And yet, neither Congress nor the Supreme Court have any explicit constitutional authority to make these decisions. Congress can cut-off funding for the war or any aspect of it, which it has not; and the judiciary's only role in these matters is to defer to the president, who has explicit and broad authority under the Constitution as the commander-in-chief.
Today, the Court has taken a giant new step in its usurpation of explicit presidential authority. The battle against terrorism is being fought as much in our courtrooms as on the field in Iraq and other places — where the likes of the ACLU and activist judges will set policy in contravention of the Constitution.
Congress and the courts are conferring rights and privileges on terrorists. They are conferring constitutonal protections on the enemy. They are granting the enemy jurisdiction in our civilian courts. They are extending the Geneva Conventions to an enemy that is specifically excluded from those protections.
I wrote an entire book on the subject of the Supreme Court, and how it's destroying America.
Which clearly makes him an expert. I mean, a whole book! Jeepers!
And that's exactly what it's doing. In 2004, the Court said, in two cases — Rasul and Hamdi — for the first time in our history, that unlawful enemy combatants — that is, terrorists who themselves refuse to comply with the rules of law — have a legal right to access to our federal civilian courts and can file habeas corpus petitions there. That means they can ask a federal judge to determine whether their detention is proper. In the past, the Supreme Court refused to grant such access to our courts. And as I wrote at the time, this is a slippery slope. Having broken down the wall of restraint that had traditionally been recognized by the Court, there appears to be no limit anymore on the judiciary's role in second-guessing the commander-in-chief. And that's exactly what happened today.

insanely easy and delicious recipe
until somebody notices.
RAINBOW TROUT STUFFED WITH SPINACH, PINE NUTS AND DILL
4 8-ounce rainbow trout,filleted,
butterflied, rinsed and patted dry
Kosher or sea salt
freshly ground pepper
2 tablespoons sweet butter
1/4 cup pine nuts
1 minced garlic clove
10 ounces spinach, cleaned
1/4 cup golden raisins
3 tablespoons chopped dill
2 tablespoons extra virgin olive oil
1: Season each fish inside and out with
salt and pepper.
2: In a large skillet, melt butter over
medium high heat. Add pine nuts and garlic
and saute until golden and fragrant, about
one minute. Add spinach and let wilt, about
2 or 3 minutes. Stir in raisins and dill,
and cook one minute more.
3: Divide spinach mixture into quarters and
stuff each fillet with filling. Tie each
fillet with kitchen string.
4: Return pan to medium heat and warm oil
until sizzling. Cook fish until skin is
golden and fish opaque, about five minutes
for first side and three minutes for
second. Remove, and remove string before serving.
5: Your tongue throws a party for your mouth.

But note: If Congress decides to alter the UCMJ and override the Geneva Conventions, the President can have his military tribunals with procedures as unfair as he wants. But that would require that Congress publicly decide (1) that it no longer wanted to abide by the principle of uniformity announced in the UCMJ, (2) that it no longer required that military commissions abide by the laws of war, or, finally, (3) that Congress no longer considered the Geneva Conventions binding on the United States.

NPR had a former Navy JAG on who worked on the tribunals for Gitmo. Completely overridden by the White House, and he said the damage is "irreparable" and that "our children will be paying for it." Rewrite UCMJ to exclude due process, etc., you put every one in the military under an even worse legal system than they have now. One with virtually no legal protections at all. Just to punish a few terrorists.
I got a big picture of that happening, even with this Congress.

I'm an England supporter, most of the time. When they deserve it and this year they sure did not( divas and bad coaching). I never expected France to get there, they played awful in the first round. But they woke up vs Togo (without Zidane) and then were magnificient vs Spain and today they dominate Brazil!.
