In his speech, Biden accused conservative jurists and constitutional thinkers of placing the interests of the powerful ahead of the people, while at the same time forcing government into people's private lives.

If we assume that our Founding Fathers were honorable men, then it follows that today's so-called conservatives (a seedy group of lying, scheming, ratfuck assholes) could not possibly understand the "original intent" of the Constitution.

Would anyone expect a diseased slug to comprehend Einstein's Theory of Relativity simply because it had slimed its way through his garden?

Schmidt looking like fool - using all of Bush's OLD talking points as if somehow she had fail to even keep up with FOX news latest Bush talking points (ie within the last six months).

Hackett look very sharp, a lot more more like a congressional material. And sound more like conservative with his "conviction". I was a conversative - I feel sure I'd vote for Hackett.

I wouldn't be supised if Hackett wins, unless of course the state has those damn paperless voting machines.

No mention of how the House held the vote open on CAFTA for several hours, or the questions about the vote, or the fact the GOP controls both Houses, and what did you really expect, a filibuster on ever piece of legislation (considering the Senate had already approved CAFTA), nor any mention that CAFTA passed the House by just two votes, and the vote closed as soon as that happened.

Actually, the former. It's a pretty mainstream group, but they can be very serious about the Constitution, and most are pretty upset with the current maladministration.

Hearings on Roberts won't be before September, despite what Specter might threaten, and if Bush appoints Bolton during the recess, Roberts is suddenly in the cross-hairs.

Besides, Dems have pointed out O'Connor won't resign until the replacement is approved, so they'll argue there is no hurry. And I don't think they like the foot-dragging Bush is doing on releasing documents, AND they can read the polls. The country is turning in their direction.

And on something not nearly as important as a lifetime SCOTUS seat, which we'd be able to train our full attention on. Dems have got to be relentless on this. They simply can't back down from their stonewalling. Plus, refusing to answer questions is something really simple that Joe Sixpack can get his mind around. Can Bush legally use a recess appointment to get Bolton in as ambassador to the UN?

Since Bush likes a strict constructionist view of the constitution, what exactly does the constitution say about recess appointments? Under Section 2, it says:
"The President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session."

In the context of 18th century traveling, this makes a lot of sense. If someone died or left suddenly, it was very difficult to get the senate together quickly to confirm a replacement. No planes, no trains, just horses and buggies.

So the original intent of the framers was to make sure the government kept functioning until the senate could return and a long term appointment put in place. It was never meant as a way to sidestep the senate's advice and consent powers by shoving a nominee through that's unpalatable even to the president's own party.

John Danforth resigned as US Amb. to the UN in a letter dated Nov. 22, 2004, and was announced Dec. 02, 2004.

It seems to me that this nomination can not be recess appointed, since Danforth's resignation did not happen during a recess. The senate has had ample opportunity to debate and discuss Bolton as a nominee, and he has not received the senate's consent.

The bottom line is, is it constitutional for Bush to ignore the original intent of the founding fathers and manipulate his nominee into place?

Saw Edward's speech. Love his economic populism theme, which is exactly what Democrats need to win back blue collar voters. Over the last 25 years, Rethugs took over many of the blue collar people by convincing them with lies and exaggerations that Liberals are NOT fighting for them, but are instead just trying to tell them what to do. You all know the characture that was served up: the pointy-headed leftie intellectual with his plan to micromanage society. People, particularly in the so-called Heartland bought into it. It was a lie, but they believed it -- and look what it has gotten them -- the struggling, failed, fiery wreck of the W preznitwittery, where up is down, war is peace, looting the treasury is tax relief for the richest Murikans.

This is a stupid question, and I apologize in advance, but what good are our laws if they aren't for "ALL" the people, and not just the ones with money? Money equals laws equals justice, and politicians, our supposedly representatives, seem to be for sale.

The way the Senate and House are run these days, and bills passed (huge bills with hidden pork) is a disgrace.

Corporations and wealthy hire lobbyiest that make bids to our Representatives who appear to take the highest bidder.

We can't even get honest elections in our country! No one seems to care or wants to really fix the problem without some political advantage.

What is the problem? What is the root cause? Does Democracy work when a country is so wealthy; is it because the wealth is concentrated; is it because corporations are treated like individuals?

I know our country has had some hard times, but the corruption seems at an all time high.

Hopefully, the Democrats will use their time to frame the hearings as an effort to cover up Bush Administration illegalities.

Um, I've actually been there the past two days, and in fact the average age can't be more than about twenty-seven. And the consensus about Roberts is, he may be inevitable, but we should not let him pass without not only asking him the tough questions, but calling him out if he doesn't give frank and detailed answers. Biden - of whom I'm no particular fan - gave a great, great speech along these lines.

It's a terrific event, and keep in mind, those who may see it as "boring" from 10,000 feet - it is because we ceded these "boring" issues to the wingnut lawyers twenty years ago that we're stuck with the right-wing courts we have now.

We have to take them back, and that's what ACS is trying to do.
