Personally, I can't say whether he is or he isn't. Give me one reason to believe he is. The past lies and misdirections concerning the overall conflict with the shady Islamic world makes me suspicious of his motives. The administration's continued need for extreme privacy and controll over their public environment. The shutting out of dissenting voices. The parade of political allies appointed to jobs they had no credit to do. The rather suspect way this current imbroglio came to light. The cheerleading he's done against personal liberties, from the Patriot Act to the attempted constitutional ban on gay marriage. The rather shitty way he responded to it in this morning's radio address. I don't trust the man. I don't like not trusting the president, but I don't.
Besides, there's absolutely no reason to take the president - any president - on just his word alone. He's a public servent, answerable to the people and the Constitution. If what he's doing indeed is against the law of the land, then it's wrong. The ends do not justify the means, especially when one man has that much power.

The fact remains that, despite Bush's weak attempts to show the contrary, he completely manipulated the evidence leading to the Iraq War. That much is obvious to any critical observer. The Plamegate scandal, the Downings Street Memo, the revelations made by Richard Clarke (and of course his own character assassination), Powell and Rice's pre 9-11 comments; these all lead to the same conclusion: Bush intentionally misused the intelligence on WMD on Iraq to justify war.
On December 16, however he goes from bashing Novakula to justifying Bush's "Constitution is just a piece of paper".

That's your right. I don't trust the government - any government - enough for this sort of unfettered power. I know the U.S. government has spied on citizens before, not because they posed a threat to the nation, but because they posed some sort of threat to people in power (MLK, for example).
I also don't particularly trust the Bush government for the reasons listed above, but I'd be just as concerned if Clinton pulled this sort of thing. It's still early in this whole affair yet, and I do honestly think both sides are doing more screaming than listening - which is more a comment on the current ugliness of American partisan politics than anything else - but I simply refuse to trust anyone with that much extra-Constitutional power just on word alone. No one's that perfect, and the limits on the government exist in the Constitution for a reason.
Right now, that's my main most beef with Bush's radio speech this morning.

There is no Article 48 in the American Constitution.
Article 48 belonged to the German Constitution of the Weimar Republic. It game the President the right to suspend the laws of the land if he felt that the nation was in danger.
It was the article that Hitler and Hindenberg invoked after the Reichstag power, and the Article that spelled
the doom of the Weimar Republic.
So let me ask you...what laws SHOULD the president be allowed to disregard if he thinks the situation warrants it? All of them? Some of them? Just a pesky few? Or shall we just let Bush decided which laws he wants to obey and which laws he wants to disregard?

I will refer you to Berger vs. New York, US Supreme Court, 1940, which stated that the State does not have a "blanket grant of protection" to eavesdrop without adequate judicial supervision.
Furthermore, failing to eavesdrop without a warrant has been a violation of Federal Law since 1968.
Berger vs. New York even stated that such wiretaps, if they went on too long, were indeed the equivalent of a search without a warrant under the Fourth Amendment.
The President is a lawbreaker. He's a lawbreaker under the Fourth Amendment. And he's a lawbreaker under Federal Law. He's a lawbreaker, period.
