I, nonetheless feel it is important to note this major qualitative difference between the change elections that brought the conservatives into power and this one bringing the Democrats back. The Republicans pointed to the election results (even those of 2000 and 2004) as evidence if not proof that the people had rejected liberalism whilst many now are pointing to reality's rejection of unregulated market fundamentalism as evidence if not proof of reality's rejection of unregulated market fundamentalism. The latter, being a tautology, is somewhat easier to defend logically.

From Andy Tanenbaum's electoral-vote.com:
Republican candidates for the Senate in Oregon, Louisiana, North Carolina and elsewhere have de facto given up on John McCain and are urging voters to support them as a counterweight to President Obama. They say that one-party rule is bad for the country. Interestingly enough, in 2004, when Republican control of Congress was assured, few Republicans were advocating a vote for John Kerry in order to prevent the dreaded one-party rule. In 2000, 85% of the people voted for the same party for the Senate as for President, so in practice, people do not really split their tickets just to give each party some power. In fact, when Congress and the White House are controlled by different parties, everyone bemoans "the gridlock in Washington."

WASHINGTON (AP) — Barack Obama's aunt, a Kenyan woman who has been quietly living in public housing in Boston, is in the United States illegally after an immigration judge rejected her request for asylum four years ago, The Associated Press has learned.
Zeituni Onyango (zay-TUHN on-YANG-oh), referred to as "Aunti Zeituni" in the Democratic presidential candidate's memoir, was instructed to leave the United States by a U.S. immigration judge who denied her asylum request, a person familiar with the matter told the AP late Friday. This person spoke on condition of anonymity because no one was authorized to discuss Onyango's case.
Onyango, 56, is Obama's late father's half-sister, the Obama campaign has confirmed. She is not a relative whom Obama, 47, has discussed in campaign appearances and, unlike Obama's father and his maternal grandmother, is not someone who has been part of the public discussion about his personal life.
The Obama campaign declined to comment late Friday night.
Information about the deportation case was disclosed and confirmed by two separate sources, one a federal law enforcement official. The information they made available is known to officials in the federal government, but the AP could not establish whether anyone at a political level in the Bush administration or in the McCain campaign had been involved in its release.

Meanwhile, it took me took some serious staring and contemplation to realize that Billy is supposed to be the popular Iron Man character, with his mask pushed up on top of his head (presumably so we’d know that he was really Billy, and not Robert Downey, Jr., come to score some dope from the Keane Kids). DALLAS (AP) — Northern Texas has been getting more rare earth tremors, one day after several minor earthquakes made Halloween memorable for some people in the area.
Two almost simultaneous aftershocks were centered beneath Grand Prairie and Irving just before 7 a.m. Saturday. The U.S. Geological Survey says the Grand Prairie quake measured 2.5 magnitude and the Irving quake came in at 2.7.
Saturday's tremors between Dallas and Fort Worth were in the same general areas as on Friday, when tremors of magnitude 2.5 set off car alarms. Switchboards for 911 systems lit up with calls from people near the quakes' epicenters but no damage was reported.

David Sedaris makes a funny:
I don’t know that it was always this way, but, for as long as I can remember, just as we move into the final weeks of the Presidential campaign the focus shifts to the undecided voters. “Who are they?” the news anchors ask. “And how might they determine the outcome of this election?”
Then you’ll see this man or woman— someone, I always think, who looks very happy to be on TV. “Well, Charlie,” they say, “I’ve gone back and forth on the issues and whatnot, but I just can’t seem to make up my mind!” Some insist that there’s very little difference between candidate A and candidate B. Others claim that they’re with A on defense and health care but are leaning toward B when it comes to the economy.
I look at these people and can’t quite believe that they exist. Are they professional actors? I wonder. Or are they simply laymen who want a lot of attention?
To put them in perspective, I think of being on an airplane. The flight attendant comes down the aisle with her food cart and, eventually, parks it beside my seat. “Can I interest you in the chicken?” she asks. “Or would you prefer the platter of shit with bits of broken glass in it?”
To be undecided in this election is to pause for a moment and then ask how the chicken is cooked.

The poor lady was refused asylum and is scheduled to be sent back to Kenya where it's quite likely that bad things are going to happen to her.
yeah, but my point is that there is no positive thing obama can do about an individual case. if he helps her, he is pulling strings (using his awesome powers of celebrity) to help his own family members. if he does nothing, he's ignoring his family. if he helps to get her deported faster, he's just mean. he has no choice, so how does her situation in any way illuminate his candidacy?
just like mccain being "tested" when he was ordered to go on standby in the cockpit of his plane. what was the test? whether he would obey or disobey the standby order? whether he would desert? he wasn't even ordered into action - there was no choice, so no test, so it has no meaning.

This is not about bashing you, it's about bashing your shockingly naive ideas about how to bring about change. I'm not defending their accomplishments. They are obviously precious few. But they are not collaborators. They were dealt a shitty hand, and if you can't see that, I think it's because you have a deeply distorted view of the American electorate and how it will react to things. Right now, on the eve of the election, the Republican brand is about as unpopular as it has been in my lifetime since Nixon resigned. I submit that if Pelosi and Reid had taken your approach, that would not be the case. Lots of Middle-American types who are now fed up with the Republicans and defecting would have instead snapped back into the fold in the face of an affront to their core identity values. And I'll repeat that it amazes me that you apparently don't understand that. I'll be perfectly happy to see Pelosi and Reid get replaced by somebody a bit more left-leaning now, but I'll not spew infantile rage at them for not single-handedly healing the American psyche. That is not a job that would have been accomplished by impeaching Bush or any other thing they might have done.

i've never understood why people think ethanol is the answer.
It's the anwer if the question is "will [project X] raise or lower corn prices?" and you come from a major corn-growing state.
I admit surprise that prices tanked as much as they did, albeit they did get ludicrously high last year. Everybody around here (w. TN) planted corn last year, lost their asses when the drought hit, and went back to cotton this time.

infantile rage. right.
look, blerb, it's not that i don't understand how things are done. it's that i can contrast what the democrats manage to accomplish with what republicans have. isn't it interesting, how majority or minority, republicans manage to get their way on so many of their pet issues, while dems go on and on about not having enough votes, blah, blah.
i am not one who believes the SCLM narrative that this is a 'conservative' nation. indeed, last night was very informative for me. a bunch of white, middle and upperclass older folks at the party, gushing enthusiastically about a black presidential candidate and things like universal health care and the environment...supposedly these people are either freaky SF leftists or nonexistant, and yet i found myself surrounded by them. if the country doesn't vote more to the left more often, a lot of times, it's because no one speaks to their concerns. that's my belief.
a while back, i posted on a bill that nanci was able to kill, using a procedural trick, no majority voting needed. i found it odd that she could do so, and at the same time go on and on about the inevitability of war funding and fisa and suchlike. don't get me started on her letting people like rove give the finger to congressional subpeonas. yes, i'm an infant having a rage. but the point is that the failures of the current crop of dems have a terrible price, one that we've only just begun to pay. making excuses about process and moderation isn't going to change that.

From Digby...

The case could have been made that Bush's adherence to the unitary executive theory, his assertion of the right to violate federal law as clearly written without check or balance when, in his sole judgment, he thought it necessary, his actual violations of federal law, and his use of signing statements to modify laws as drafted all struck at Congressional prerogatives enshrined in history, the Constitution, and Supreme Court decisions. This case, seems to me, should have been made, and, if necessary, he should have been impeached for it.
That congress didn't fight this is an indictment, principally, alas, of the Republicans in the congress. Pelosi and Reid were faced with the political problem of making what should have been an utterly non-partisan case in an environment where only Democrats would make it. An impeachment of Bush would have been portrayed as nothing more nor less than a partisan exercise along the lines of, and in retribution for, the Clinton impeachment, rather than a defense of the very basis of this country's system of government. The Republican embrace of Bush was total, and a disgrace.
I disagreed with them, but I understand their position.

a dozen years ago or so, every grain elevator around had corn piled up on the ground as they couldn't store it all. corn was $1.70/bu. the original ethanol model was simply to raise corn prices $.25/bu in an attempt to try to help keep the folks on the farm and provided small town jobs.
now that commodity prices are back up, there's really no need for them from a purely 'original intent' perspective. of course, now it's portrayed as a tool to help fight global warming.
take it or leave it i say. it's such a small part of the big picture now it doesn't matter much.
we still have the most stable secure food system on the planet. it's probably the only thing the wingers didn't fuck up while they were in power, although there's probably some storm brewing that won't show until after the election.

I understand why Pelosi said "impeachment is off the table". Short term sensible, long term disastrous.
Impeachment would have done very bad things to the Democrats immediately. But down the road we are going to have an administration that for sheer corruption and evil is going to make Bush II look like FDR. And no one will (metaphorically) pull the trigger then.
The only way to put an end to the imperial governance of swine like Bush and Cheney is to let them have it: jail, loss of pension, bankruptcy, the whole package. Destroy them utterly as politicians and as free men. Let the next wise guy who thinks the VP is a fourth branch of government think twice about spending his sunset years making little ones out of big ones, behind bars.

Bullshit on stilts.
Yep.
I understand why Pelosi said "impeachment is off the table". Short term sensible, long term disastrous.
Nope. The problem with Pelosi's capitulation was, it would have been perfectly fine to say "impeachment is off the table" if she had added "however, there are serious charges and issues here, and they deserve a full investigation" and then FOLLOWED UP ON THAT.
THAT is what the '06 Dems were elected to do. And as far as "collaboration" goes, it is now pretty obvious one of the main reasons Pelosi doesn't want any sort of investigation is her direct involvement in approval of torture and the shredding of the constitution.

Sure, but the question remains of why a liberal district that has elected a supposedly progressive representative for years, does not rebel against Pelosi's capitulationism. The answer, I think is that the structure of US politics is enormously incumbent friendly - the local benefits of a powerful congressperson outweigh the negative effects of her national policies.

In fact, Sen. Clinton is an unbelievably good lawyer, twenty-five years ago one of the top hundred in the country. My mother's farm was represented by the Rose Law Firm in Little Rock (though not by Hillary herself).
I do not know that she has ever been a judge, but many superlative justices have been formerly governors, senators and other non-judicial figures.
The position requires a first rate mind, and a deep understanding of the law. I have no doubt Senator Clinton has those attributes.

I didn't mean to imply that Hillary Clinton isn't a very bright woman with a superb grasp of the law. But she isn't a legal scholar. She doesn't have an extensive bibliography of serious studies of legal issues. I'd suggest that absence of such a scholarly record isn't a disqualification for Supreme Court appointment. I'd trust her instincts, and her clerks, to make good law based on decent principles.
Not all Supreme Court justices were legal scholars. The most prominent example, again, is probably Earl Warren, governor of California.

I think this is a complete misread of where the Justice Department is. Over the past 8 years, Bush has done considerable damage to 4 major institutions.
State Department
Intelligence Community
Military
Justice Department
Each were damaged in the same way. Appointing political idealogues in leadership positions who then abused the career staff who have chafed under their ignorant leadership. Do not be surprised when the newly appointed competent and capable leadership of these institutions transform them into fully functioning entities.
With the Justice Department finally able to act, don't be surprised when the worst of the crimes of the last 8 years are prosecuted.

I think impeachment needs to happen in a calm time after the election--perhaps after June.
Bush's adherence to the unitary executive theory, his assertion of the right to violate federal law as clearly written without check or balance when, in his sole judgment, he thought it necessary, his actual violations of federal law, and his use of signing statements to modify laws as drafted all struck at Congressional prerogatives enshrined in history, the Constitution, and Supreme Court decisions.
from wombat
these are impeachable offenses and for the sake of the future and what is thought to be permissible we need to go on record that Bush violated the Constitution.

After arriving with McCain at the Nationwide Arena Hockey Stadium on board the "Straight Talk Express", Schwarzenegger delighted a raucous crowd of several thousands with some biting barbs about Obama's policies and physique.
Schwarzenegger, who organizes a bodybuilding competition in Columbus every year, said he wanted to invite Obama because "he needs to do something about those skinny legs. I'm going to make him do some squats."
"And then we're going to make him do some biceps curls to beef up those scrawny little arms," Schwarzenegger said, before his punchline: "But if he could only do something about putting some meat on his ideas."

WSJ -- One high-level Bush appointee who has yet to launch his job search said colleagues are alarmed by the weak job market. "They are getting a lot less than they expected," he said.
Education Secretary Margaret Spellings, for example, has signaled possible interest in leading a business, one knowledgeable person says. But a mid-sized industrial business seeking a CEO recently declined to consider her because of her lack of corporate experience, as well as her close ties to the president, that person says. Ms. Spellings has been advising President Bush on education issues since he was governor of Texas. A spokeswoman says Ms. Spellings intends to remain in education.
In 2001, Mr. Light said, officials departing the Clinton administration generally landed well. He cited Jacob "Jack" Lew, former head of the Office of Management and Budget, who is at Citigroup Inc.; Health and Human Services Secretary Donna Shalala, who became president at University of Miami; and Strobe Talbott, deputy secretary of state, and now president of the Brookings Institution.
Some Bush officials took senior business posts earlier this year. But not all lasted long. In July, Wachovia Corp. tapped Treasury Undersecretary Robert K. Steel as chief executive. But he has said he will have no "operating role" after Wells Fargo & Co. completes its acquisition of Wachovia.

Barack has been a pillar of confidence, cool, and level headedness this entire campaign. McCain represents desperation, low road politics and putting self and your own personal aspirations far in front of country. There is no limit to the depths John McCain won't sink to in an effort to win this election. He gave up country first a long time ago. Schwarzenegger, an alleged racist, who's been critical of Sarah Palin and John McCain, now is being utilized as McCain's saving grace. Politics are such a joke.

Jeebus. Schwartzenegger has been a far less heinous governor than I expected him to be. He's a social moderate and he seems genuinely to care about the job and his responsibility to the people of the state. Unlike most Repukes, he seems to want to use government to actually solve problems rather than just fuck shit up on purpose. But he's pissing me off with this shilling for McCain. I know he's a Repuke, but he's not up for re-election and he could just as easily sit this one out. He must want to run for Feinstein's Senate seat in 2010.

I think they still have a kitchen sink.
If they did, they'd have deployed it already. Anything released now won't have time to soak in and have a major impact, unless it's REALLY dramatic, like a major terrorist attack. And that wouldn't favor McCain. A lot of people have already voted.
I think Obama's 'illegal immigrant' half-aunt is their best shot now. It may have a minor effect, but I doubt it won't affect any voters besides those who already weren't going to vote for Obama. Now, they're not going to vote for Obama even harder, which will have exactly zero added effect.

Blame Palin at Your Own Risk
The recriminations begin early.
By Kathryn Jean Lopez
In the final week of the presidential election, the hot political storyline centered on how the maverick hockey mom, also known as Republican vice-presidential candidate Sarah Palin, is really a “rogue,” a “diva,” and even, Lord help us, a “whack job.”
She’s gone “off message,” “McCain sources” complain.
Off message? Off message! That’s only something to complain about if you want Palin’s running mate to lose. Palin’s off-message remarks are better than a lot of things I’ve heard coming out of a campaign that could have used some messaging help more than once, an operation that hasn’t always been worthy of the seasoned public servant at its helm, John McCain.
Most of what Palin says — especially those statements raising the ire of some in the McCain camp — is sensible; it resonates. Palin exudes a common sense you can’t buy in a political consultant. For example, she supposedly committed a major faux pas in admitting she has no love for automated phone recordings. While talking to the press in Colorado Springs, Alaska’s governor asserted that she would prefer to communicate with American citizens personally, rather than rely on robocalls and shrill TV advertisements.
I sent a letter to Sarah, requesting that she visit me (without First Dude, of course). So far, she's a no-show.
When's she gonna start these personal communications?

You can, however, convict them of lots of things that they were immune from while in office. But for it to be an effective move, you first have to convince the American public that Bush was not just a shitty president, but a war criminal, and realign their minds so that they no longer identify with any of the ultra-nationalistic messages he based his presidency on. Shared: sure. I'd hope, though, that Obama wouldn't appoint a Federalist Society member to the Court, regardless of his/her legal expertise.
My guess is that Obama's appointments will be of people of superb legal scholarship, centrist-progressive but not lightning-rod lefty. The goal posts have moved so far to the right that Souter and Stevens are viewed as liberal, fakrissake. The odds of, say, Lawrence Tribe or Erwin Chermerinsky being appointed are, alas, slimmer.

Ford's pardon of Nixon broke that precedent, and since then, several people have been pre-pardoned. I don't think it's ever been tested, but I doubt that it's a constitutional use of the President's pardon power granted by Constitution. I'd like to see it go to the Supreme Court, but not the bunch that's currently in there.

What we need to do is continue to patiently, incrementally marginalize the Republican brand by creating a new positive Democratic image around which people can re-form their politcal identity values. Obama is currently doing a better job of that than any presidential candidate since Ronald Reagan. The Obami are truly scary-smart about these things.

Interesting Globe article on 'Rockefeller Republicans' as an endangered species:
http://www.boston.com/news/local...e_rockefellers/
Now, I've heard the odd voice demand that the Democrats, in order to claim the slightest legitimacy, tack to the center and renounce what's been characterized as their extreme left. Even given the disastrous Bush record, and the pathetic McCain campaign, and the utterly inadequate slate of candidates that yielded McCain as the best of a bas bunch, I've seen very little suggestion in the media that the Republicans, by sacrificing their center and moving to their right, have done anything wrong, or politically damaging...

Well, I am no constitutional scholar and have written off my chances of being nominated to the Court, but impeachment proceedings for "High Crimes and Misdemeanours" is just that, a legal indictment and trial that is carried out by the Legislative Branch.
I don't believe Ford's pardon was for the impeachment, but for future criminal indictments which may have occured. The text of the pardon proclamation seems to bear that out:
[excerpt]It is believed that a trial of Richard Nixon, if it became necessary, could not fairly begin until a year or more has elapsed. In the meantime, the tranquility to which this nation has been restored by the events of recent weeks could be irreparably lost by the prospects of bringing to trial a former President of the United States. The prospects of such trial will cause prolonged and divisive debate over the propriety of exposing to further punishment and degradation a man who has already paid the unprecedented penalty of relinquishing the highest elective office of the United States.
Now, THEREFORE, I, GERALD R. FORD, President of the United States, pursuant to the pardon power conferred upon me by Article II, Section 2, of the Constitution, have granted and by these presents do grant a full, free, and absolute pardon unto Richard Nixon for all offenses against the United States which he, Richard Nixon, has committed or may have committed or taken part in during the period from January 20, 1969 through August 9,1974.

Ya gotta hand it to Broder: wanking his way to a weekend wanker spot. A whole article calling this the best campaign he's ever seen finds time to slam Obama for not agreeing to meet McCain in weekly town hall meetings and because he "broke his word and rejected public financing". No criticism of McCain or what his campaign has become. Instead, he ends with this:
"The country faces a choice between two men who both promise the nation a more principled, less partisan leadership."
Only Broder would conclude that after watching McCain slander Obama, Pelosi, and Reid.

Al: yup. The best thing about eliminating the Electoral College would be that, of a sudden, folk would notice that even the reddest state is 40+% blue, and the case would be made there as well. It would instantly transform the caricature of the South as composed solely of rightie fundie racists.
I'd guess strongly that Democrats would have more to gain thereby than Republicans looking for their votes in blue states. There's a reason for Republicans constantly intriguing to limit the franchise.

so, in the absence of any activity by the Justice Department against even the most unsavory characters of this administration, does it make sense that "Bush the War Criminal" would essentially go public by pardoning public officials and admitting that each is guilty of crimes that would require such a pardon?
The wording of Ford's pardon was for any crimes that were committed or 'may have been committed' in a particular time period. If that is accepted as a valid use of the presidential pardon power, I don't see how any admission of guilt is necessary.
I expect Bush's use of the pardon power when he leaves to be unprecedented in scope. I don't put a blanket pardon on everyone in the Executive Office beyond the realm of possibility, but I don't know if he'd go that far. But certainly, he's going to pardon all of his co-conspirators in the various crimes of his administration, as his father did when he left office. Since the crimes are bigger and more widespread, the pardons are going to be more numerous and blatant. I'm just speculating.

it's time to boycott these idiots the minute Obama is elected - we no longer need propaganda from pravda on the potomac - go after their brand - it's a killer - that goes double for cable news - wrong all the time.

While enjoying an 11 point lead today's Gallup Tracking Poll overall, Obama has inched up to a 10 point lead in Gallup's "traditional voter" model. He is also up ten in the "expanded" model.

"WASHINGTON (AP) - Barack Obama's aunt, a Kenyan woman who has been quietly living in public housing in Boston, is in the United States illegally after an immigration judge rejected her request for asylum four years ago, The Associated Press has learned.
Zeituni Onyango, 56, referred to as "Aunti Zeituni" in Obama's memoir, was instructed to leave the United States by a U.S. immigration judge who denied her asylum request, a person familiar with the matter told the AP late Friday. This person spoke on condition of anonymity because no one was authorized to discuss Onyango's case..."

Ok so I figured each working day (260 in a year) there's 10,000,000 groups of people who have lunch together. Lunch for a group costs $100, so that's a $1 billion per day, or $260 billion in a year. The one rethug in the group has to buy lunch for everyone else, so let's say there's three others in the group, so only 75% of the lunch bill counts, that's $195 billion/year paid back. Boosh stole around $12 trillion, so in roughly 61 years that will be paid back, in the form of free lunch for people who didn't vote for boosh.
Let's be generous and say rethugs only have to buy everyone lunch until 2050. If they object to this we can call them socialists.
