I dont think the ISP will look at it that way, raymi, my experience is that if you have banned the individual and complain to the ISP that people keep returning to webpages on proxy servers then the ISP will start complaining to their customer to stop doing it. Enough complaints and they deactivate the account. As I said I have never had to goto 4.
However if things did goto 4 then the ISP will back up the complaintent as they have been recieving information regarding this for some time.
I dont think anyone would be charged at that point. But since the police will have access to the person local to them and not to the complaintent then they will end up dealing with the local person.
I dont know if carrie is flaming you guys in your comments. If she is I would recommend following those steps yourselves, not comming here to tit for tat retort. As that obviously does not stop anything, and only makes it worse.

excuse me i have never ever threatened carrie and calling the police, do it, see what happens as carrie is nowhere close to innocent in any of this, i can tell you now that you would not have a leg to stand on. the ONLY times i ever comment here is when provoked by carrie, that's it, she does this shit on purpose. the police would laugh in her face and counter-claim against her for wasting their time, crying wolf over something she brought upon herself!
I keep telling you to ban them.
1. Ban them.
2. record their original IP's
3. If they comment again contact their local ISP, contact information is availible at ARIN.org(under abuse) tell the ISP how they are threatening you (this comment from butchie definately contains a threat) and tell the ISP how you banned their IP but they continue to return on proxy servers and you would like them (The ISP) to take some action.
4. If that doesnt work contact the ISP again and tell them you are contacting the local police in their area and that the police will be contacting them regarding butchies real contact information. Hell maybe even conference in the cops with the ISP.
However I have never had to escalate anything past #3
