First off, at least in Canada, church and state are separate.

This issue, at least from a Canadian perspective, is a battle for rights. It is a push for the "right" to wed. It is not to decide whether or not same sex couple "should" marry or are "allowed" to marry.

Under the charter of rights, every man, women or child is to be treated equally regardless of age, gender, ethnic background, religion, are sexual orientation. There is no "Equal, but separate". If Marriage is a right, which it is, and rights are protected under the law, which they are, it is only reasonable to say that the right of same sex couples to wed must be granted. Doing otherwise would be in violation of the charter of rights. Whether or not same sex couple "should" marry is an issue the church must deal with.

Religion does not apply to the charter; as such charters were created to prevent the oppressive societies which occur through religious influence in the state.
