interesting. although not unexpected to me at least. prime downtown real estate remains expensive. redlining is also another factor, for all we pretend it doesn't happen any more. i often note to family how "odd" it is that in my subdivision, all the 'people of color' in it live on two streets, mine included.

WASHINGTON - Dying of cancer, Thomas Amschwand did everything he was told to make sure his wife would collect on the life insurance policy he had through his employer.
"He was obsessed with dotting every `i' and crossing every `t'," Melissa Amschwand-Bellinger recalled about her husband, who died in 2001 at age 30.
But Spherion Corp., the temporary staffing company where Amschwand worked, told Amschwand-Bellinger she would not receive any of the $426,000 in benefits she believed she was due. When she went to court, Spherion succeeded in getting her lawsuit thrown out. The Supreme Court on June 27 refused to review the case.
Amschwand-Bellinger received a refund of the few thousand dollars in insurance premiums she and her husband dutifully had paid. The total, she said, would not cover the costs of his funeral.
The story has played out often under the federal Employee Retirement Income Security Act. Designed to protect employee benefits, the law has been used by employers as a shield against suits.
Federal appeals courts, interpreting Supreme Court decisions dating to 1993, consistently have said companies that offer health, life and retirement benefits under ERISA cannot be sued for large amounts of money, or damages. Instead, they can be sued only for typically smaller sums such as Amschwand's insurance premiums.

It is on days like this when some people on this blog start spouting incredibly hurtful and stupid shit that I really wonder why it is that I hang around here.
People, who should know better, suddenly become these terrible, spiteful creatures who hate with elan and really and truly would like to see the thousands of people who are depending on the auto companies for their jobs, pensions, and health care do without: that is what you are talking about, you know?

Spherion's decision to deny benefits to Amschwand-Bellinger turned on an odd set of facts. Spherion, which employs about 300,000 people, switched insurers after Thomas Amschwand was diagnosed with a rare form of heart cancer. The new policy did not take effect until an employee worked one full day. Spherion never informed Amschwand of the requirement.
Amschwand asked repeatedly whether there was anything else he needed to do and was told no. He asked that the new policy be sent to him. Spherion never did so.
He died without returning to work. His widow said he easily could have worked a day if that was what it took to activate the new policy. Spherion could have waived the one-day-of-work provision, as it did for other employees but not for Amschwand.
Spherion spokesman Kip Havel issued a brief statement when contacted by The Associated Press after the high court declined to review the case. "We are pleased the court has made its decision and the matter has finally been resolved," Havel said.

The court also recently turned down an appeal from Louis Gerard "Gerry" Goeres, who sued Charles M. Schwab & Co. over hundreds of thousands of dollars in retirement plan benefits.
For 16 months, Schwab mistakenly refused to acknowledge Goeres as the beneficiary in the retirement plan of his domestic partner, Stephen Ward, a Schwab employee who died in 1999. By the time Schwab acknowledged its error, the value of the account had declined by more than $500,000. Goeres sued for the rest. Federal courts dismissed the suit. "Unfortunately, legal relief is not available," U.S. District Judge Charles Breyer said in ruling against Goeres.
"You know the Schwab commercial, `Talk to Chuck?'" Goeres said. "I thought if Chuck knew this, he'd say, 'Oh my God, this is so wrong.' I live on naive dreams."
Schwab said in court papers that Goeres could have taken legal action soon after Ward's death, when he first was told he was not the beneficiary.

Yup, and I'll go for the Constitution and weather the taunts of those who might call me an idealist. Given what's happening to the economy and the general disdain the public is developing for corporations, it might not matter who gets elected. What will mater is how flexible the folks in charge are. Theodore Lowi wrote an interesting book called THE POLITICS OF DISORDER in which he outlines the qualities of leadership in times of calm and in times of disorder and rebellion. Probably beyond most of you who are blindly following the mainstream, but I thought I'd mention it anyway.

but that's just the point. if mccain wins, which he can't he will be in perfect position to fight off any progressive movements from the left. if obama wins, he won't. simple politics there. and the bigger the perceived victory on the left, the harder it will be for obama. plus, the more riled up the left base gets, the more left leaning senators, reps, govs, and local politicians will get elected to put on those pressures.
it isn't just about obama, it's about a tide. and the bigger the tide, the more powerful it will be. the nader trickle may go directly to the sea, but in the end it just reduces the force of the flood.

Did you see this morning's WaPo?
Taking a new approach to parking, by building less and charging more, is a central tenet of the new urbanism that has gripped planners and developers in suburbs and cities across the country.
The planners said that parking, especially free parking, encourages people to drive. Cars allow for development sprawl, highway congestion and air pollution. The parking lots coat the ground with impervious asphalt that sends dirty runoff into rivers and streams. And, the planners said, parking is often ugly and creates spaces that discourage walking or the use of a transit system.
"If there's a free parking space, you're irrational if you don't drive," said Cheryl Cort, policy director of the Coalition for Smarter Growth, based in Washington.
Reducing the supply of parking is one way to change people's habits and patterns of development, Cort and others said. Other crucial pieces include a grid of streets, a mix of uses, and transit, which is why Tysons boosters have been pushing so hard for a Metrorail extension through the area. A decision about a rail extension, which would stretch to Dulles International Airport and into Loudoun County, is expected from federal regulators this year.
If more people ride Metro, fewer people will drive, which means less traffic, pollution and runoff. It also means less demand for parking. That, in turn, opens up a world of development possibilities: narrow streets with sidewalk cafes; intimate storefronts; tall office and condominium towers where workers and residents can walk to lunch, to a dry cleaners or to a Metro station.

For that reason, my son has switched his major, from astro-physics/maths, to just maths/and civil engineering.
(he's still shooting for a double major degree)
He says employment prospects for an astro-physicist is not that good but that there always will be a need for people that know how to design and build things.

eh - the money from repubs didn't bother me that much. it did piss me off the way they gloated over it, but it was just a calculated game by the pugs, not an indication that they in any way supported him or that he was intentionally helping them.
in any case, a vote for nadar wasn't really, imho, a vote for nadar. it was a protest vote for ideals. if gore had gotten into office, large numbers for nadar's platform would have given him even more pull to the left - bush of course could just ignore it.
but this time around i agree with you. it's all about ralph. his candidacy serves no other purpose.

Didn't cover any part of NM, but that wasn't my thought. I pulled it way in to cover North Central Phoenix - and it reported that the majority of property went for under $1000/month, and a fair amount more for under $600. I suppose this may be accurate - but only if the vast majority of the properties there are on the 25th year of a 30 year mortgage or are paid off or some other off-kilter factor. Either the stats are calculated on something not being shared or the mapping is out of whack. Otherwise, it is an interesting visual.

In the article where he called for no exceptions for mental health in late term abortions, he also said something about teaching children the "sacredness" of the sex act. I wonder if that applies to gay coupling as well.

That's what I really don't get. The fundies aren't going to vote for him; they're going to vote for McCain who's promised to appoint judges who will outlaw abortion. The notion that he's going to do outreach to these whackjobs to "bring them into the fold" is insane. Every time the Dems try to be Republican lite, lose, and then figure that well, next time, they'll run even FARTHER to the right.

The people calling in to Journalist Roundtable on CSpan are more and more like the Munich beer halls of the thirties. Then it was about how great Hitler was, how terrible the Jews, the Poles, the Gypsies, the intelligentsia, and immigrants in general and the terrible people who hate this wonderful country which supports the whole world. Media Matters covered a SNAFU over what Obama meant when he was talking about his kids and pregnancy. I forget the details but I think that this stuff is probably just Obama trying to express Obama. Mebbe he should STFU...and get elected first.
And no, QL, he is clearly in support of gay rights but prolly won't advocate explicitly going there with kids. I don't either.
Sex ed in generic terms of respect and love for partner doesn't have to parse the shit down to porno.
