After trying to piece together the various timelines of what happened after the shooting I have one question: If "one bullet" Barney..oops.. I mean Cheney was sooo concerned about his dear friend being blasted @ point blank range, why didn't he go to the hospital w/ his buddy?? The excuse of "they didn't need another body" in the ambulance is ridiculous! I believe he could of arranged a ride for himself...AND if he was so troubled about the events of the day how could he go back and have dinner!!! Please don't tell me he actually ate the kill from that day!!

Whittington says "nobody drank DURING the hunt."


It seems quite clear that when Cheney was interviewed on Sun a.m. by Chief Deputy Sheriff Gilberto San Miguel Jr., Cheney admitted to the deputy that he pivoted approximately 270 degrees (about 3/4ths of complete circle) before firing off the shot that struck Whittington!

Here's how I figure it happened: Just moments before the shooting occurred, Cheney and Ambassador Willeford were not far from each other, facing towards the south. Willeford was apparently to Cheney's left. (I don't think this is in the police report, but I assume it to be true based on various things I've read.) The sun was setting in the west, which would have been to Cheney's right. Whittington was to Cheney's right (reportedly 90 feet away, but possibly closer), down in a bit of a gully. But of course Cheney didn't realize Whittington was there. A quail then went up and flew BEHIND Cheney. Cheney turned to his LEFT, pivoted COUNTERCLOCKWISE, and spun about 270 degrees, before firing off a very low shot that apparently was barely off the ground, in the general direction of the setting sun.

Cheney's birdshot of course hit Whittington's upper body. Cheney told the deputy that if Whittington had been on level ground, rather than down in a gulley, Cheney's birdshot probably would have struck Whittington's lower body.

I'm neither a hunter nor a hunting-safety expert, but this strikes me as negligent, if not reckless, behavior.

Until I read the police reports, I had been assuming that the quail had gone up in front of Cheney, he had then turned to his right, pivoted clockwise roughly 90 degrees, then squeezed the trigger and shot Whittington. But it seems my assumption was incorrect. I suppose there is some chance that Cheney, when telling the deputy what had happened, meant to say "clockwise," but inadvertently said "counterclockwise." I also suppose it's possible that Cheney said "clockwise," but the deputy then inadvertently dictated or typed "counterclockwise." But you'd think both Cheney and the deputy sheriff, knowing this was a very important matter, would have chosen their words carefully, so I suspect the use of the word "counterclockwise" was not an error.


The Deputy says he received written affidavits from the women on Wednesday. It doesn't say they were interviewed.


Marky -- from what I can tell reading the report, the statements were taken the day after the shooting.

All the witnesses lied about alcohol and now have as much credibility as a teenager found to have empties under the seat after swearing up and down there was no drinking.

He said a bird flew behind him, and he followed it in a counterclockwise direction, not realizing Whittington had walked up behind him to rejoin the group. He said Whittington was about 30 yards away, on lower ground, when Cheney fired his shotgun.

''Mr. Cheney told me if Mr. Whittington was on the same ground level, the injuries might have been lower on Mr. Whittington's body,'' the investigator reported.

ljt -- the report indicates that the Deputy briefly spoke with Katherine Armstrong on Sunday after speaking with Cheney (I think on p. 2, about halfway down), along with indicating that he spoke with other witnesses, including Pamela Willeford.

Ol Harry said that no one drank during the hunt- which opens up the possibility that they got drunk as skunks BEFORE the hunt.

Cheney says that he had one beer with lunch- which doesn't preclude him having had six beers with lunch and/or a fifth of Wild Turkey AFTER lunch but before the hunt. Ya gotta read these things VERY carefully.

2. Peggy Noonan's hackalicious column in today's WSJ is extremely interseting, less for what it says than for its mere existence. If anyone believes that said column was not in some way sanctioned by GOP powers-that-be, I have some very nice oceanfront property to sell you in Nebraska.

The sheriff apparently took little personal interest in all this- he got back to his grilling. He probably only goes to the police officer station for ceremonial duties- like raising the flag on the fourth of July...Clearly he didn't give a shit. He sent his "chief deputy" to do all the work.

Kornblut write in the New York Times: "Until Mr. Cheney acknowledged having had a beer at lunch, members of the hunting party had been adamant that no alcohol was involved. Katharine Armstrong, whose family owns the ranch, had said in interviews that Dr Pepper was served at lunch and that no one was drinking. In interviews with The Times and other papers, Ms. Armstrong heavily implied that no alcohol was served at all.

" 'No, zero, zippo, and I don't drink at all,' she said in an interview published on Monday in The Corpus Christi Caller-Times, the paper she initially called. 'No one was drinking.' "

There are other comments out there that I really have no interest in running down right now. I do stand behind my statement, but guess based on this piece of data I can only say Armstrong lied.


Redd--On page 2 he says that he "was able to locate and get information from Gerardo Medellin...who helped me identify the other people in the hunting party" then he lists their names and drivers license numbers. He then says "I was able to speak briefly with Katharine Armstrong..."

Then on page 3 he says that on Wednesday he "was able to make contact with K. Armstrong, Sarita Armstrong Hixon, Pamela Willeford"

Maybe I'm reading too much into this, but it sounds to me like he never actually spoke with Willeford in person.


Cheney didn't say that he had ONLY one beer with lunch- only that he had ONE.


Maybe Cheney had a bad reaction to the Dr. Pepper. I know I would.

OK. So a couple of things to hammer up here, or hammer on. Declassification of documents. From what you've known and know, did you know or do you believe that a vice president has the ability to declassify documents?

BOB BARR, CNN CONTRIBUTOR: It's not quite that simple, but the bottom line, Kyra, is that no, the vice president cannot just wake up one day and say, oh, I'm going to declassify something. It doesn't work that way. It is a specific procedure that the vice president, who does have authority to classify information, which is very different from the authority to unilaterally declassify information -- he has the authority to classify. But if he wants to have something declassified, there is a process through a National Security Council adviser that he has to go through.

PHILLIPS: OK, because he came out in his interview yesterday, and this is what he said when he was asked about this. "I certainly advocated declassification. I have participated in declassification decisions. There's an executive order that specifies who has classification authority, and obviously it focuses first and foremost on the president, but also includes the vice president."

OK. So we went digging a little further here and found executive order 13292, section 1.3. Now I'm getting really technical here.

BARR: I'm impressed. PHILLIPS: Yes, are you impressed? OK, I tell you, this took all morning. Our staff was going crazy. All right, here's what it says. "The authority to classify information originally may be exercised only be the president and in the performance of executive duties, the vice president, agency heads and officials designated by the president." So if you're looking at this executive order, it looks like Dick Cheney is right, he would have the ability to declassify documents.

BARR Now, there's another -- there a number of documents that one would really have to look at here. The vice president clearly has the authority, in his official duties as vice president, to classify information.

But the vice president cannot, under these executive orders -- plus the fact there are federal laws that relate to certain types of information, such as, in the Valerie Plame case, the identity -- releasing the identity of an undercover operative of the CIA, for example. An executive order cannot override those specific statutes. That's sort of a side issue here.

But having the authority to classify information and being able to participate, as the vice president correctly said in his interview just the other day, in declassification procedures and requests, are very different from having the unilateral authority to declassify, which I do not believe from reading these documents the vice president has.

PHILLIPS: So why would the vice president come forward and say this? Because if it's -- if Scooter Libby, indeed, was told by a superior -- you would think that's Dick Cheney, his boss -- that he could release this information about Iraq, talking about the identity of Valerie Plame.

And now you've got the vice president coming forward, saying I can declassify information if I want. If you start putting everything together, it looks like if that indeed, if all those facts -- well, if all that information are, indeed, facts, that they didn't do anything wrong?

BARR: Well, of course, what we're not dealing with here are facts. We're dealing here with interpretations of executive orders, interpretations of perhaps other bureaucratic procedures, interpretations of law.

And the vice president, although I don't think he's said anything technically wrong in his statement to the press the other day, he's being very clever about it. He throws this issue out there, that hey, I really may have authority to declassify something. Then when he's pressed on it, he says, oh, I might be a witness, so I can't say anything about that. What they're doing is very simple. It's an old Latin term called muddying the waters.

PHILLIPS: We know that expression. All right, so let me ask you this. Let me just kind of re-ask it in a different way. Valerie Plame and the fact that she worked for the CIA, her position as an agent with the CIA, can you -- does that make sense? Can somebody -- because that's supposed to be classified information, right?

BARR: Right.

PHILLIPS: If she's working undercover? OK, has an agent, position, a covert position, ever been declassified before? I mean, would that make sense?

BARR: Certainly, it can make sense in certain circumstances, but it's very unusual to do that. Because -- and let's take the case of Valerie Plame. She was in what's called non-official cover, working overseas in a cover capacity that didn't identify her even as a government official.

That's a very sensitive type position. And even though she or a person in a similar situation may later on be employed in a capacity that is overt, you very rarely would want to declassify a person's position that they -- even though they're not in that position -- because that can set in motion a chain of events that our adversaries can uncover that would identify people she dealt with in her prior undercover capacity that could endanger them.

PHILLIPS: Interesting. It just keeps getting more interesting.

BARR: It is.

PHILLIPS: Have you ever been hunting with Dick Cheney, by the way?

BARR: Do I look like I've been hit with pepper spray? The obvious answer is -- or pepper shot. The answer is obviously no.

I just read through it again, and I think the only witnesses the deputy spoke with on Sunday were Cheney, Medellin and (briefly) Katharine Armstrong. It sounds to me like Medellin's "help" in identifying the other members of the party was to hand the deputy a list of names and drivers license numbers.

This new vice president would, however, have to be very popular in the party, or the party wouldn't buy it. Replacing Mr. Cheney would be chancy. The new veep would have to get through the Senate, which has at this point at least three likely contenders for the nomination, at least two of whom who would not, presumably, be amused.

I'm not a hunter, but from the comments from hunters that I've read, isn't it much worse that he was not only shooting low enough to hit a fellow hunter, but shooting low enough to hit a fellow hunter who was in a lower area?

Put this observation together with Katharine Armstrong's remark that Cheney poured himself a stiff one when he got back to the ranch house on Saturday and you have a simpler explanation for why Cheney kept it under wraps until the next day.

He simply was incapable of any rational thought or action, having lost it after seeing Whittington lying on the ground, a bloody mess.

And that's why no one could get to him on Saturday night. Our five-times-deferred chicken hawk in chief was already in meltdown.

Here are the results in the six dem target states for senate takeover:

Montana 50% approve

The two most interesting are Montana where a dem is tied in a race with a very high Clusterfuck approval rating- and Rhode Island- where Chaffee is tied with a dem in the state that hates Clusterfuck more than any other state!

Both will provide challenges..

In Montana- the dem will have to attack the gooper senator while not attacking Clusterfuck.

In Rhode Island- Chaffee will have to try to save his own ass in a place who would just as soon fry Clusterfuck as salute him.

This is why any "national platform" will always be very vague- candidates need room to move.

According to p.4 of the police report, it was the border patrol agent who turned Captain Kirk (don't'cha just love saying that?) of the sheriff's department away at the Armstrong Ranch gate on Saturday evening.

Well of course Bo Hubert isn't available until the 17th. He's on a nice week-long all expenses trip somewhere nice so he can think about what he wants to say to the cops.

And San Miguel? He's a little distracted of late, too, since he just discovered all his kids have gotten a really swank college tuition fund from an anonymous donor. The chance to go to college! Free of charge.

But there had to be Secret Service Agents "around" ... why weren't they interviewed or asked for affidavits? They were probably the best trained and professional observers on the scene.

Cheney suggests in the Fox interview and the Wall Street Journal clearly says that Cheney turned to the right, but police report says he turned counter clockwise, which would be to his left, correct?

Lee- It isn't clear whether Cheney was facing north or south before the shot- if he turned counter clockwise- he had been facing north and then turned to the west- into the setting sun. I can't see how the difference could be very important though- it's clear that one way or the other he shot the fucker.

In my experience- these types of details almost NEVER agree- a surprising number of people can't immediately tell you which is their right or left- and certainly can't point out north..

The issue is almost certainly about drinking- not direction.


Peggy Noonan makes essentially the point I've been making for a couple of days: naming a Cheney successor when there are so many presidential aspirants is just begging for some serious internal bloodletting for the GOP.

Throwing Cheney under the bus is a lot tougher than many people here have been hypothesizing.

They've done a modified limited hangout with the "one beer" concession, bought time and testimoy for the record, and are hoping, as EW points out, that they can circle the wagons and hold firm, as ever.

In one part, the story relates that Tobin Armstrong, still alive in 1999, "At age 12, Armstrong shot a buck from a custom-made hunting car with his uncle, Tom Armstrong, and the King Ranch's Bob Kleberg Jr.
"Both men looked at each other and said 'Nice shot, Bob. Nice shot, Tom.' Then they realized I had shot it,'' Tobin Armstrong recalled.
Toasting Tobin with liquor that they kept in the back of the hunting car, Tom Armstrong suggested they give Tobin a new rifle as a reward for his good shooting. Kleberg said that a rifle wasn't good enough. He suggested Tom Armstrong's own customized hunting car. If start out in a line with people on your side, any turn at or beyond 90 degrees is going to put your gun through the path of one of the other hunters. I don't know anything about hunting, but it sure seems like any turn beyond 90 degrees would be extremely dangerous.


Much as we'd like to think that Cheney would be weak and damaged if he remains, the fact is that simply remaining gives him strength. Rove has not been diminished by any scandal, but Libby has since he is out of a job.
Cheney in office is strong; Cheney out of office is weak---moreover, Cheney out of office makes the dam more likely to break on the Plame case.

Cheney out of power makes it more likely Libby will flip.

The missing part of your analysis positing a Cheney rebound in strength is the continuing threat of other scandals that hit him directly or indirectly.

If hanging on would get him out of all trouble and out of the woods, I would agree with your analysis.

He still faces Plamegate exposure. And even if Karl goes down, or Abramoff stuff hits congress harder, he takes collateral damage, since he IS the GOP establishment.

Warrantless wiretapping can still hurt him, and he is more damaged by shooting a 78 year old man in the face even if he does hang on.

Parts of you analysis seem right to me, but purley playing for time does not do anything other than forestall immediate implosion of his position. It does not, in my estimation, fundamentally strengthen him or alter the dynamic against him, given everything else still in play.

That's just my take.

I'm not a hunter, but from the comments from hunters that I've read, isn't it much worse that he was not only shooting low enough to hit a fellow hunter, but shooting low enough to hit a fellow hunter who was in a lower area?

Sometimes the quail don't "flush," that is, rise up as one and fly. Occasionally they just run along the ground for a while and then take off. Shooting them on the ground is called "skillet shooting" and is considered very bad form, and might even be illegal. Of course, if it was considered something that a real hunter wouldn't do it stands to reason that Cheney would do it.

And rwcole is right, drinking and hunting go hand in hand. I watched a hilarious clip on C & L yesterday in which Fuc..I mean Tucker Carlson said he'd been on dozens of hunts and had never seen anyone drinking while hunting. Those must have been dainty affairs. The other two guys Scarborough and O'Donnell just laughed out loud. No one needs to remind me what a bad idea combining guns & alcohol is, I'm just saying it's extremely common. I'm sure I'm not the most experienced hunter on here, but I've hunted quail in Missouri and deer and dove in Texas and, well, let's just say .......an extremely large time was usually had by all.

Tim Kaine, whatever you think of him, did win Virginia. Dems are exceeding expectations and Republicans can't recruit candidates.

Even the establishment watchers like Stu Rothernberg and others are predicting Dem gains in both houses, barring events that change the dynamics in play. The only question to them is whether those gains will be enough to retake either or both houses (the tidal wave phenomenon, which does happen).

Chris Bowers has been crunching the numbers and reviewing history, and there are forces at play that certainly create a lot of tailwind for Dems this year. We'll see.

To choose a Cheny replacement (unless it was some doddering old one) would basically be crowning that person as money frontrunner iin 2008. That would upset a lot of people who probably are arguing they deserve their own shot....

Amazing that when the police interviewed Whittingon in the hospital on Monday, he "explained foremost that there was no alcohol during the hunt." The man is shot full of pellets, has a minor heart attack, but he is at pains to explain "foremost" that no one had been drinking during the hunt.

That part is up in the air. He faces a primary challenge, so if he clear that, and then thinks he is free to act effectiely as a Republican, it's possible. But he could also be forced by his primary to hew left, and that might constrain him a bit in the Fall. Too early to tell.

Let's hope Ned Lamont beats him and makes him run as a Republican if he wants back in the Senate.


Indiana has a "Sore Loser" law which prevents a loser in a primary from running in the fall as an independent or finagling the appointment as the candidate of another party. I hope Connecticut has one for Lieberman ...

I generally agree, though my appraoch comes more from negotation experience and theory. I'll be teaching it an Ivy League business school MBA program this Fall.

I also play some chess, but not online stuff. I tend to make careful calibrations of the leverage environment, and of the personality/human factors (psychologist and all).


But I totally agree with the point about preparation and anticipation. And I agree the DC Dems are not doing it well. I'm all for sending them "tough love."

Oh, and they are going to muzzle Comey and Ashcroft when they testify.

Misdirection folks. While the press was busy salivating over birdshot, beers and babes--Darth Cheney was doing his specail magic on those few republicans in Congress who foolishly thought they might get away with actually doing their jobs for 5 or 10 minutes.

If they are still afraid of him, we should be too.

Noonan may well be stirring the pot a) for amusement--it is entertaining to think about, b) for more misdirection.

Gotta go back to giving whistleblowers cover and trying to push back on our Congresspeople and Senators to actually do the checks and balances thing.

2 things motivate our beloved Congressional leaders: money and fear.

If they see donations flowing in a given direction--toward or away from a particular cause-- they follow the money. Fear of anything that will cost them votes. They need to get reelected after all.

The only way we can counter the fear they have of being swift boated or outspent in a targeted race if they annoy BushCo is to make them MORE AFRAID of the wrath of their constituents than they are of the Administration.

The more the work of the blogesphere moves the MSM and drives the story, the more it organizes blocks of people to unified action (like the many calls to write your Congressperson-- or MOVE ON want s to have vigils), the more it raises money for candidates who demonstrate allegiance to the rule of law; the more responsive Congress will be to the needs of the people. We, the people have to be aggressive consumers of the work of our elected officials and make sure they know that we do care and are paying attention.

But that does not necessarily indicate strength. The nature of a crime organization like this is, once the first real crack occurs, the whole structure collapses. Fear and desperation can create the appearance of last minute unity, but it's not necessarily well grounded byt a reliable foundation.

"Bo" had to be the dog handler. He doesn't show up in the FEC campaign contribution database.


Quick, if slightly stale, observation about Armstrong's alleged eyewitness account.

Cheney told Hume that after he shot Whittington in the face, "they were able to get the ambulance there, and within about 30 minutes we had him on his way to the hospital."

I can think of two ways that this "were able to" construction makes sense:

(1) Cheney's ambulance was not part of the hunting entourage and they "were able to" summon it from elsewhere on the ranch;

(2) Cheney's ambulance was part of the entourage and they "were able to" drive it through the brush up to the wounded man.

My money is on (2). And if it is (2), then we have a tiny bit of further evidence that Armstrong wasn't close enough to see anything. Cheney wouldn't have said "were able to" if the ambulance had been right there, within "eyewitness" range of the shooting.

Longitude: -97.7514. You may need to zoom out - the runway appears to run from NW to SE!

First, let's convert some coordinates: N 26 degrees 56.352, W 97 50.420 = N 26.9392 degrees, W 97.8403 degrees. That, as you mentioned, is where the accident occurred. According to my software, the elevation at that location is 33 feet above sea level. The terrain within 100 feet of that point is practically flat. Yes, there's a possibility of a ditch in that area that doesn't show up on the map when I zoomed in on those coordinates.

I have some other software I can use later on. There's also Google Earth. Let me see what I can find out from the maps provided by the other programs I have available.

It was reported in the press that a Sheriff's deputy was turned away from the Armstrong gate. Why no mention of that occurrence in the Sherrif's Report?


The entire police report is suspect. The parties involved have all had time to get their "story" straight, by the time the police showed up the next day. The fact that their "stories" "match up" proves only that they were all involved...
