Yes you can, however, you cannot punish someone for an act committed before it was declared illegal. You can decide an act that was previously illegal does not deserve punishment. Think of the three strike drug laws that have been overturned resulting in many prisoners being released early.

While I understand the logic of the argument, I disagree with it. Mainly because the 4th Amendment is not a prohibition on the activity of private citizens, only government. They are not prohibited from what they did by the Constitution but by statute, and Congress can grant them immunity or change their liability or anything else.

So Newsweek released a new poll yesterday afternoon breathlessly reporting "Barack finally has his bounce," claiming that according to their latest poll Obama has opened up a 15 point lead against McCain. Further, Reuters did an entire article dedicated to nothing but trumpeting the Newsweek poll's results.

Looking at the the pollster.com and RCP polling averages I see that not a single other poll has Obama up by anything more than six. That's quite the outlier. And Newsweek's methodology here seems highly suspect — 1010 people polled, and the bulk of that is 896 registered voters, comprised of 324 Democrats vs.231 Republicans, with the remainder indpendent.


You know from shit about polling, so you should keep your mouth shut.

Took three hours to get across town by bus and everything went through downtown, so even if you only wanted to go a few miles around the outskirts of town you had to ride 20 miles to get there. Wonder why nobody was riding....

Give us some trains that actually work and even in the west it might be practical. But to get to a train from Phoenix, you apparently have to go to Flagstaff first. That's practical, right?

By contrast, if Obama had said, "I'm not voting for this bill because it's badly written and harmful to Americans. Just because sexists have used comments on hair and dress to slam women doesn't make any such comments sexist for all time--it's the intention of the sexist that is the issue.

I'm not saying I disagree with you, just trying to think of it from different perspectives. The issue is a difficult one to argue against in campaign soundbites, while arguing for is easy -- national security terror terror terror.

So if you're trying to decide what the issues for the campaign will be this might not be at the top of your list.

I think Obama really does want to win this by a landslide with long, long coattails so he has the capital to charge in with the changes he wants us to help make. The more non-Blue Dog Dems elected, the less power the Blue Doggers have but they're treated respectfully to persuade them to reach consensus on imperative change.

I'm a big supporter of Obama's new cooperative model of politics. But that doesn't mean you don't try to weight the voices at the table in different ways.

GravatarI heard on one of the talking head shows yesterday that Blue Dogs put a lot of pressure on the pass the FISA bill because they're facing tough opposition in the upcoming elections.

I'd like any of them to show one shred of evidence that a single goddam vote will be cast *for* them on the basis of this pusillanimous FISA legislation. OTOH, they are alienating their base and reinforcing the GOP frame that Dems are soft on terror. If they're plaing defense, they're fucking losing.

That's why Obama gets no pass from me on not stepping up and cracking heads together on this. Hint: The GOP will say if he is elected, everyone is gonna die, no matter what the fuck he or any other Dem does. So quit deferring the 20%ers and represent the goddam 80% of the country that has steam coming out of its ears over these motherfucking assholes who drove us off the cliff.

What savvy activists.

Obama winning IS good news for Republicans--you won't get universal health care, withdrawal from Iraq, or accountability for Republican crimes (to pick only the most obvious looming betrayals from the Candidate of Hope), but it will all be on the Dems watch. PLUS they get to impeach him in the end. Public disgust with spineless Dems becomes the springboard to another majority in 2012. It's a win-win.

Granted that the election is not over, and could still go either way, but how Obama's lead becomes good news for the Repubs seems like a bit of a stretch, if not a completely mindless comparison.
Not a fan of Reagan but even he could only achieve W.'s levels of incompetence and duplicity in his nightmares. Fair to say that George the First benefitted from a lot of residual goodwill towards Reagan.
Dukakis also never replied to a single charge leveled against him. Obama is proving effective at that, at least.

I care about the end result of that far more than I care about Obama's vote the other day.

Maybe he's saving this as a defense against the inevitable "abuse of power" shrieking from the Right that will commence on Jan 21, 2009.

I'm more or less resigned to the fact that no one is going to prosecute the Bush admin for their crimes against humanity and the Constitution. It's not like Hillary would have done anything. I don't think Edwards would have, either.
