MEMRI and Instapundit report that a Kurdistan newspaper has published (on its first page) a 2002 letter from Saddam Hussein's office, reaching out directly to al Qaeda's No. 2, Ayman Zawahiri, about the possibility of attacks in Saudi Arabia. [h/t Mark Eichenlaub of the Regime of Terror blog]
Of course, I cannot vouch for its authenticity. If it's legit, though, it would be an instance of Iraq collaborating with al Qaeda even after the 9/11 attacks. We'll see.

You cannot retroactively legalize unconstitutional behavior.
Yes you can, however, you cannot punish someone for an act committed before it was declared illegal. You can decide an act that was previously illegal does not deserve punishment. Think of the three strike drug laws that have been overturned resulting in many prisoners being released early.
Not a lawyer, just a paralegal who worked in law enforcement.

No. The telecoms activities were unconstitutional because they violated the 4th Amendment, and Congress cannot change that. That is what people are arguing. It is a civil rights violation regardless of whether or not it is illegal under FISA.

While I understand the logic of the argument, I disagree with it. Mainly because the 4th Amendment is not a prohibition on the activity of private citizens, only government. They are not prohibited from what they did by the Constitution but by statute, and Congress can grant them immunity or change their liability or anything else.

Look Who's the Divider [Kathryn Jean Lopez]
Barack Obama, the Democrats' candidate for president, yesterday in Florida:
"We know what kind of campaign they're going to run. They're going to try to make you afraid. They're going to try to make you afraid of me. He's young and inexperienced and he's got a funny name. And did I mention he's black? He's got a feisty wife," he said to cheers. "Ultimately, I think the American people recognize that old stuff hasn't moved us forward. That old stuff just divides us."
The ironic thing is a lot of the people on the Right who say they're attracted to him are attracted to him because he is black — they think it will be a good moment for America for a black man named Barack Obama to be elected president.
My problem is I'd prefer not to have a conventional liberal in the White House who underestimates the threats we face. The prospect of electing such a president does scare me. And it disappoints me Obama doesn't want to have debate about the future of our country in a way that doesn't demonize those who oppose him.
How can you debate someone who constantly forgets what the subject is?

Thanks Snow. It's just that when I took the Constitutional law class, so so many years ago, ex post facto had a specific context. Obamaweek Strikes Again [Mark Hemingway]
So Newsweek released a new poll yesterday afternoon breathlessly reporting "Barack finally has his bounce," claiming that according to their latest poll Obama has opened up a 15 point lead against McCain. Further, Reuters did an entire article dedicated to nothing but trumpeting the Newsweek poll's results.
Looking at the the pollster.com and RCP polling averages I see that not a single other poll has Obama up by anything more than six. That's quite the outlier. And Newsweek's methodology here seems highly suspect — 1010 people polled, and the bulk of that is 896 registered voters, comprised of 324 Democrats vs.231 Republicans, with the remainder indpendent.
You know from shit about polling, so you should keep your mouth shut.

Trouble is, all the estimates of threats of foriegn people is phrased as "If they do something, how much will it threaten us getting what we want through Congress? How much will it stregnthen the Opposition Party threat? How much will it threaten the deals we got going?"
the concept that a threat might actually be a , you know, threat, is a null concept there.
Once again, I'm sorry to be the skunk at the garden party, but as far as I'm concerned, after this disgusting FISA sellout the Democrats have officially jumped the shark.
As far as I'm concerned, they can never be counted on to do the right thing ever. And that includes Supreme Court appointments under Obama, which I no longer believe can be counted on to be even reasonably to the left.

An acquaintance who has been trying to convince me that Obama is a Muslim forwarded this email to me last week-
Think you know who this man is?
This possible President of the United States !! Read Below and
ask yourselves, is this REALLY someone we can see as the
President of our great nation!!!!
Below are a few lines from Obama's books; In his words!
From Dreams of My Father: 'I ceased to advertise my mother's race at the age of 12 or 13, when I began to suspect that by doing so I was ingratiating myself to whites.'
From Dreams of My Father : 'I found a solace in nursing a pervasive sense of grievance and animosity against my mother's race.'
From Dreams of My Father: 'There was something about him that made me wary, a little too sure of himself, maybe. And white.'
From Dreams of My Father: 'It remained necessary to prove which side you were on, to show your loyalty to the black masses, to strike out and name names.'
From Dreams of My Father: 'I never emulate white men and brown men whose fates didn't speak to my own. It was into my father's image, the black man, son of Africa , that I'd packed all the attributes I sought in myself , the attributes of Martin and Malcolm, DuBois and Mandela.'
And FINALLY the Most Damming one of ALL of them!!!
From Audacity of Hope: 'I will stand with the Muslims should the political winds shift in an ugly direction.'
* If you have never forwarded an e-mail, now is the time to Do so!!!! We CANNOT have someone with this type of mentality running our GREAT nation!! I don't care whether you a Democrat or a Conservative. We CANNOT turn ourselves over to this type of character in a President. PLEASE help spread the word.

re: stupid e-mail forwards: Did everyone see this? I can't remember where it came from, but someone else will:
Barack Obama wears a FLAG PIN at all times. Even in the shower.
Barack Obama says the PLEDGE OF ALLEGIANCE every time he sees an American flag. He also ends every sentence by saying, "WITH LIBERTY AND JUSTICE FOR ALL." Click here for video of Obama quietly mouthing the PLEDGE OF ALLEGIANCE in his sleep.
A tape exists of Michelle Obama saying the PLEDGE OF ALLEGIANCE at a conference on PATRIOTISM.
Every weekend, Barack and Michelle take their daughters HUNTING.
Barack Obama is a PATRIOTIC AMERICAN. He has one HAND over his HEART at all times. He occasionally switches when one arm gets tired, which is almost never because he is STRONG.
Barack Obama has the DECLARATION OF INDEPENDENCE tattooed on his stomach. It's upside-down, so he can read it while doing sit-ups.
There's only one artist on Barack Obama's iPod: FRANCIS SCOTT KEY.

The party subsequently made changes so that would never happen again.

Ok, here's the theory. Apparently, when the wiretapping started, the Dems were told about it. Now I'm sure it was just enough information to make them feel like accomplices, but not enough that they could do anything about it then. (A lot like the media was treated). Now the threat is that their "collusion" will be revealed.
There's still a couple of problems. Why not just let this shit sunset-let someone else worry about it?
After 9/11 we were all a little twitchy and would forgive a little over zealousness-however everyone seems to be forgetting that this illegal wiretapping began well before 9/11.
I'm guessing the folks running the White House are pushing for a back door way to escape being prosecuted for the pre-9/11 shit...

Pardon the digression to the earlier thread. Wichita used to have pretty pathetic bus service. City solution: Cut routes and times because nobody was riding. Took three hours to get across town by bus and everything went through downtown, so even if you only wanted to go a few miles around the outskirts of town you had to ride 20 miles to get there. Wonder why nobody was riding....
Give us some trains that actually work and even in the west it might be practical. But to get to a train from Phoenix, you apparently have to go to Flagstaff first. That's practical, right?

so, oil prices skyrocket, much to the benefit of oil companies. the only solution is domestic drilling, much to the benefit of oil companies. oh, and tax cuts to encourage them to drill, much to the benefit of oil companies.
here's my counter plan: you can have your drilling if the oil companies pay for the exploration from their foreign source profits, and any profits from domestic sources go to the american people in the form of universal health care.

While Jeb was governor of Florida, Little Boots pretty much stayed away from the issue, because offshore drilling is very unpopular there. As with everything else, policy is still being driven by politics in the WH.
Now that Jeb is gone, the Idiot-in-Chief is looking to lock down leases for his friends before he leaves office. The increase in gas prices is a politically opportune circumstance, since he believes the American public is stupid and they'll go for this con game of his, that it won't notice that the relatively small benefit is many years in the future and will have no impact on current prices.

However, I'm willing to give him a break for now cause I'm halfway convinced he's being ratfucked by the established elite of the party. Why do you have to jump all over Obama two weeks into his nomination?
Simple answers:
So far the change seems to be unbelievable because there are no backing actions. Talk with out action is just more bullshit.
Example: see the democratic congress.

I heard on one of the talking head shows yesterday that Blue Dogs put a lot of pressure on the pass the FISA bill because they're facing tough opposition in the upcoming elections.
If that's true and really part of the reason it was rushed through, then that's a mighty big favor to call in come January. Which, if Obama is planning major legislation for the first 100 days, could be a good thing.

Yes, he will.
Okay, he's the de facto head of the Democratic party (which is still hard to believe, frankly) ... but I don't underestimate the impact hidden that racism is going to play in this contest. My guess is that he doesn't want to come across as the Scary Black Man who Wants to Bury Your Children by Being Weak on Terra just yet.
Seriously, that a friend of mine, a Hillary supporter, said that Michelle Obama is a power-hungry bitch really blew my mind.
Hillary went to Yale Law School. Michelle went to Harvard Law School.
Hillary married an up and coming political star from Arkansas. Michelle married an up and coming political star from Illinois.
Both are smart, professional, political women.

The more I think about it, the more that this seems to me a capitulation to corporate interests/donors.
The implicit deal is this: let the telcos off, and the Corporatocracy will not go heavy on the Obama campaign.
Go after the telcos, and that's as good as declaring war on the Corporatocracy. And that, folks, would unleash a mud torrent on Obama unrivaled by the Cedar, Iowa, and Mississippi Rivers at full flowage.

The public, by and large, doesn't want to take the time to listen to the explanation.
By contrast, if Obama had said, "I'm not voting for this bill because it's badly written and harmful to Americans. I'm going to work to defeat it and bring the telephone companies and the Bush administration to justice," what would the effect of that have been (other than giving a few fatcats some ventricular fibrillation)?

So a person has a very odd hairstyle or voice, but because the person is a woman such comments are automatically sexism?
Please try again.
To comment on the hair or voice because she is a woman, or more importantly, not fitting a preconcieved notion of womanhood, is sexism.
Just because sexists have used comments on hair and dress to slam women doesn't make any such comments sexist for all time--it's the intention of the sexist that is the issue.
This goes for all the ism's used to beat folks about the head until they learn never to speak a coherent thought again.
If you then think the idea I just put forth is wrong and that I don't "get it" because I am a man--that, too, is sexism.
If you disagree because you think I'm a fool...well that I can't dispute.

I'm not saying I disagree with you, just trying to think of it from different perspectives. The issue is a difficult one to argue against in campaign soundbites, while arguing for is easy -- national security terror terror terror.
So if you're trying to decide what the issues for the campaign will be this might not be at the top of your list.
I think Obama really does want to win this by a landslide with long, long coattails so he has the capital to charge in with the changes he wants us to help make. The more non-Blue Dog Dems elected, the less power the Blue Doggers have but they're treated respectfully to persuade them to reach consensus on imperative change.
I'm a big supporter of Obama's new cooperative model of politics. But that doesn't mean you don't try to weight the voices at the table in different ways.

I'd like any of them to show one shred of evidence that a single goddam vote will be cast *for* them on the basis of this pusillanimous FISA legislation. OTOH, they are alienating their base and reinforcing the GOP frame that Dems are soft on terror. If they're plaing defense, they're fucking losing.
That's why Obama gets no pass from me on not stepping up and cracking heads together on this. Hint: The GOP will say if he is elected, everyone is gonna die, no matter what the fuck he or any other Dem does. So quit deferring the 20%ers and represent the goddam 80% of the country that has steam coming out of its ears over these motherfucking assholes who drove us off the cliff.

Instead of mobilizing to use the one political lever you have to get Obama to fight the FISA bill--the vaunted "grassroots" fundraising base that Obama is relying on instead of public financing--I see we're already back to complacently snarking about Republicans and the media that love them. What savvy activists.
Obama winning IS good news for Republicans--you won't get universal health care, withdrawal from Iraq, or accountability for Republican crimes (to pick only the most obvious looming betrayals from the Candidate of Hope), but it will all be on the Dems watch. PLUS they get to impeach him in the end. Public disgust with spineless Dems becomes the springboard to another majority in 2012. It's a win-win.

Granted that the election is not over, and could still go either way, but how Obama's lead becomes good news for the Repubs seems like a bit of a stretch, if not a completely mindless comparison.
Not a fan of Reagan but even he could only achieve W.'s levels of incompetence and duplicity in his nightmares. Fair to say that George the First benefitted from a lot of residual goodwill towards Reagan.
Dukakis also never replied to a single charge leveled against him. Obama is proving effective at that, at least.
