Amazingly, the Chimpster is right this time. The Senate is in seesion but The House is not. Since the authorization bill originated in The House, he is correctly returning it there. And they're not in session.

The origin of the bill is probably irrelevant. The Congress is still in session, even if only one house of Congress is in session.

The origin is relevant, because the language regarding veto'ing bills talks about sending it back to the house it came from.

Even conceding the validity of the pocket veto, There certainly should be enough political hay for the Democrats to harvest if they would only emerge from their holiday stupor, find what's left of their spines in the back of the coat closet and start a major media blitz detailing how much Bush hates the troops.

Just because Pelosi spoke like a moron, does not mean that if bush makes an recess appointment it will be approved.
Myself, I figure that both democrats and republicans are owned by the same lobby money (both business and AIPAC) and that really, in foreign policy, there is nary a difference there.

The Constitution establishes that Congress is composed of both bodies - the House of Representatives and the Senate. A Supreme Court decision in 1938 (Wright vs. United States) affirms this regarding pocket vetoes.
Bush cannot Pocket Veto because the Senate is currently in session. It does not matter that the House that originated the bill is not in session - Congress is.
