I think an iPhone would be a hit. The best phone out there now is maybe the Treo, and I don't think Apple would have much trouble clearing the low-ish bar the Treo sets.
That was the point that was in question: whether it was a violation of copyright to unlock phones. The carriers claimed it was; the copyright office has ruled it wasn't (and isn't for 3 years at least).
I concur with your thought that an iPhone would be a hit provided it includes the same quality and user-oriented thinking that Apple's other products have. Quite frankly, most cell phones have terrible UIs in my opinion. If Apple just made phone operation, music, address book, and texting simple and easy to use, iPhone would be a winner out of the box.
