True enough, she's got a *RUMOR* tag under her mug until she officially announces; same for the other potential candidates.
But Presas-Garcia has already filled out her campaign treasurer form and submitted it to the City Secretary's office. Ask for a copy if you'd like, it's all public info. (But you already knew that, didn't you?)
She was also actively collecting signatures for her petition. Not that it'd do her much good now. Unless she flips to little ole' District 2...

About 8-10 years ago maybe - I defended a member of Dallas City Council on similar charges - the grand jury no-billed him because of the confusion over the meaning of residency - his case was not black and white.
If she signed and submitted paperwork with the city it is a misdemeanor if she falsified her residency - the city attorney needs to look to this issue and make a formal decision about prosecution
oh yea - like anyone will ever get prosecuted for criminal conduct as a public official

I like Catalina Presas-Garcia's Tenaciousness. Honestly folks, she deserves to be placed on the ballot. Fair Play Guys. Fairies do exist here in Brownsville.
I truly believe she will win District One City Seat in May. She is not polluted by the special interests in our town, who are guilty of extracting millions of dollars from city budgets (most of it large debt that will take 40 years to service with an extra price tag of millions in interest) in low impact fees for some developers and a massive resume of municipality sports buildings, museums, trailways, parks, and other projects basically hand delivered to them with hardly any reasonable opposition in a bid, all while ll of us pay for it through high utility rates. No problem with the quality of life projects, I do not oppose them, but when over 90% of them were built by maybe two guys, one has got to wonder. I know you are a builder Davis, and I know you know my brother and brother - in - law are developers of residential lots. None of those facts can construe my thinking. You are suppose to do what is right. So do it Davis. Besides, I do not think our present City Commissioner Longoria has performed well enough as a leader to even be considered again, in case any one wants my opinion on his performance.... I just think he is askew for causing ruin and destruction in his campaign, which shows. It was bootless of him to wrangle, so publicly and with no objective, sanity, or understanding of the logic behind such a peculiar comment.

The preliminary issue on the Presas- Garcia is not whether she is a good candidate or not. Even a bad candidate has the right to run... Just look at Pat Amumada, Robert Sanchez, Sandra Garcia, Pat Lehmann...The word quality doesnt always go with the word candidate...especially in Brownsville.
I will vote against and work against all these people but I will not interfere with their right to run for office. Just because I dont agree with someone or like the way they do their hair, does not mean that I have the right to prevent them from speaking or running for office.
The issue right now is simple. Does Presas Garcia have the right to run in District 1 because of her residence? The questions therefore are as follows:
Question Number One
Where has Presas GArcia been living and sleeping for the past 6 months? If the answer is District 2, indict her. If the answer is District 1, then answer question number two.
Question Number Two
Does Presas Garcia intend District 1 to be her residence? This is where it gets sticky. How do you prove someones intent when they say otherwise? The truth here is that there is evidence both ways but nothing convincing either way. On one hand, Presas drivers license and voter registration cards say District 2. However, Presas Garcias clearly made a statement to PUB claiming to reside in District 2 back in October.
Lets assume for the sake of argument that Presas had moved to District 1 in August. Presas would have been living in District One for only three months in October of 2006. Therefore the statement in October is partially correct in the sense that had she run for office at that time, she would have had to run from District 2 and not District 1. Clearly the candidate has a right to run for office somewhere. The same arguments being made against Presas running in District 1 can be made against her running in District 2. What does all this mean? If Presas has truly been living in District 1 for six months, it will be nearly impossible to prove that she does not intend District 1 to be her residence.

How do you equate clearly stating, in present tense, her residence with "nothing convincing either way"? (BTW, it occurred in November, not October.) Did she just innocently forget where home really is?
After that, you lost me with the hypothetical October election run.

I have no idea where Presas lives...none at all. I just think its funny that Rick is claiming she lives in District 2 and Charlie is claiming she lives in District 1. I dont want her...you take her.....no, she lives in your district, you take her....Yahhhhhh.
