxpayers are paying $900,000,000 directly to the construction cost of the wall. The best Chimpy can say is "the wall is a problem", then authorizes the dough. This is a special add on to Israeli security aid. I believe an additional $15 billion since 9/11 above the usual foreign aid package.

No. I have the same mixed relationship with them (arrested on a political; demo, knowing the wrong people, etc.) that I always did, but I am safe: I am white and I have a middle class voice and I live in a middle class inner city suburb. (If I'd idealised the police before this, then I would have a different relationship with them now.)

We've seen some, but I want to see more; but they will be careful because the more they say, the more likely it is the police involved in this shooting will be charged with murder. (Of course scapegoating them is not good enough unless they clearly broke the rules of the policy -- to shoot suspected suicide bombers -- and I think they did.)

All police shootings here are investigated but -- to P. O'Neill -- there really will be a full inquiry about this one, I am sure. I hope so because the story as it stands now does not make sense.

I'm helping one of my wife's friends that lost her husband after a brief illness. He got a will, but slipped into a coma before signing it. Lots of assets in his name. Thirty year marriage, four kids, no ex-wife, etc, so nobody to contest anything.

Does she need to hire a probate lawyer? Does she get something from a probate lawyer which will allow her to move everything into her name? Anything I'm missing?

Thanks for letting me know the problem was on my end. But now I'm really perplexed.

Clearing the cache didn't help at all, so I decided to re-boot. When I shut down the tabbed browser, suddenly the ZA firewall software popped up to warn me that it had blocked my computer's attempt to connect with www.huffingtonpost.com.

The detailed info on this warning showed that my computer attempted to connect with port 80 of another computer, calling itself huffintonpost, but using an invalid address -- 70.183.191.23 -- an address reserved by the IANA and not for regular use.

Supposedly anyone using this address is forging the site.

Anybody got a clue? I ain't as techie as I oughta be, but this sounds sorta hinky.

A "forged address" doesn't give me a warm fuzzy.

Memories of probate law tell me that without a will (did he leave one in his handwriting? Even unsigned, that would work) means it passes under intestacy laws, which means the kids split things with the wife per the statutes.

Probably need a probate lawyer just to get all real property transferred to one person, if the four kids don't want it. Mom gets a survivor's estate in the homestead, but there are questions of transferability of title later that are better resolved now.

Personal property no one will really care about, presumably. If the kids are minors, even the real estate problems are minor (relatively).

But the only way to answer the questions is to get a probate lawyer involved. Unfortunately. Ironic, as Texas law was designed to let you self-probate (although that seldom works out so well, and then only with a well-written will).

Could be a virus. THere is one that modifies your hosts file (sort of local DNS).

If you are using Microsqaush, try c:windowssystem32driversetc, or just look for a file named 'hosts'. Open it with notepad (not write, wordpad or word) and look for a line with huffingtonpost and remove it. maybe others too, really you probably shouldn't need any addresses listed there for a home system.

chris/tx - get a lawyer. Any probate really should have a lawyer just to make it go smoothly. It's one of those things that people sometimes do without a lawyer, like uncontested divorce. But I wouldn't go through probate without one, even in a straightforward situation. When my mother died, for example. I paid a lawyer to take the estate through probate, and it was cut and dried.

The situation you described is not straightforward and a lawyer is going to be a necessity. The lack of a signature is something that a lawyer needs to deal with.

The stated reasons are the following:

1. He was followed by police after leaving an apartment building that the police were staking out in connection with the investigation. No word on how the building was connected to the investigation, nor how many people lived there.

2. He was wearing a large jacket in the middle of the summer. Many here suggested it is common for immigrants from warmer climes to wear jackets during the summer in London... so that isn't necessarily suspect.

3. He "challenged" the police. No idea what that means exactly. They were, apparently in plain clothes, and they did chase him.

It seems clear that he either did not know they were police officers or he thought they were after him for an immigration violation.

If they had good reason for thinking that he had a bomb, then killing him would be excusable, indeed it is what we would expect the police to do.

They need to eventually disclose why they suspected that he had a bomb... so far, all we know is that he ran away from some dudes chasing him in inner-city London and that he came out of a certain apartment building...

I really hope that there is more to this story.

GravatarChris/tx, I second the advice to retain a lawyer. Intestacy laws vary somewhat from state to state. In some, eg. (I believe) Wisconsin, the spouse automatically inherits all. But things can get weird if don't know the laws and procedures in question. An attorney practicing in probate should be able to walk things through the process with relative ease.


GravatarThanks Tena - I was just telling my wife what RMJ said. My wife had failed to tell me even though the will was not signed, he verbally agreed to the will in front of two witnesses and the lawyer. I guess this is what the lawyer is hanging his hat on.

The reason the will is important is one son (oldest) is already saying his dad promised to give him the rent house his parents own and he lives in. I'm just trying to make sure she gets everything as she still has two children to put through college, and is years away from retirement.

Anyway, I'm going to make sure she follows through with hiring a probate lawyer as you both (RMJ/Tena) think it is the best thing to do. And because the estate is fairly large.

flory, it's glorious. Something rolled in while I was downtown and it's about 58 and cloudy and there was some rain already and I think more is coming.

I really didn't think I could take many more nights in the 60's. It will be great sleeping weather tonight.

Thing about the temperature up here is that at 80-something, you cook because the sun is just brutal up here.

Yes, well, this precise sort of "tragedy" happens when the British police force begins behaving like Americans.

In my city here in the "land of the free" the shooting of unarmed American citizens, who are predominantly black or brown, are shot dead by white police officers who "shoot-to-kill" at the slightest provocation.

Moreover, these appalling slayings of unarmed black and brown people by trigger-happy white police officers -- incidents that have occurred multiiple times in my city during the past decade -- have resulted in the police enjoying full exoneration and absolution in each and every case by the required but perfunctory "police inquiry."

The police investigate themselves and exonerate themselves -- and no police officer has ever been held responsible or accountable. If it is later discerned that the dead person was suffering from mental illness -- which has been the case in a number of instances -- the police might offer a mild apology followed by strong declarations of justification for shooting first and asking questions later.

The Brits would do well to abandon American trigger-happy policing in London and throughout the UK and return to a more sane and rational method of detection, apprehension, and incarceration.

The Brits, at least, have the decency to apologize for the trigger-happy behavior of their policemen and to rightly call the event a "tragedy." Surely, that is light years beyond what their American counterparts are inclined to do.

Still, Mr. Menezes is dead at the age of 27 -- innocent, walking in the vicinity of a tube station, and suddenly chased onto a train and shot dead with five bullets to the head because he was "suspected" of some involvement in the bombing plots, and, yes, for looking like he just might be Muslim.

So, the late Mr. Menezes has been absolved and declared innocent by the same police force whose officer decided that he was guilty and deserving of execution in public without a trial or due process.

It's so sad. But, now that the 27 year-old Mr. Menezes has been absolved of any guilt by the London police, he is too dead to enjoy his newly-redeemed innocence.

For shame!

i was saying he was wrong. so were many others. he was wrong, and many of said so at the time. otherwise, why would they have been trying so hard to convince us? saddam's regime had been virtually destroyed by the first gulf war and the draconian sanctions. powell and rice said so in 2000. pretending that everyone bought that the vial of talcum powder proved the existance of tons of anthrax is just wrong. that is also why so many of us were and are furious at the dems in congress who went along with this madness.

This "tragedy" -- and it certainly is that and an outrage as well! -- is exactly what happens when the police behave like "terrorists."

I believe it's called "state-sponsored terrorism" when police officers are given orders to "shoot-to-kill" unarmed citizens.

Finally, the innocent Mr. Menezes, age 27, is still dead and no apology can change that!

The BBC article does suggest, however, that the police officers will be brought to justice for their reckless and violent behavior -- and that would be a refreshing change from what occurs in my American city with shocking frequency.

I am not sure if you know this, but in my teaching job I work deeply immersed in the African American community. I have done so for my entire professional life. (into my third decade now)

I have been thinking that if I were a black person I would be much more paranoid at this juncture than ever before. It is not so much the DWB thing as it is something much much deeper. This hatred of people who are not like "them" is positively frightening. Killing is okay, as long as it is someone of color - seems to be their mindset.

I don't like the knee-jerk reaction from the left that the officers were to blame. I'm sick of the reaction that muslims are not to blame for anything. Fareed Zakaria (sp?) on Daily Show this week mentioned that there is no "pope" in the Muslim world who can put out a Grand Unified Thou Shalt Not policy on terrorism.

What Zakaria added was something encouraging that I hadn't heard before. That moderate voices are rising in Islam to say, "no, this terrorism activity is a real problem. it is destroying what we stand for."

Hopefully, there is a silver lining that more moderate voices will rise and they will come to power in Muslim countries. Zakaria also mentioned that the hardcore Muslim parties typically go down in flames whenever there is a democratic election.

Dim rays of hope, but the simple truth that change will have to come from the Muslim community, and not from Anglos dropping bombs on brown people.

Having read the comments in this thread and the one below, I don't get the feeling that everyone "is blaming" the officers. My feeling is that they were assuming he had a bomb under his jacket and were scared shitless. With everything else that has occurred in London the last two weeks, I can understand--sorta. I agree with many here that police are trained not to pull a gun a kill someone for merely running away. This was knee-jerk reaction to me, and police shouldn't be police, if that is their nature.

GravatarWell, good news on the kitties' dental adventures. The big kitty who had five teeth extracted Tuesday is feeling much better, good enough to successfully resist taking his pills (but I fooled him by crushing his pill into some canned-tuna juice and pouring the tuna juice over his favorite fancy feast). And what's better yet, the little kitty didn't need any dental work at all. And the checkbook heaves a sigh of relief.

In fact, "we" taught the Israelis everything they know about law "enforcement" and sold them the weapons with which to carry out their "policing" methods -- while, of course, giving them $3 billion per with which to buy their weaponry (from U.S. military contrctors) and to build their apartheid wall!

The method can be summarized as "shoot-to-kill first and then declare the victim to be a "suspected" terrorist, member of Hamas, or Hezbollah, or Islamic Jihad, or whatever the Israeli/American flavor of the month happens to be.

In the early Middle Ages this was known as a blood-feud among warring factions -- a theory in which might makes right -- that was as brutal and stupid and barbaric as it was unsuccessful in the long term.

And no one (in his or her right mind) would argue that the Israelis -- for all their brutality and oppression of the Palestinians -- have enjoyed much success at bringing peace to the Israeli/Palestinian conflict. Even the crazies in the settlements would be hard-pressed to make such a claim.

But, I know...I know...the argument is that it's all the fault of the Palestinians -- but somehow that mantra is ringing hollow even among those who have been inclined to support Israel in the past.
