The latter would be a defense to defiance of a court order, but only just. If there is a court order, get it modified ASAP, based on the violence/mistreatment.

There is so much pain in this situation. Your daughter needs to get to the police and connected with every aspect of the social service system that can help her. This is going require a long-term solution and it needs to start now. That said, I also understand your sense of helplessness. Sometimes as parents of adult children all we can do is advise and support, which can be very painful and frustrating. Remember to take care of yourself.
