however, the issue was subject to interlocutory appeal (IIRC) and is now before teh 9th circuit en banc. so who knows.

GravatarIf you don't act to protect your trademark, you eventually lose the right to enforce a cease and desist order with respect to other's use of it. If you do not prevent trespass, eventually habitual use of a path creates a legal easement. If you allow millions of individuals to work for businesses, pay into federal retirement systems and grow up knowing no other land but this one you lose the right to suddenly get all paranoid about "illegal aliens". Amnesty is the only real solution if for no other reason than the government lacks the resources or political will to actually enforce any other plan. These people are already part of the society so there is no point to wringing your hands over what to do about it, accept it, close the book and move on. Furthermore, I would advise against instituting any new restrictions that you do not intend to enforce because that's just blowing smoke and undermining the credibility of all of your other laws.
