wow. Totally uncalled for and revealing of the reporter's own ignorance. Justice Thomas has explained many times why he does not speak at oral arguments. He finds oral arguments demeaning to the legal process - they're a dog and pony show - and unfair to defendents who lack a charismatic lawyer.

A month or two ago, I remember reading a one-page article in Newsweek about Thomas that rambled on about his past and about racial issues to try to explain Thomas's convictions and past votes. It was not nearly as sour of an attack, but it misunderstood Justice Thomas just as sadly.

It seems like the MSM is just looking for some one event or circumstance to explain why Thomas has a mind of his own and doesn't follow what MSM would expect of "the black Justice".

Thomas also voted that consensual gay sex can be deemed illegal in the Lawrence opinion. Do you libertarians agree with that?
