We have the difference between a moped and a scooter issue in our classes. Mopeds aren't allowed. Scooters are. We just let the state DMV make the distinction by what they put on the license plate.
It is tempting to park a scooter in odd parking spots, isn't it?
I am sure for some it is tempting. My BV500 is way too big for those shananigans, and 7' long and nearly 3' wide with the cases on it, it firmly fits into the I'm a motorcycle pretending to be a scooter category. I quite happily take up parking spaces and even park to the very back of the space so my ass end lines up with the cars I park between to reduce the risk of the moron cager hitting the bike thinkng there isn't a car in the spot.
