Actually, it is. This kind of thing is pretty standard in all sorts of trials. Discovery procedures require it. If you want a judge to start enforcing subpoenas, aka send armed marshalls into the WH to shoot it out w/ the SS in order to seize hard drives, you have to lay down a paper trail that shows you tried to work it out w/o him. I guess that I'm just very used to this sorty of discovery procedure, even though it appears slow-moving and pointless if you're not used to it.

Often parties are expected to exhaust compromise possibilities for seeking court orders. A judge is more likely to grant you your request when he is convinced there is no other way to resolve the conflict. That's a positive thing.

Neither party in Congress is truly interested in confronting Executive Privilege for fear of losing access to it when they have the presidency. So they try to work around it. But this administration is out of time and has no fear of losing in court. That Congress acts this way is nothing but a negative.

They have a remedy which is not dependent upon any court but their own. Sadly that court is evenly divided along party lines at the moment with one fucking independent vote who appears to have sworn allegiance to the Administration.

GravatarI am not a lawyer (and do not play one on tv), but IIRC otherwise priviledged communication (between lawyer/client, etc) loses its priviledge when it can be shown that the communication was in furtherance of the commission of a crime. That's why you write letters and try to get a judge to enforce subpoenas to get the evidence to blow the whole thing wide open. Frustrating, but it takes time.

The Republicans did discovery on Clinton for years and I guarandamntee you they were writing these kinds of letters to back up their requests to the judge to enforce subpoenas. They built their case until they could depo Clinton and get him to lie about sex w/ Lewinsky which they then alleged was perjury since he was under oath.

The evidence that Waxman et al. are trying to get is necessary in order to get enough votes. People like Mary Landrieu and Ben Nelson and Olympia Snowe need it for cover, if not to actually convince them. If we had a huge majority, it might be a different story, but you go to impeachment with the Congress you've got, not the one that you wish that you had.

There are two ways to get this junta out. We can take to the streets. Some of us will die, but if there are enough of us out there, we could still win. I've said a hundred times that I have a pitchfork and I'm ready to go. As a pedestrian, westlaw-researching, law-library-dwelling lawyer, I believe that the people have a legal right to throw this junta out and that such an action would be morally justified.

You've heard about that activist judging? They have assumed it exists because of the separation of powers doctrine. The executive gets to decide how to enforce the laws, so executives have tried to conclude that Congress has no right to ask them how they reached their decisions. The first one to do so was, well, the very first one.

One house votes to impeach. Clinton was impeached. The other house holds a trial. Clinton didn't have to leave office because the Republicans couldn't convinve enough members of that house that he was guilty.

In order to convince moderates in either house to vote the way that we want, we're going to have to show them evidence.

Here's an idea. One of the people who I think is working the hardest to get Bush impeched is Freeway Blogger. He puts signs up everywhere that say "Impeach." Imagine how much bolder Congress would be if, over this weekend, hundreds of "Impeach" signs went up all over America. I've got one in my yard right now. How about if, instead of bitching on a blog, everyone of us goes out and puts up five "Impeach" signs this weekend? I'm certainly willing to do that. Who else will?

WHEAT RIDGE, Colo.—A woman on Friday won her free speech battle with her homeowners' association and will be allowed to display the American flag upside down outside her home in this west Denver suburb. Retired banker Beth Hammer hung the flag the upside-down on March 19, the fourth anniversary of the invasion of Iraq, in protest of the war.

Hanging the flag with the blue field and white stars on the bottom is considered a sign of distress under the federal flag code and has drawn the ire of some in her community and the homeowners' association. In a statement, the Cambridge Park Homeowners Association said it would not pursue enforcement under its "patriotic and political expression policy" because: "The financial and other resource costs to the Association outweigh any harmful impact this violation may have."

The association also said its members still believe Hammer violated the federal flag code and the HOA's issue on how to display a flag had not been settled. The federal flag code states: "The flag should never be displayed with union down, except as a signal of dire distress in instances of extreme danger to life or property."

The HOA held a hearing on the issue Wednesday. Beth Hammer and her husband, Doug, faced fines of up to $500 per violation which could be applied retroactively to the date the flag was hung. Hammer's lawyer, Mari Newman, said the five-member board wouldn't allow her to present evidence of other residents who were violating HOA rules on flags but who were never cited.

Although the Administration is arguing that its decision to withhold the Tillman documents is based on the same principle of executive privilege as is being used in resisting Congressional efforts to get to the bottom of the US Attorney dismissals, the issue can be much more simply framed by the Democrats as a White House standing in the way of the efforts of an American family to get to the bottom of why the government lied to them about the circumstances of their son's death.
I can only hope that Pat Tillman's brother or mother issues a strong statement making that point - - viz, Why is George Bush keeping the truth from us? Why can't we be given the full truth about the circumstances of Pat's death, and the stories and cover-up that followed?

GravatarI agree impeachment is needed to preserve the democracy against a possible competent future administration that will take what digsby called the "tools" the junta leaves behind establish to authoritarian rule. But I just don't see enough GOP Senate support -- leaving aside Lieberman -- to make it happen. Christ, they can't even move away from torture or Iraq.
What would be a reasonable impeachment timeline? I can't see the process going forward after the conventions next summer.

GravatarJP - the form you may have been asked to sign routinely says everything -except- traffic. Don't worry about it. And remember that nobody is paying any attention to you at all - who you visit on your lunch hour is your business. Not even the gossipy little receptionist would dare share any kind of information about who visits whom during legal clinic because she would lose her job. Just call 'em up and make the appointment and take care of it. Chickens always come home to roost if you don't.

I'm not making excuses. I'm saying my better move is to hire an attorney that has no connection to my workplace. I'm not going to jail, unless I am stupid -- they don't come looking for people who miss traffic court, but they do routinely jail them if they're caught driving.
