That's all well and good except that the GOP folks are too clever for that - they've no doubt hired well-paid black challengers to work in the black polling areas. Esp in Cincy.

I asked a question in the comments on Wes's site on Tuesday, maybe someone here can answer. By law, witnesses and challengers must be qualified electors (see the comments on Wes's blog for links to OHR). But to be a qualified elector in a given precinct, you must live in that precinct. So my question is, to what level is the witness/challenger's "qualified elector" status scoped? I assume you can't have people from Texas coming to Mt. Auburn as challengers. I would also assume you can't have Hamilton County people go be challengers in Cuyahoga County. But can you have people from precinct G-14 go be challengers in precinct F-12? Is the "qualified elector" scoped to the state, the county or the precinct?

Ethan, that is a great question. Does that mean I can challenge the challenger's qualifications? I for one, like the photo idea and I am in OTR.

I don't have any idea of the answer to that - but if the standard is "electoral jurisdiction" it would only be reasonable to interpret it the same way that Blackwell, and now the 6th circuit, has interpreted that standard for provisional ballots - within the same precinct.

Two points -
(1) ALL of the NAMES of the challengers for BOTH the BC04 and KE 04 campaigns will be public sometime after 5:00 p.m. on Monday night, as we have to be CERTIFIED by the BOE in order to even be a challenger. Since the BOE does the certification, it is all PUBLIC RECORD. I'd say, either Monday evening or Tuesday morning, if you're so inclined, get a list of the Challengers.
(2) According to the "Witnesses and Challengers Policy" adopted by the Hamilton COunty BOE on 10/22/04, an "elector" is qualified so long as s/he is a qualified elector in the State of Ohio - out of precinct and out of county Challengers are permitted per the BOE rules.
Hope this clears things up.

No, it isn't intimidation.
It is documentation.
And if you are a "challenger" you may want to note that a challenge must be based on personal knowledge - any random challenges not based on personal knowledge of a disqualifying condition are illegal, and punishable by jail time.
How's that for intimidation?

KOS - you are right. That would be intimidation. ...but what do you call the Republican challengers... could that be intimidation? I say it's very fair to document the problem. They have a right to challenge, & I have a right to document their efforts.
