GravatarThe real question that comes to mind is, why? The Washington Post and the New York Times have both been amazingly acquiescence when it comes to the malfeasance of this administration. Certainly they have minor complaints, but overall, they have done little to point out the lawless behavior and raise the publics' consciousness as to the vile nature of their deeds.

It would be different if they had actually done something. As it stands, if they complain, it is laughable.

Yup, I think it's pretty fucking amazing that the animal was able to read the person so well. We "train" our dogs, but they do it right back at us, too, so there are lots of different intelligences and we don't give our companions enough credit oft times.

ummm... montag. no. a warrant was not required to tap US citizens overseas previously. Everything outside the US was fair game previously.

Now it requires a warrant to directly target a US citizen abroad, but no data minimisation required if the US citizen's data is *accidentally* picked up in a broad collection effort.

Beg to differ. Here's what USC 50, Sec. 1802 says about when the President can order surveillance without warrant. This is the law prior to the most recent changes:

(a)
(1) Notwithstanding any other law, the President, through the Attorney General, may authorize electronic surveillance without a court order under this subchapter to acquire foreign intelligence information for periods of up to one year if the Attorney General certifies in writing under oath that—
(A) the electronic surveillance is solely directed at—
(i) the acquisition of the contents of communications transmitted by means of communications used exclusively between or among foreign powers, as defined in section 1801 (a)(1), (2), or (3) of this title; or
(ii) the acquisition of technical intelligence, other than the spoken communications of individuals, from property or premises under the open and exclusive control of a foreign power, as defined in section 1801 (a)(1), (2), or (3) of this title;
(B) there is no substantial likelihood that the surveillance will acquire the contents of any communication to which a United States person is a party; and
(C) the proposed minimization procedures with respect to such surveillance meet the definition of minimization procedures under section 1801 (h) of this title; and

if the Attorney General reports such minimization procedures and any changes thereto to the House Permanent Select Committee on Intelligence and the Senate Select Committee on Intelligence at least thirty days prior to their effective date, unless the Attorney General determines immediate action is required and notifies the committees immediately of such minimization procedures and the reason for their becoming effective immediately.

Note particularly subsections (a)(1)(A) and (B). US persons are specifically excluded. This subsection says that the US Attorney General must certify that communications to be intercepted are those of a foreign power or between foreign powers (other definitions would include agents thereof), and that it is reasonably expected that the communications of US persons will not be involved.

That's why there are further minimization requirements in this section which must be reported to Congress.
