"presumptuous" can also be mistaken for "presumptive", which both parties' nominees are being called. I bet there is a huge portion of voters who don't know the difference between the words and thus the "presumptuous" label doesn't register much of anything.

Perhaps, perhaps not. With a stronger congress, he/she wouldn't necessarily get approved if McStain nominates. If a Dem nominates an anti-choice candidate for the Court it will be sure to be rubber stamped. Frankly, with these choices for veep, I'm not sure Obama wouldn't nom an anti-choicer.
