No other hint about who the source was except it was "cooperative". Pincus reiterated his denial of hearing from Woodward about Mrs.Wilson a month earlier...

OT - don't know what's going on with senatory kerry... but, as of this morning his DC office is saying that senator kerry is "keeping his options open" and "hasn't decided" if he will support the resolution to censure president bush. called the boston office to confirm and they're not talking - seriously, wouldn't even let me finish the question... told me i'd have to talk to the DC office and hung up on me.
earlier in the week it was all politeness and both offices had confirmed that senator kerry "strongly supported" the resolution.
does anyone know what's going on?

There's been so much terrible reporting on this topic, and thus your well-considerd exposition of the basic principles of classification is a breath of fresh air on a fundamentally important topic.
Two quick related facts:
(1) all classified discussions must be motivated by a specific "need to know", so that there's a lot more to it than simply "insuring the right clearance level for classified communications". Two people having the proper clearances is not sufficient legal basis for classified discussions -- there must first be a "need to know" to justify the communication, regardless of whether the clearances permit it. Proper need to know motivations are inherently technical (not political!), and specifically exclude non-technical motivations, e.g., mere curiosity.
(2) classification is a LOT more complicated topic than the corporate media leads us to believe. There's a lot more than "secret" and "top secret" involved here, including compartmentalization classifications (e.g., NNSA Sigmas) that may themselves be classified. Given this, the recent assertion by the WH that the prez can simply "choose to declassify" information by administrative fiat is not only ill-considered, but also hopelessly infeasible in the real world of interlocking and nested classifications.

Called Sen. Wyden's office. He has not put out a position on the Feingold censure resolution yet. I asked the person who answered the phone when Wyden was going to announce a position. He told me it would be soon but wouldn't narrow it down any further.
Wyden must be getting a lot of calls because I was put on hold for awhile and when the person answered he sounded frazzled.

Actually, it wasn't just post-war CYA. OT - I have a question for Redd. I read what you wrote recently about the prosecutorial misconduct during the Moussaoui trial and I have a question. Doesn't it seem just a bit bloodthirsty to be spending what seems like a herculean amount of energy to get a death sentence for this guy? I know the rationale is that it would help 9/11 families get closure but is that in the interest of justice or just vengeance. Didn't the judge already express concern over pursuing the death penalty based on deaths caused by non-cooperation. Does anyone else find this to be bloodthirsty?

I grew up in an area where a lot of people had clearances of need-to-know-and-you-don't flavors. Kids didn't ask 'what does your father/mother do?' because it wasn't going to get more than a generic answer ('engineer', 'secretary', ...). So if Libby and Rove don't understand that sort fo thing, I think it's because they were told they could talk.

Ever since 9-11, they've also been quick to claim the war on terrorism as a justification for breaking the law. They say, "Trust us. We're protecting you from the terrorists."
They've said that for five years. But if we accept Bush's recent poll numbers (nobody believes poll numbers, now do they? Nahhh...), then nobody's buying this administration's spin anymore.
The Bush administration is done. Oh yeah, we'll have a little blips on the radar like ANWR or Medicare, but no more major policy initiatives.
There's still Iraq. But, again, polls indicate he's lost the majority on the wars there AND aginst terrorism.
Damn you, polls! (Fist raised skyward)
The next step is to hold the Bush administration accountable. Isn't an "accountability moment" coming up in November? My hope is that if Democrats can manage keep it together long enough to reclaim the Senate, then they'll lose their timidity and truly investigate and punish the crooks in this administration.

1) Dems cowering, refusing to respond to constituents;

3) NSA spying program unclear about targets, may include opposition party members;
4) As mentioned in previous thread, a progressive Senator and a Rep die under mysterious circumstances, the Senator after a threat by Cheney and after unsolved anthrax attacks on Congress persons;
What if Feingold KNOWS he could NOT speak with the Dem Party in advance of his announcement, that he had to go public first on This Week before any action could be taken? Perhaps Feingold thought it was the only way he could safely tip off Congress in advance without flagging the "Republican Guard"?
And what if a large portion of the lemmings are people who understand and perceive the nature of the threat against them? Have any of them been threatened in regards to Iran???
Just sayin'...
If this were legitimate, how do we encourage threatened folks to stand up en masse against their bully?

There are no good answers to it -- other than political payback, revenge, or other even more unsavory motivations -- none of which are appropriate under "need to know" considerations as far as I can tell. If anyone has more experience with classified matters and can weigh in on this, I'd really appreciate it -- because it seems awfully clear to me that they ought not have even been told her status under the regs. Period.

Getting ready for work this morning I had the Washington Journal on. I haven't done this for awhile because I normally oversleep and catch the news on NPR in my car on the fly.
I was pleasantly surprised that callers on BOTH lines are very frustrated. I don't know if today was a lucky day or if callers have been expressing these feelings for awhile......Things are not going well for this administration. (Of course, one wacko was calling for nuclear war with Iran as soon as possible.)
But last night TOOK THE CAKE! Watching Pat Buchanon actually telling television viewers that the only way for this president to raise his numbers would be to begin bombing Iraq. He was so excited that you could tell he was already convinced and hoping that it would happen soon. Does he have family serving?

First off, you only implement the largest bombing campaign in a "non" war after you "win." Why? You might ask, that sounds like a silly thing to do. To show the people who "lost" the "non" war that you could "win" again, and to show the people next door who are the target of the next "non" war that you can do it to them too. See, when Rummy was talking about the new paradigm of asymetric warfare he was really talking about "non" war, and "non" death and "non" destruction, b/c so long as you've "won," well, you've "won," and what happens after doesn't count, ever, because you are "winners."

I just read a piece that made the point that the is being termed an "air assault" and not an "air strike". The author made the point that this is lingo for using aircraft, usually helicopters, to ferry in troops. An air strike in military lingo refers to firepower from the air. I don't know whether this is correct. Has anyone actually heard reference to bombing?
Another thought. Does the area in question, northeast of Samarra, having any particular significance for a possible future assault on Iran? Anyone out there informed about such matters?

It appears that the US military is moving into the next phase in their conduct of the war..
They want to turn the "boots on the ground" work over to Iraqis and allow the US to provide abstract and random "death from the sky". This will:
1) reduce US casualties (down to one per day this month)
2) increase Iraqi causalties
Their hope is that this change will make it possible to continue the US role in the conflict for another few years.
They may be right.

Do keep in mind that Libby did not have a need to know the identity of any NOC, nor does Rove, nor does Cheney. Just trying to find out was a security violation, and the CIA should have not given this information out. Security considerations are not governed by one's rank in a hierarchy. This just demonstrates that the administration is not concerned with security except, as with apparently anything, it can be used as an authoratian tool to stifle dissent.

Speaking of the sterling job the press is doing with this story--what a difference a word makes. Here's the last sentence of David Johnston's article for the New York Times about Armitage possibly being Woodward's source:
"Novak identified Wilson in a column on July 14, 2003, after Wilson's husband, former Ambassador Joseph Wilson 4th, publicly criticized the Bush administration as twisting intelligence about Iraq's weapons programs in the months preceding the war."
At the risk of sounding Clintonesque, the use of the word "as" in that sentence is downright weaselly. To see how wrong it is, consider the following:
"Republicans publicly criticized Clinton as getting a blow job."
Doesn't sound right, does it? Because it's not what you'd say; you'd say they criticized him for getting a blow job, because, well, that's what he did.
The word "as," however, would be correct in a sentence like, "The GOP portrayed Clinton as dishonest." The difference here, of course, is that the GOP would like you to think Clinton's dishonest, but that doesn't necessarily mean he is.
Johnston's use of "as" avoids coming right out and saying the administration twisted intelligence; it implies that the White House's lies pre-Iraq are open to question, and maybe just a matter of Joseph Wilson's opinion. This one little word is a microcosm of all the craven water-carrying the press has been doing for Dubya all along.
Tell the truth, David: Wilson criticized the administration for twisting intelligence. It's what he did, and more importantly, it's what they did. Just say it.

It's hard to imagine a legitimate reason why anyone at the highest levels of the WH should have this information -- this kind of operational information would normally be compartmentalized, and the most obvious way a high-level manager (e.g., the prez) would learn about it (absent clear evidence of wrongdoing by the lower-level operative, which isn't the case here) would be through micromanagement .
This CLEARLY isn't the situation here, as the Bushies don't know how to manage, much less micromanage.
There are plenty of illegitimate reasons, tho, including the all-too-obvious one of political payback against Joe Wilson. There might be even more nefarious rationales at play here (it's easy to start sounding like a missing episode of the X-Files while still remaining firmly grounded in the facts at hand about this sordid episode), but all of the likely illegitimate reasons could easily arise from a single common modus operandi of the Bush administration, namely that they try to work the levers of government without any sense of respect or understanding for how that government actually works in practice.
For example, people who've never served in the military readily make military blunders, e.g., the myriad problems with the execution of the Iraq war. And people who haven't served to protect classified information readily make information security blunders, e.g., pointlessly outing a CIA operative working in one of the most important venues of counterterrorism and nonproliferation.
So I suspect the reason that they know this stuff is simply because they have no clue that they ought NOT to know this stuff. They just don't "get it" when it comes to governance and the rule of law, and hence trying to find rational reasons for their actions is a futile exercise.
What's scary here to me is that "they don't get it" and "there's no accountability" is as lethal a combination as I can imagine for the behaviors of a public servant. As long as there is no penalty for bad actions (e.g., retaining one's security clearance after even the slightest hint of impropriety in handling classified information), and no desire to learn about how the government is actually supposed to work, then's there nothing but trouble ahead.
The good news is that this problem is now well-established, thanks to continuing evidence that the Bush administration has no idea how to govern, and no apparent motivation to learn on the job, either.
So the outing of Valerie Plame is now but one example of a now-well-established larger problem, which makes this story easier to tell, and which helps the citizenry learn that their current government is not working in the national interest.
just fwiw, the image I have of the Bush administration is that of the bus driver in "The Truman Show". He knows there's a steering wheel and pedals and levers, and he places his hands on those controls with an apparent sense of purpose, but he simply has no idea how any of those devices contribute to make the bus go.
With regard to the CJR Pincas article, this is the best line for me:
He learned that principle of incremental coverage in part, he says, from Andrew Lack, then of CBS News, in the early 1980s. “Andy came out of advertising,” he says, “and he got me thinking that what news stories on the nightly news were — if you think of them as ads — it’s the visuals, and the message, and it has to be repeated. My two cents re: the classified info leak, learned from serving in a comm unit in the Marine Corps:
There are three things you need in order to deal with classified material - Clearance, Access and Need to Know. You MUST have all three or you are in violation. Even if you have the clearance and need to know, if the info you seek is in a locked vault and you aren't on the list to get into that vault, then it's a no-go.
This is Classified info 101 for the military, stuff that even a lowly Private knows about, and takes very, very seriously.
That Scooter Libby chose to violate these very simple rules is inexcusable. "I was really busy," in the military would translate as, "I'm just too incompetent to do my job correctly, so please court martial me."
To give a small example, I worked with cryptography for radios. If, during an inventory, a piece of gear was missing and couldn't be found, then nobody in the entire unit was going home until it was accounted for (with the risk that the whole base might be shut down and outgoing vehicles searched). This didn't just apply to actual Crypto Keys, but even the cables used to connect the equipment. Also keep in mind that none of that equipment even had valid crypto information stored on it.
Regardless, losing gear was not an option. No matter what.
To riff off of cieran's point a little, I'm wondering not just why Libby had Need to Know, but how he got Access. I'm not sure if all those CIA files are open to people at that level, but I would assume there is a vetting process for every single NOC file that gets passed on, and if not, then there should be.

Lets see here, Bush corp. violates Nation Security and then uses National Security as the reason that the case can’t be tried. Never mind that Fitzgerald had to limit this case to perjury, instead of the vastly more important case of the breaching National Security, because Bush corp. would have used the National Security trump card to prevent the case from going to trial and thus getting their just deserves. Now they have the unmitigated audacity of claiming that same National Security “Get Out of Jail” card belongs in the same domain as the perjury trial, when the only possible connection is the errant claim that Cheney could declassify Plame’s identity. Talk about having your cake and eating it too!
The unmitigated gall of this administration has been a constant and unbending force since day one on the job. It’s not just their utter disregard of their oath to the Constitution and that they consider themselves above the law that is so disgusting. It’s the sweeping wave of amorality that I strenuously object to!
That this country appears to have lost its moral bearing is beyond debate. Seemingly, the political leaders, the religious leaders, the traditional media and the people of the United States of America have become inured to the constant moral outrages perpetrated by the Bush administration, of which the outing of an undercover CIA agent is but one of an almost innumerable examples which readily spring to mind. The perceived lack of outrage in this case is symptomatic of a larger trend.
To see the scope of this onslaught of this immorality, I propose that we focus on the case of Valerie Plame Wilson. Valerie Plame Wilson was a CIA NOC according to the CIA, who reportedly worked in the area of weapons of mass destruction. I think that we can safely say that one of our greatest fears is that terrorists will explode a nuclear bomb in one of our cities and certainly, the Bush administration representatives used this threat as their primary reason for the preemptive invasion of Iraq. Really, the outing an agent that was working to prevent such an occurrence is such an utterly disgusting piece of work that mere words fail to convey the full moral outrage. Ask yourself this: if given a choice between drinking a large, steaming bowl of diarrhea and outing a undercover agent whose work was to prevent terrorists from gaining weapons of mass destruction, what would do? Where is the perceived outrage to match the magnitude of such a dirty deed?
As I said before, this is just one example of a seemingly innumerable amount of actions by the Bush administration of radically amoral behavior. Where is the oversight called for in our Constitution to prevent such outrageous actions? Well it isn’t in our Legislature because the GOP controlled Congress, which apparently shares the same goals and ideology as the Bush administration, has almost unanimously supported these actions by choosing not to defend the Constitution, as is its charge. And thus, our Constitution and we the people of the United States are now clinging to the hope that we can find justice in our judiciary system. And the fact that these perpetrators of these amoral, unlawful, and unconstitutional actions can possibly escape justice by invoking national security as a legal trump card, when they violated that same national security is outrageously infuriating! Where is the perceived outrage?
I will tell you where the perceived outrage is. It is located in the offices of the traditional media, the offices of the Congressional staffers, the offices located on K Street, the offices of the top management located on Wall Street and all the appendages that make up the Republican Noise Machine. They control the perceived dialog in this country and thus they quite successfully suppress the perceived outrage. The real outrage is that, so far, we the people (or the peasants under glass as they like to refer to us) are powerless to stop them.
Where is the outrage?

You really ought to get folks to look at Title 18, Sections 793, 794 and 798. 793-794 pertain to Libby and his disclosures of Plame.
I reference Title 18, Section 798 about the Chalabi disclosure to Iran that we had broken their secret codes.
As you mentioned, just failing to report an accidental disclosure is a violation under 793. The particular portion is 794(f).
I've read that Brewster Jennings was working on WMD to IRAN and I'm still at a loss as to why no one seems to want to touch that angle.
