Because the Mayor would be essentially an "officer" of the BPUB, could he not serve in an "ex-officio" capacity? Sec. 314-2 as pertains to "general manager"(3) and Sec. 314-20(g).

Strain yourself on that reach? Ahumada is NOT an officer of the BPUB, he's a board member. And read (3) further, authority isn't delegated to board members. THEY are the ones to delegate (to Bruciak).

If you update this post or start a new one on this subject, could you state the statute that Goza kept trying to explain about CIAC members not serving the city in an official capacity. I believe he was sheepishly trying to explain that even if the Commission gave BPUB the courtesy to choose one member, it couldn't be the mayor; except, as usual, by the time he finished speaking the commissioners were already moving to another point. I was disappointed and frustrated that he didn't interrupt the Mayor and reiterate the point when he was trying to nominate himself for CIAC. This is another example of why we need a new city attorney. We need someone who will be respectful and apolitical (which I feel Goza is), but also forceful with everyone in the Commission. He needs to take clear control of the floor, correct procedural mistakes before a vote can be taken, and then promptly give the floor back to the Chair. Anyways, I hope you can find the relevent statute language and post it for clarity.

I watched last nights meeting and noticed that the issue of the Mayor not being eligible to serve on CIAC was never verbally spoken about outloud. The danced around the issue till they wandered to other matters. What happened to Rick? He started something and then when Pat started raising his voice and daring him he backed off.
