If Obama was indeed born in Hawaii, why didn't his maternal grandmother issue a statement to that effect? If he were born there, surely she would have been present at the hospital or have seen her grandson as soon after his birth as possible. But she didn't make such a statement. She did not give interviews (which was certainly her prerogative, esp. considering her health); but I also wonder why didn't she give interviews -- perhaps because she might be asked a question which would embarrass or make matters difficult for her grandson if she answered truthfully?
It simply makes no sense at all that Obama would not release his birth certificate, unless it shows that he is NOT a natural-born U.S. citizen and therefore not eligible for the Presidency.

Every major news network, print and cable news like FOX, CNN and MSNBC, have ignored all the court cases challenging Obama’s eligibility as sore losers or conspiracy theories. "Contrary to Internet rumor that Justice Souter had ordered Barack Obama to provide the vault copy of his birth certificate, the Court merely set December 1, 2008 as the date by which the respondents--Obama, the Democratic National Committee and Federal Election Commission--were to respond to Berg's petition if they chose to do so at all. Yesterday's filing, which appeared on the docket this afternoon, shows that the respondents have waived their right to respond."
America's Right is theorizing that Obama and the FEC feel confident that no one will take this seriously.

Is there a provision under the Freedom of Information Act to search the records of the Selective Service Administration to see if Barry ever registered? Other sources say he was traveling to Pakistan and the region under an Indonesian passport at 20. If he is in fact a "draft" dodger, by never registering, he can serve his two terms+ in Leavenworth as a felon and would make the writs and suits unnecissary.

Is this just regarding the BC/natural-born citizen suits (which are going nowhere fast), or is there some new angle on this -- like real proof or a non-crazy attorney getting involved?

I only have small concerns with your portrayal of the lawsuits:
The response due on Dec. 1st is not a requirement. They can waive any response and the case will be decided without such. The Berg case is NOT in front of the entire court right now, it is only on Souter's desk. The Donofrio case has been set for a full conference on Dec. 5th. If the court decides to hear the case it will not be that day.
Berg is 12-1 but not before the entire court.
Donofrio is 12-5 but for a conference not a hearing.
Keyes is not in front of the court yet at all, but should be and will be if denied at the lower level.
Donofrio's case is the strongest yet, and Keyes is second, IMO.
I hope you're not holing your breath for 1 December.
Berg put in an application for a writ of certriori. That is for the Cout to grant as it is one of the prerogrative powers.
Berg applied for an injunction. That application was denied. The hearing for the susbstantive certiorari application will be held 1 Dec.
Predicition by Kris: The substantive application will be dismissed in the same way the injunction application was - for lack of standing.
Keyes equally has no case as he has no standing: He lost because nobody voted for him, not by any supposed harm to him from a "fake" birth certificate.
Leaving legal prodedure aside, are you saying 50 state secretary of states conspired and colluded to get Obama on the ballot - all turning a blind eye to their duty to ensure all candidates on their ballots comply w/ all constitutional requirements?
The case to really watch is Leo Donofrio v. Wells, out of New Jersey. Leo has hit the Supreme Court with an Emergency Writ to "stay the National Election," which by the way is not done since the Electoral College has not met yet. The issue of standing is not a problem with this case since Leon has sued the New Jersey SoS based on her ministerial and constitutional duty to ensure the ballot contains eligible candidates.
Donofrio was initially required to submit to Justice Souter, who promptly denied it. But according to SCOTUS rules, he was allowed to resubmit it to the Justice of his choice. He resubmitted it to Justice Thomas - and Thomas distributed it for conference in front of all 9 judges. It is docketed for December 5th, and if 4 Justices agree, it will be treated as a normal writ and will be scheduled for oral argument, etc. Leo's case is also different in that he alleges that neither Obama nor McCain are natural born citizens.
The basics of Leo's case:
Article II of the Constitution is the only place Natural Born Citizen is addressed (eligibility for president), and the framers added a grandfather clause. It states a “Natural Born Citizen, or a Citizen at the time of the adoption of this Consitution.”
The Framers make a distinction between Natural Born Citizen and citizen, and clearly added the clause since they were born on U.S. soil but were British subjects at birth (thus, NOT
Natural Born Citizens). The interpretation of Article II (by Donofrio and others) is that the Framers clearly intended that a Natural Born Citizen must be born on U.S. soil and have no encumbrances on their citizenship. In other words, both parents must at least be citizens.
The 14th Amendment provides situations where a person can become a Citizen, by statute - such as when an illegal alien gives birth to a child in the U.S. But this child would NOT be a Natural Born Citizen as provided in Article II.
In regard to McCain, I have long thought that military bases are considered U.S. soil and that there was no issue in regard to McCain’s Natural Born status. I thought this UNTIL I researched Donofrio’s case. He cites the Foreign Affairs Manual that specifically provides that a military base overseas is NOT U.S. soil. Also, the Immigration and Naturalization
Act of 1790 provided “Natural Born” status upon a child born abroad of two U.S. citizen parents - but this was repealed in 1795 and the words “Natural Born” were removed.

Donofrio makes a pretty compelling case that neither McCain nor Obama are Natural Born Citizens, since McCain was born in Panama and Obama was born with U.S. AND British citizenship (later became Kenyan). The issue is definitely “ripe” for interpretation by SCOTUS, which is what really gives me some hope.
I think everybody with any credibility has said that Obama's birth certificate is legitimate. Go to Snopes.com, for example.
Why do you say McCain released his birth certificate, "no problem"? McCain never released his birth certificate. His Panamanian (not canal zone) certificate was obtained by lawsuit.

A True Christian is indeed judged by the fruit they bear. . . but that fruit goes beyond charity, and doing for others. Obama hardly seems to be a "true" Christian. He mocked the Bible in the public square, supports the killing of unborn babies (including allowing botched abortions to gasp and die on the table by rejecting allowing them to have any medical treatment given), he supports gay rights (though he is quite abiguous regarding marriage); because of that and more, one begins to wonder the motives behind his Thanksgiving activities. Did he do these things because he would normally? Or was it because the cameras were watching? Homosexuality is clearly a biblically sinful behavior, so so-called Christians that support Gay Rights are not following biblical text. . . and it is not about "being a good Christian" through actions, though the fruits of one's lives are testimony to their faith, it is about the fact that Obama has mocked the Bible, mocked Christianity, and supports positions that oppose Christian beliefs. Saying he is a Christian makes him a Christian no more than saying he is Chinese would make him Chinese.
I have never seen any evidence that he has mocked the bible or his faith.
I fundamentally disagree with you on two points;
1) Christianity is, since the earliest times, an Inclusive religion. Indeed many Christian customs and teachings were adapted from the many who made up the Christian faith. Not all sects of the Christian faith conside the bible to be the absolute, literal word of God. There is no great arbiter of "Christ-ness" In fact there are many of us who do not consider homosexuality a sin, in fact there are ordained bishops who are gay. go figure. I guess their sect is not Christian.
2) You can be a good Christian, and yet respect the right of others to live their lives differently. There is no commandment that says you must force all who live around you to live by your strict interpretation of the Bible. The USA supports religious freedom precisely for that reason. You can be a Christian lawmaker, yet chose to vote to preserve the freedoms, even though you don't agree with it via your faith. It's called tolerance.
The attacks on Barack Obama, by supposed Christians, is so contemptuous. 'Their" candidate (JM) had a documented history of very un-Christian adulterous behavior. Their VP had a family besotted with pre-martial teenage sex, yet they are supposedly the "Godly ones". Please.

But, the relationship one has with Christ will normally result in fruits that are recognizable as "Good Christian Fruit." As for forcing all that live around us to live by interpretation of the Bible, I never suggested that, and you makin that statement proves your subjectivity. However, why should ungodliness be forced upon Americans by a homosexual agenda populated by 4% of the American People? Should they be able to force their agenda on those that live around them, even after Prop. 8 passed, by using judicial activism? And you dare proclaim tolerance when I was struck in the side of the head by a foreign object because my rig has a "yes on 8" sticker? Who's the intolerant ones? Who's the haters? Christians are commanded to love their neighbors as themselves. It is not loving to support someone in such an unhealthy lifestyle choice. When someone is making a choice that can take years off their lifespan, if you love them, you don't stand by and say "hey, it's you life".

Your argument doesn't really work. If I had to stand in the way of my neighbors unhealthy lifestyle choices I'd have to work to:
- Stop them from smoking
- Stop them from eating too much fat laden foods
- Get them divorced when they are in abusive relationships
- Take away their guns
- Stop them from having children, driving, and drinking.
The list goes on.
Of course, since followers of Shinto live longer than Christians... perhaps I should encourage a change in religion.

Just read on Berg's website that he contacted the SCOTUS Clerk's office and was informed that since no response was received from the respondents (Obama and DNC), Berg's Writ of Certioari was being distributed to the full court.... with a conference on it set in 10 days. Will that be the 11th or the 15 th ? Don't know yet.
The choice facing the Supreme Court boils down to civil unrest to protect the Constitution or civil war to proceed to ‘inaugurate’ a non-”natural born citizen”.

1) It's not "Berg's Writ", it's Berg's application. The Court grants writs;
2) The issue in all of these suits is standing- as in Berg, Kreep, Keyes, Donofrio have none.

In my view, upholding the Constitution is not now a joke and it never was.
Mr. Obama must prove his Constitutional eligibility to sit as president, and if he does not, then every citizen of this country who respects the rule of law needs to file a suit requiring him to do so.
If he were applying for a job as a surgeon at a respectable hospital, would it be acceptable for him to refer to the fact that he had been accepted at a sleazy hospital in another community to avoid producing his diploma? I don't think so.

Look, I'm thrilled people are interested in constitutional law and procedure. More people should be. I wrote my elections board to ask what the process is for Mr. Obama to be on the ballot here. This was their reply:"
Wisconsin requires all candidates for President (or any other office) to file sworn Declarations of Candidacy (DOC) indicating they meet the applicable age, residency and citizenship requirements. We have DOCs for all candidates, including Senator Obama.
Any issues concerning the qualifications of the winning candidate for Office of President of the United States will be resolved by Congress as part of its certification of the results of the Electoral College. If there are further questions with respect to this issue, please contact the Federal Election Commission at www.fec.gov or 800-424‑9530."
Did you get that? He has to sign a declaration of candidacy. That means that the state of Wisconsin has asked Mr. Obama to sign a piece of paper attesting to his own status and depends upon the Electoral College and the Congress to validate the truth of Mr. Obama's eligibility.
I checked the state dept statutes on immigration. They are heavily weighted to avoid penalizing a child for that actions of his/her parents.
I believe Mr. Obama himself stated in his book that he traveled to Pakistan during a time when that was illegal for US citizens. It is not wild conjecture to think that he was traveling on a passport that labeled him as Indonesian, as he lived there with family as a child. If the passport was the same one his mother got for him as a child, that's one thing. If however, he renewed that Indonesian passport as an adult, that would be a permanent renunciation of his American citizenship. That's assuming he reclaimed his American citizenship within the allotted time by signing a declaration of allegiance and taking an oath of the same.
Perhaps it is speculation and conjecture, but none of it is out of the realm of reason and is certainly not tin-foil hat territory.
It is possible that the 50 SOS did not have to see verification of his status.
It is entirely possible that he was adopted by his Indonesian stepfather.
It is possible that Mr. Obama did not do what was necessary to reclaim his citizenship.
Kindly do not assume that I have neglected to do my own due diligence before taking a position.
As for why anyone might think the child of a foreign national cannot be a natural born citizen, I can do no better than to refer you to the notes of John Jay and the framers of the 14th amendment, as to the meaning of the term natural born citizen.

If your particular state needs to tighten up on it's presidential candidate compliance procedures, that it a matter for your state to sort.
Jay's notes, while persuasive, are not the law. It is for Congress to define what a "natural born citizen" is.
For all the wannabe British/Kenyan immigration lawyers on this blog, Barry's did was a Black Kenyan. He may hay been a British Subject, but he was not a British Citizen: that was not for indigenious people. The law that is misquoted by all these idiot certiorari applications was for WHITE Kenyans so their children would be british. Obama is not entitled to British citizenship. Further, he never even applied. Obama is not British.
After independence, Kenya didn't allow dual citizenship. Many of the white "Kenyans" above had to make a choice: either be British or be Kenyan.
Therefore, if Obama is an American Citizen, Kenya would not ALLOW him to also be Kenyan.
Obama must be an American Citizen becasue he has a US passport. Obama is therefore not a Kenyan Citizen.
Further, can any of you show me any of Barry's supposed application to become British, Kenyan or Indonesian?
Finally, the birth certificate shown by Obama states he was born in Honolulu. Even if it is nothing more that a COLB, Hawaii still wouldn't put some random city of birth.

A. Gold: Persons born in the country of two parents, BOTH of whom are Gold Citizens. (see below) Only Gold citizens are eligible for the office of the president.
B. Silver: Persons born in the country of ONE Gold parent, but not both. Silver citizens have all the rights of citizenship EXCEPT for the right to hold office as president.
C. Bronze: Persons who have completed the process of “naturalization”. Bronze citizens have not been born in the U.S., but the have all the rights of Silver citizens once they are naturalized.
Arnold is a "Bronze" because he was not born in this country. Obama and Jindel are "Silver" because they are born in this country, but not from 2 Gold parents. These second and third class citizens have most constitutional rights, but are not eligible to be president.
George Bush is "Gold" because he is born in this country, and BOTH his parents are Gold. Demographically, most people in the US are Silver or Bronze.
Are you a GOLD CITIZEN? Many people are not.

Most of the cases I have seen filed are against those who should have verified Mr. Obama's citizenship status. I think that's a pretty good indicator that WI is not alone in having passed the buck on presidential compliance procedures. How does that invalidate my argument?
Yes, it is for Congress to determine who qualifies as a natural born citizen. I believe that's why they passed SB - 511(it might be 211)a non-binding resolution to declare Mr. McCain to be a natural born citizen although he was born in the Panama Canal zone, to allow him to run for POTUS in this election.
Are you saying that because his father was a black Kenyan, that makes it all better? He was still, clearly, NOT an American citizen.
I believe one may use a COLB to obtain a passport. I don't know if the COLB that was posted is a forgery or not. I haven't heard any expert testimony saying it is genuine, but I think it's highly questionable to try to verify any reproduction as it says right on the document that it becomes invalid simply by the act of copying it.
Yes,I am someone who regards the truth with a great deal of respect. Calling me names does not invalidate the argument. Show me some expert testimony that it is not a forgery, because, as I mentioned before, I have only found expert testimony on the forgery side.
So far, everything I have seen that claims Mr. Obama is a citizen has only Mr. Obama's word or signature to back it up. That doesn't seem reasonable to me.(Especially given the political culture in Illinois.)
It also seems highly unreasonable for anyone to spend so much money to avoid producing such easily obtainable documents. For the fees paid to one lawyer to tell the SCOTUS that Mr. Obama is declining to produce the documents, he could have obtained enough copies to send to the judges in all the cases that are pending and shut this thing down. Instead, he continues to stonewall.
That's rude at best.

As I mentioned before, Mr. Obama said in his book that he traveled to Pakistan at a time when Pakistan was not allowing US citizens in. It does not require a great stretch of the imagination to suppose that he was adopted by his Indonesian stepfather, became an Indonesian citizen at that point, and was travelling on his Indonesian passport at that point in his life.
I believe Mr. Berg has posted a scan of a document showing he was registered as a student at an Indonesian public school-again at a time when one must be a citizen to attend public school in Indonesia. Do I know if that is "real" - no. It could be real and referring to some other Barry Soetoro(sp?), I have no idea how many boys in Indonesia have that name. It may be the equivalent of John Smith here. I don't know and I'm not discounting either possibility.
I'm just saying it is well within the realm of reason for Mr. Obama to have been an Indonesian citizen at some point during his youth. This would not require an application, simply adoption papers.
If he was adopted by his stepfather, as seems reasonable, he would have had to sign a declaration of allegiance to the USA. If he did not do so by age 23(21 in some circumstances), then he is not an American citizen. Furthermore, if he had an Indonesian passport and renewed it as an adult, that is a permanent renunciation of his American citizenship.
None of this is unreasonable within the wider context of Mr. Obama's well traveled life.

The birth certificate in NOT new information. It was known before the election. Those who knew about it and voted for him anyway are knowingly guilty of treason under the law. Obama entered into a tacit arrangement with a co-conspiratorial segment of the public whereby, if they were to contribute sufficient votes to his candidacy, Obama agreed to become their president. That is conspiracy as well as treason, and those who are guilty should never have rights again.
Voting is a priviledge, NOT a right.
