Mr Davis, kudos to you for posting this. Now I understand the two of you have differences but I would be in total agreement that we all have a right to see this. So if anyone says you are being vindictive they can kiss my "como se llama." Anyway, in Charlie's defense, I must say he doesn't look like anyone who poses a threat to himself or others. It sounds like he badmouthed the officer, which couldn't have helped him. That's probably what got him busted?

Thanks, Chris. Im glad people got to see me pass that last test where I had to elvate my leg for thirty seconds. Most people who are intoxicated couldn't pass that test, especially on a bumpy surface. You should show the other tests so the people can see the truth. I always knew I was in the right. My mistake was at the beginning was to accuse him of coming off the ramp pretty fast and therefore the reason I had to speed up to get out of his way. He didn't like that and the rest is history.

There doesn't appear to be enough evidence in this video to determine Atkinson's guilt. The dismissal is understandable.

Atkinson really does not appear to be drunk. He does the whole one leg thing very well. However, it seems the trooper didn't have much choice once Atkinson refused the breathalyzer.
In the end it looks like he did the right thing because had he blown things may not have gone as well with the special prosecutor.
Where are the other 3 parts? I'd like to see how the stop started.

Yes it's wrong and Charlie is a jerk. In his position, how many of us wouldn't bring up that point in a desperate situation knowing we could be faced with serious charges which are unfounded? How many of you are man enough to pay and have that stain on your record knowing full well you were not drunk? Would you trust fate to a breathalizer? Sorry, I couldn't afford to. He's not drunk Mr. inexperienced DPS Trooper.

Im a jerk with people who act like bigger jerks. I take the position of someone who brings people back down to earth. Nobody is better than anyone else. In the start of the video, the trooper asked me if I was a commissioner in Brownsville but the sound was cut out. I was pleading my case that I wasn't a bad person or a thug. I was on a date with my wife and on the way home. This could happen to anyone who was initially stopped for speeding. I never denied speeding. The young trooper was just following procedures. He told me that on the way to jail. Any seasoned officer would have seen that in addition to passing all the tests. I never lied about passing all the tests. The trooper told my brother that I was going to jail because I would not take the breathalyzer test. He told my brother that even though I passed the previous three test, the fact that I refused the last test left him no choice. I understood that. Remember, it was his opinion that I was DUI but I wasn't.
I was tired from a full day with my kids that started at 6am. I went to three soccer games, one football game, one volleyball game,and cooked 20lbs of fajitas that day. I admit that I was dead tired from being on my feet all day. Sorry Davis, the camera doesn't lie.

I just saw this video in its entirety. Unbelievable! Sure has taught me not to drink and drive. Heck, I don't even know if I could pass that field sobriety test sober much less after having a few drinks. Pobre vato! By the way, how come Charlie was taken to Los Fresnos jail and not Brownsville? Also, why did the video included a lot of times when the sound was omitted?????

Charlie, I'm sorry but I don't think you passed any of the tests. Not falling off and keeping balance does not mean you passed the test. You also have to follow directions to each of the test. For example, on the leg elevating test, you did not follow the directions of counting "2001, 2002, 2003". As soon as the officer had just instructed you to do that, you right away started counting "1,2,3". So you're right, the camera doesn't lie.
