it will go back to the states...

it will never be outlawed altogether...

I wish these folks would get that and worry about the other changes these new judges will bring....

GravatarDr. Dobson holds a Doctorate of Philosophy in child development from the University of Southern California (1967). He was an Associate Clinical Professor of Pediatrics at the University of Southern California School of Medicine for 14 years. He spent 17 years on the staff of the Children's Hospital of Los Angeles in the Division of Child Development and Medical Genetics.

He is a clinical member of the American Association for Marriage and Family Therapy, a licensed psychologist in California, and is listed in Who's Who in Medicine and Healthcare. He also has a long list of honorary doctorates from various institutions.

Dobson has also served at the invitation of presidents and attorneys general on government advisory panels and testified at several government hearings. Among many other awards he has been given the "Layman of the Year" award by the National Association of Evangelicals in 1982, "The Children's Friend" honor by Childhelp USA, (an advocate agency against child abuse) in 1987, and the Humanitarian Award by the

Hey thank you! Thank You! Ill be here all weekend. I'll be appearing at the Nevelle in September, tip your waitresses.

GravatarI doubt radical cleric Muqtada al Dobson gets much respect in medical circles these days. The American Academy of Pediatrics hasn't really gone in for the "gays make bad parents" line. Seems the medical science says otherwise.
Plus that whole "curing the gays" thing is really out there.

GravatarIt terrifies me to think that with Ohio so vulnerable, my choices for Governor in 2006 could be pro-choice Montgomery (R) and pro-life Strickland (D).

The new boss will also be in a position to overrule any decision by Fitzgerald to issue indictments.

The position we're talking about is Deputy Attorney General, currently held by the widely admired James Comey, who is leaving for private practice.

Fortunately, the Deputy Attorney General position requires Senate approval. This is a MUST FILIBUSTER situation. Any Democrat who declines to filibuster will be complicit in what looks to me like an attempt to obstruct justice.
Newsweek's Michael Isikoff will splash a story in tomorrow's Newsweek which reveals that the boss of CIA leak probe prosecutor Patrick Fitzgerald is likely to be replaced by a former Bush classmate at Yale.
What's more, Newsweek has found that the new boss is a fellow initiate of the Yale secret society, Skull and Bones. Details will appear on the magazine's website early Sunday and on newsstands Monday.

GravatarThanks, guys.

I know he insists on being called "Dr. James Dobson" in intros, etc. You reinforced my memory that he was/is not, however, an MD or even a DO.

I've read about his triumph of will over a very small dog just trying to sleep warm, too.

He's a real Herbert, that stickypants.

GravatarThis would indicate to me that these two politicians, one of whom is running for president and the other who is trying to keep his seat in a swing state, have seen numbers that indicate the religious right is hurting their chances.

These fuckers are at best, 30% of the population. They are marginal and way outside the mainstream. I hope the GOP keeps pandering to the lunatic wingers.

GravatarYou have to wonder about a body politic in which Rick Santorum is #3.

Too bad the Senate doesn't work like Al Qaeda.

oh, and a lackadaisical blogwhore.

GravatarFortunately, the Deputy Attorney General position requires Senate approval. This is a MUST FILIBUSTER situation.

So this is not all that harrowing, for the moment.

What are the chances Fitzgerald will wrap up his investigation before the new appointee is even considered?

GravatarShortybrown, stop spreading disinfo.

Fitzgerald doesn't issue indictments. neither does his boss. The GJ renders a finding and a judge acts on it and issues.

Now Ollie Willis and Ezra are dumping on David Sirota.

I get this vibe off some Dems that SO pisses me off...like those of us who actually think that some core Democratic issue is worth having some passion about are somehow too naive or too embarassing to be seen with.

And then they accuse US of ruining the party.

GravatarPart of his struggle got off on a very wrong foot, way back when the framing devolved into "pro-life" vs "pro-abortion". Ok Ok, I understand that is a false dichotomoy, but that is the obvious bumper sticker reduction that is Easy To Make. And "pro-choice" is hardly an improvement, since it is too analytical, and choice itself is often accompanied by disquiet and anxiety. In this we have the short end of the image and framing stick.

I blame John Anderson for squeezing Reagan into the WH, and with him the undisputed masters of image war.

Freedom, surprisingly, is not easy.

GravatarDonna Marie is super nice.

Gravatarprosecutors don't issue indictments. The GJ finds true bill or no true bill based on the evidence, and you can indict a ham sandwich, a magistrate issues an indictment based on the finding of the GJ.

GravatarThe new boss will also be in a position to overrule any decision by Fitzgerald to issue indictments.

Fortunately, there is nothing the new boss can do shortchange what the grand jury and prosecutor have already learned. That's a done deal. Any attempt to screw the process at this point will be so obviously corrupt that it will do more harm than good. Heh.

GravatarBetter yet, let's put the Right to Privacy on a national referendum. That's really what this is about.

Thank you Samurai Sam - that's exactly right. And that's exactly how the Democrats should frame it, and then hammer on it.

Gravataryou can indict a ham sandwich

Shrub looks around nervously and whistles.

Gravataryou can indict a ham sandwich...

I've had a few of those I would have liked to indict.

GravatarLet's put abortion on demand and same sex marriage on a national referendum. Let America decide! Oh wait, I forgot - when America decides, the left always loses. Even without the Atrios-MediaMatters KODE (Kiss Of Death Endorsement)! Nevermind.

Okay, I'm just confused. One matter has been decided as a matter of constitutional law 30+ years ago, and to date the American electorate has not passed an amendment to undo that decision, nor seated a Congress that would radically re-write the abortion laws.

And the other issue is one for the states, not a national referendum.

See how silly this stuff is when you treat it rationally? Life is too short to be gloomy, or to argue nonsense like this.

GravatarActually the accurate and fair terms are pro-abortion v. anti-abortion.

I prefer Pro-Women's Rights vs. Pro-Dark Ages, myself.

Gravatarnational referendum=constitutional amendment

GravatarActually the accurate and fair terms are pro-abortion v. anti-abortion.

No, because I'm not "pro-abortion." I actually have problems with the morality of abortion.

But I have bigger problems imposing that morality on another person. Abortion is unique, and I prefer the choice be left to the individual, not be determined by the state (which is a fantastically blunt instrument with no delicacy at all. Better the decision be left to the person concerned.)

Which makes me pro-choice. Not pro-abortion.

Gravatar"Screw with Fitzgerald, and the GOP will lose positions all the way down to dog catcher in '06." Amen, brother.

GravatarI read the Kos post, it certainly looks like a lot of borrowing problems. I have confidence Fitzgerald knows how it all works, I don't understand getting worked up by what could happen at this point...

Rmj, Wandering Aengus

Rmj, not to be too downbeat, but this administration has gone places none has gone before.

GravatarI think the more fundamental issue is about granting all people equal integrity. After all, it took a long and great fight to get here, where women and minorities have the right to vote and not get lynched for wanting to, so all the retro-rethugs have left is to intimidate them for their natural reproductive rights, and gays for being who they are. That's flat-out intolerance.

Such is the bane created by all religions that fail to treasure all humanity equally and do not yet focus on the spiritual evolution of the self through careful and sincere introspection.

In other words, if you SAY God is within, then MEAN IT in your actions! Be responsible for your own behavior, your own karma. Otherwise, you live your own lies, deluded into thinking God is "out there," somewhere, while you continue to abuse your own brothers and sisters. I guess you just don't know any better, yet...

GravatarNo, because I'm not "pro-abortion." I actually have problems with the morality of abortion.

But I have bigger problems imposing that morality on another person. Abortion is unique, and I prefer the choice be left to the individual, not be determined by the state (which is a fantastically blunt instrument with no delicacy at all. Better the decision be left to the person concerned.)

Plus, a true "pro-abortion" position would be one that required the government to actively encourage or even mandate abortions. I'm fairly sure none of us are advocating that...

GravatarBecause of the Fifth Amendment, the federal legal system has to use grand juries to bring charges, at least for certain offenses. The Fifth Amendment to the U.S. Constitution requires that charges for all capital and "infamous" crimes be brought by an indictment returned by a grand jury. The amendment has been interpreted to require that an indictment be used to charge federal felonies, unless a defendant waives his or her right to be indicted by a grand jury. The Supreme Court has held that this part of the Fifth Amendment is not binding on the states, so they can use grand juries or not, as they wish.

GravatarOtter's amendment sounds great, but if we do not get some Michael-Deaver-and-Frank-Luntz ( ... spits ... ) -class marketers we are unlikely to make the necessary headway. The argument is easy to win, but the battle is another matter.

THE EQUAL RIGHTS AMENDMENT

Section 1. Equality of rights under the law shall not be denied or abridged by the United States or by any state on account of sex.

Section 2. The Congress shall have the power to enforce, by appropriate legislation, the provisions of this article.

Section 3. This amendment shall take effect two years after the date of ratification.

-

GravatarJenny--

I don't say they won't do it.

But the price will be so high, it'll be the last thing they ever get to do.

Nixon had people bamboozled during Watergate. Then he fired the "special prosecutor."

It was all over after that. Even the GOP members of Congress stopped protecting him then. Wouldn't happen that way, now, but they wouldn't last through the next elections, anyway. 45% of the public, per a poll Atrios posted today, think Rove is guilty. Fire Fitzgerald, and that number will double. Guaranteed.

And it'll be all over for Bush, but the cryin'.

GravatarA lot of people who want to limit abortion rights think that women can get elective abortions right up until the day of delivery. That's not true, but if I believed it I would probably want more restrictions on abortion rights. We need to educate people about what Roe v. Wade really meant and what kinds of restrictions are currently put on women who want to have an abortion.

Gravatardemocrats can't make money off the people if they give them what they want. they don't want to get us out of iraq they just want to take the republicans seat.

this whole thing is bullshit you know that right?

GravatarI suppose they could waive rights

(If a defendant waives his or her right to be indicted by a grand jury, the prosecutor can charge them by using an "information." An information is simply a pleading that accuses the defendants of committing crimes, just as an indictment does. The difference between an indictment and an information is that a grand jury must approve an indictment, while a prosecutor can issue an information without the grand jury's approval or, for that matter, without ever showing the information to the grand jury.)

Since most federal prosecutions involve felony charges, grand juries play an important role in enforcing federal criminal law. The sections below describe the essential aspects of federal grand juries.

GravatarBut I have bigger problems imposing that morality on another person. Abortion is unique, and I prefer the choice be left to the individual, not be determined by the state (which is a fantastically blunt instrument with no delicacy at all. Better the decision be left to the person concerned.)

I spent most of the day with Hispanic folk. The people I was with had various numbers of children - black eyed, dumpling darling children of lots of different ages - some of them looked just like mine own bebes, and some looked as tho they could have been adopted by Mr. Judge Roberts.

None of these children had put in tokens for permission. They were here. They were loved and not loved and tolerated and not tolerated ... but they were all here. I pinched their cheeks. They were here, and living and now. This is what a child is. One who is here. One whose cheeks I can pinch and whose tummies I can tickle and whose toes I can tweak. Before that? They are hope. Hope is a wonderful thing, something that I'd not deny to anyone and which I'd dash at risk to my soul. But hope fails. We are human beings, and hope is not always realised.

Beautiful little babies, here and now with pink stockings and pretty sticky smiles. They're real. Hope? Oh, my dears.

Gravatarthis whole thing is bullshit you know that right?
spearNmagicHelmet

Like I said, all is vanity and striving after emptiness.

Still, you can light a candle, or you can curse the darkness.

I like candles better than darkness.

GravatarGrand jury functions

Historically, grand juries have performed two functions. They decided whether someone should be charged--"indicted"--for committing a crime. They also investigated criminal activity and the conduct of public affairs. Before the American Revolution, colonial grand juries essentially ran local government, supervising everything from road-building and bridge maintenance to the operation of local jails. Over the years, they lost much of their public affairs function, as the operation of local government was taken over by administrative agencies, an institution that did not exist in colonial times.

In the modern federal system, grand juries do not investigate civil matters. In fact, it is an abuse of the grand jury process to use a federal grand jury to gather evidence for use in a civil proceeding. Federal grand juries concentrate on investigating and bringing charges for federal crimes.

There are two kinds of federal grand juries: Regular federal grand juries and special federal grand juries. Regular federal grand juries tend to spend their time hearing evidence and considering indictments submitted to them by a prosecutor. They spend the bulk of their time deciding, therefore, whether probable cause exists to return a set of proposed charges against the defendants names therein. Special federal grand juries were created in 1970 specifically to investigate organized crime. They, too, consider whether indictments should be returned against certain persons, but special grand juries also devote a great deal of their time to investigating possible criminal activity.

GravatarI'm with RMJ. Abortion is not simple; it's fantastically complicated, and for precisely that reason must be left to the owner of the uterus in question.

I'd add that the prevention of septic abortions, which can kill young women horribly or leave them sterile, is an end well worth pursuing...

I doubt progressives and moderate dems are really so far apart on "social" issues as all that, frankly.

Vinnie, I may have misunderstood you, but RMJ was not apologizing to the troll, he was giving an explanation of what it means to be pro-choice. It was an elegant enough explanation that it silenced the troll. There is more than one way to put these pathetic people in their place.

pixie

Let me guess, both of them are men.

This is not a "single issue" issue. Beyond the right to privacy are equal protection under the law, basic civil rights and a lack of adequate representation. Laws that limit a woman's access to abortion discriminate on the basis of both sex (they don't affect men) and age (they only affect women who are fertile). And let's also be clear that the majority of our legislators and the majority of our judges are men, even though women make up the majority of the citizenry.

I've said it before and I'll say it again ... if men don't like the fact that women are having abortions, then let them be fully responsible for their own behavior and wear condoms every time they have sex. If they did, the whole problem of unwanted pregnancies would virtually disappear. Any pro-life man who won't do his part to prevent an unwanted pregnancy is a fucking hypocrite (pun intended).

GravatarHow many fucking posts have you seen describing Hackett's loss as a serious omen for the R's? Jesus, a loss is a loss is loss.

Yup. We're all seduced by the illusions of power, position, influence. So tell me, which do you think is better, one person taking a thousand steps, or a thousand people taking one step?

What Bob Dylan said about that was:
"Ah'm jes average, common too,
Ah'm jes like him
and the same as you,
Ah'm ever'body's brother an' son,
Ah ain't different'n anyone.
Ain't no use talkin' to me,

We either get over our self-centeredness and begin helping each other get better for real, or we remain at the mercy of our collective karma. That choice is individual.

GravatarHey Tom, why don't you just go fuck off?

GravatarLOL!

GravatarDamn, isn't anybody else tired of apologizing for being right?

Didn't Durbin's teary eyed mea culpa make anyone else sick?

GravatarTo stand up and spit in a liar's eye isn't "being like them". It is speaking truth to power.

GravatarSchiavopalooza

Brilliant.

Yeah, Vinnie, I was really annoyed with Durbin, but I'm sure there's way more to the story. Mainly, he had to backpedal on account of the Nazi comparison, because, as we know, the pro Israel lobby won't tolerate anyone comparing any tragedy to the Holocaust. I'm not an anti-Semite by any means, but that lobby has WAY too much say-so, IMO.

Gravatarway late to discussion, but suspect that some democratic strategists think this is a good reason for us to "meet them in the middle" by running as social conservatives --- just without James Dobson. But anyone who thinks this is someone who hasn't been watching politics for the last 20 years.

Rinse lather and REPEAT!

GravatarYes by all means let's compromise with people who are playing to destroy us. There is no compromise with fanatics.

GravatarIf the Democrats don't remember who we are, they're wasting everyone's time. We are the party that supports Civil Rights, including those of video game makers and musicians. They shouldn't be advocating censorship - it scares the shit out of liberals!

We believe that if a right isn't enumerated in the Constitution, it is reserved to the people, so privacy rights are assumed. It's not about abortion, it's about and adult citizen who happens to be female being able to make her own medical decisions and to make decisions about her own body.

Between Dean yapping about appealing to anti-choice voters (using a Republican frame, no less), and Hillary taking up the same cause that TANKED Gore and Lieberman, I'm beginning to think they never want to win another election. Not that winning is possible on Diebold machines, but it would be nice if they'd at least pretend to be an opposition party.

GravatarOnce again - anyone suggesting that "WE should be moving toward more social conservatism" - do not include me in that we. I actually vote for people who I agree with based on my own opinions and ideas. The only exception I have made to this was John Kerry and I won't make another one. So if the Democrats nominate some asshole, fence-riding politician like, say, Lieberman or Hillary Clinton, they are not getting my vote.

GravatarHow much of an issue is James Dobson going to make of John Roberts helping out gay advocates? Is Dobson willing to walk away from President Bush?

GravatarThe first way to stop "running from the abortion issue" is to NOT ACCEPT the language that the right has used to "frame" the issue...NO ONE discussing this from "our side" should accept PRO-LIFE as a descriptor...it should immediately be changed to ANTI-ABORTION and we MUST identify ourselves always as PRO-CHOICE not supporters of ABORTION...the beginning of the power of the right was when they were able to define the terms...look at what has been done to the meaning of LIBERAL! By MY definition of the terms conservative and liberal I would have no trouble selecting liberal if GOD ALMIGHTY were standing before me asking for the choice!

GravatarSORRY, QuentinCompson, that's what happens when I see the topic and run to comment BEFORE reading the posts! But nice to see someone in agreement.

GravatarAs a gay person, I have to say that the democrats running from gay marriage is very demoralizing and dispiriting.
It is a grotesque failure of leadership.
When is Hillary's Sister Souljah moment, I wonder. I have no doubt she'll stab my community in the back for "value" voters votes.

GravatarThe biggest issue on many peoples minds these days is the war on terror. I suggest that if our candidates can attack the war in Iraq as increasing terrorism and toughen up their rhetoric against fundamentalists who are succeeding in their despicable acts we might start winning.

This was the sole issue that won G.W.Bush the 2004 election. Every month since Bush was elected terrorism has gotten worse. There was never a suicide bombing in Iraq. Never. Now there are 7 or 8 a day.

I believe this is the issue that can win votes. Since the Iraq war terrorism has increased exponentially all over the world. This administration is vulnerable. Our candidates should be hammering away at this issue--not by supporting candidates who have been to Iraq and want to stay and finish the job but by directly linking the war in Iraq to increased acts of terrorism all over the world.

Attack the argument that by fighting over there we are keeping the terrorists from coming here. They will come here at some point we all know it and if we can get candidates to consistently demolish that argument when it does happen here it makes the other side look really bad.

And it is a values issue.

GravatarVinnie -

This is like a bad game of Rumors.

My conditional apology to you only applied if I had critized you unfairly. I extended this courtesy because I assumed you to be a regular commenter here.

I am not an appeaser, an apologist or a compromiser when I am dealing with an issue I believe in. If you look back over any of my comments in the past 2 years you will see no signs of support for anything you claim. I am furious with the moderates in the democratic party. I'm no Hillary fan, and I'm no fan of any representative who isn't willing to fight for us.

I have never defended Durbin's decision to apologize. As a matter of fact, I was horrified and upset when he did.

Your disrespect for Rmj came out of left field, as far as I could see, and it seemed hurtful for no reason.

You are what's wrong with the democratic party... because you are stooooopid!

Now if you want to offer ME an apology I'll accept it graciously and not call you names, but I doubt you will.

GravatarI don't think anyone is advocating we become the party of Dobson and Falwell. No one is saying we should abandon stem cell research. They are merely saying that we should move to the CENTER on some of issues. The public will never support partial birth abortion or gay marriage.

GravatarOne reason is the dominance of the Senate and electoral college by largely rural, conservative states.

GravatarThe public will never support partial birth abortion or gay marriage.

See also: "The public will never support abortion rights, or inter-racial marriage."

GravatarAbortion is an abomination. Ever since it has been carried out illegally or legally it has maimed the woman and murdered the child! We are a country of instant gratification and screwing each other without commitment is a way of life for many. It is also against every religion's principles. I knew it was evil before it was legal and it is still evil and it is the in vogue thing to be for in this country! How many readers have seen an aborted child? Few, they just want the instant gratification of fucking someone and getting away with it! I say that a morality like this is bringing this country down quickly and finally and that probably is a good thing because everything is wrong with Amerikkka!

Gravatarlike how did we get to this point? we arrived at this point because things have been an abomination all along. abortion is not the start or the end of abomination. just add it to the list if you wish to so call it.
and if you want to invoke god--remember he gave this decision to women exclusively--that is what you don't like. the loss of power, of control.
so this really is not a male discussion or issue at all. women do not get pregnant on their own, all by themselves.
abortion is a cleanup tool women have.
