The legislators are well advised to remember that most of the homophobic discrimination out there does NOT concern who a given person sleeps with at night. It concerns only gender stereotypes - and the given person's (non)conformity to it.
A butch woman will not be discriminated against because of her sexual orientation, which may be gay, straight, or bi. She will be discriminated against because she is not fitting the stereotype of how a woman ought to present.
We all need to remember that without gender identity protections built in, ENDA will be toothless, protecting only the "straightest-looking" 1/3 of the gay population.
