A man who was held in isolation for more than three years before being tried and convicted of aiding terrorists filed suit Friday against the UC Berkeley law professor and former Justice Department official whose memos justified inflicting physical and mental pain during interrogations.

Military officials relied on John Yoo's writings in subjecting Jose Padilla to prolonged sensory deprivation, sleep interruption, stress positions and other techniques designed to break his will, Padilla's lawyers said in a lawsuit filed in San Francisco. Padilla faces sentencing Monday in Miami....
"John Yoo was central to the justification and creation of the torture system," Jonathan Freiman, an attorney at a Yale Law School human rights clinic who represents Padilla, said in a statement. "What Yoo seems to have forgotten is that lawyers are not above the law."....
The Justice Department repudiated the memo in 2004, when Gonzales was up for confirmation as attorney general. Before the document surfaced, the official who signed it, Jay Bybee, Yoo's Justice Department supervisor, was appointed by President Bush to the Ninth U.S. Circuit Court of Appeals in San Francisco.
Padilla, a U.S. citizen and Muslim convert, was arrested in Chicago in 2002 and accused by Bush administration officials of plotting with al Qaeda to detonate a radioactive "dirty bomb."
He was declared an enemy combatant by Bush and held in a brig without charges for 3 1/2 years, then charged with taking part in an unrelated conspiracy to provide money and supplies to Islamic extremist groups, with no reference to the alleged radioactive bomb. After prosecutors offered evidence of a document linking Padilla to an al Qaeda training camp in Afghanistan, he and two co-defendants were convicted in August.
Padilla's lawyers have cited his treatment in the brig in an unsuccessful attempt to dismiss the charges and in opposing a life sentence sought by the government. Prosecutors say his treatment in military custody was irrelevant to the case and deny that he was tortured.
Friday's civil suit, filed on behalf of Padilla and his mother, Estela Lebron, said he had been subjected to physical and mental abuse throughout his confinement. He was kept in a blacked-out cell, hooded whenever he was let out, prevented from sleeping by loud noises, shackled or forced to stand in painful positions for long periods, exposed to extreme heat, cold and noxious fumes, threatened with death and denied access to lawyers, relatives or anyone else except his guards and interrogators, the suit says.
Padilla's lawyers said government documents show that Defense Department officials relied on Yoo's advice, in the August 2002 memo and other writings that "purported to provide legal justification for unprecedented and illegal detention and interrogation techniques."...

I wouldn't call it hyperbole. It's the difference between the logical appeal vs. the emotional appeal.

It's been said many times, and here, that the Dems need to talk to the heart more instead of focusing on the head. Clinton and Edwards are talking specifics on policy and programs, as if people vote for that reason.

A few do - they are engaged, educated, and many of them hang out on blog comment threads But the vast majority of voters respond to an emotional appeal.

And Obama's carrying the day there.

What is instinctive is the tendency to hold those who are in your own clan in much higher regard than those who are not. Since primitive humans knew fuckall about genetics, they used superficial characteristics like skin/hair/eye color, which were reasonable proxies for the degree of genetic relatedness. The sociobiological argument is that a keystone of human evolutionary adaptation is the ability to behave cooperatively and even altruistically towards those who carry the largest proportion of one's own genes, thus leveraging the aggregate success of one's alleles, even if it is at the expense of the individual.

I write as an adherent to the Selfish Gene Theory, so yes, I think racism is rooted in our genetics (as are many other behaviours).

As to genetic purity, basing any judgement on a phenotype is pretty silly (see "Bell Curve").

So in my view, until we evolve beyond fearing scarcity, there will be the tendency to tribalism and racism. It will not be eradicated - it can only be controlled, and shunned.

I remember reading a story about someone who thought he was African-American did this, thinking he would find out which part of Africa his ancestors came from. It turned out he had no African ancestry at all, it was a mix of white, South Asian & Native American. Found out from a family elder that they had decided to cross over to the black community way back, because they were too dark to pass as white.

No, he knows nothing about being president, and much less about foreign policy, but he's a Christian. There are many moderate Christians out there who are Republicans and are not evangelicals. They are looking for someone to give their votes to, without leaving the Republican Party. I think, despite the fact that the bobbleheads and leaders of the Republican Party hate him, he could get the nomination because he "acts like a Christian." I'm a Methodist, and my church is full of moderate Republicans who fell for Bush's line, feel betrayed, and would like to give their vote to another genuine Christian Republican.

The most successful strategy to overcome this tendency so far has been simply to co-opt the mechanism by using broader and broader similarities to define the "us" group. Hence nationalism. Probably wont work for the whole world, though, because there still needs to be a "them". What we need is some contact with sentient aliens. That would fix the problem for good.

I do, and they do what they've always done before. They basically shut you out because they "don't want to talk about politics." They'll change the subject or, they'll do as my good friend did yesterday. She said, "There really isn't any difference between Democrats and Republicans." When you try to explain that there are major differences, their eyes glaze over. For the sake of friendship, you drop it.

Believe me, most of these people are so totally misinformed and they think politics is dirty, nasty business. My husband, who will vote Democratic every time but really hates politics, thinks that Hillary Clinton is a wild-eyed liberal. Believe me, I have tried my hardest to convince him otherwise, but he won't listen.

The more I see, the more I think most moderate Christians think politics IS nasty and not something a "good" person should be involved in, other than to vote. Then, they take the "knowledge" they've gotten on soundbytes on TV and radio, and they vote for the candidate that makes them feel good. If the guys says, "I'm a Christian" enough, they'll vote for him.

Why, thank you. It has 3/4 lb. diced double-smoked bacon, a big ham hock, onions, garlic, a bunch of fresh sage, a bucjh of fresh marjoram, two quarts of chicken stock, two quarts of water, and a bottle of white wine for the broth. For beans, there's canneloni beans, black-eyed peas, chick peas, and pinto beans, but not too many beans overall. For veggies, I put carrots, celery, green beans, zucchini, cauliflower, golden beet, parsnip, celery root, cabbage, escarole, kale, and raddichio, all diced to like 1cm. On top of that, there was about 4 cups of Italian extra-big pearl barley.

The thing that really made it work well was cooking the beans and barley both separately and then rinsing them thoroughly before adding them to the main soup near the end. Often, I have had poblems with the broth tuning to library paste with all those starchy things simmering in it, but this way with some thorough skimming I was able to end up with a nearly clear, only slightly thickened broth.

When I went to a Native convention a few years ago (I was recruiting for a jobs program), lots of them were mocking Cherokees because apparently you can claim membership with a very small percentage of of genuine Cherokee blood. And Cherokee is apparently the favorite choice of most white people claiming Native ancestry.
Also, what the hell is the matter with Tweety and his problems with Hillary? I heard him pushing that "60 percent rejection" meme, too, and then heard either Shuster or Gregory repeat it the next day. What is the root of his dislike of her, does anyone know? He relented very briefly when she was really doing well in the polls? And why don't some of these pols take him on when he says something outrageous?
