I'll be interested to read Scalia's dissent-he's usually such a tubthumper for restraint. Of course, he's also quite slippery and diabolically brilliant, so he can usually talk his way to anyplace he wants to wind up.

we'll see what happens when the rubber meets the road with this court. don't forget it was scalia et al who interfered mightily in the florida case which started this whole current mess. scalia was all for state's rights and lasseiz faire until it came down to being able to have nine justices decide a national election then he became a great big fan of judicial activism.
still, you're correct. they did get this one right.
Scalia is also for State's Rights (TM) until some state legalizes Ganja for sick people.
