I bet you a higher percentage of Americans at large agree with more Santorum or Kyl positions than they do Boxer or Kennedy.

Interesting analysis, Ryan. You raised some points I hadn't considered, and the argument is compelling. Aside from the bit that the amendment is "unconstitutional," that is. But like you said, I'm not sure that's even technically possible!

Ryan, I doubt that any new ammendment or repeal will pass in your lifetime.
I think having appointed senators would just accelerate the pork fest.
Consider, has any school district or state told the Dept of Edu to stuff NCLB and simply run their schools without federal funds and interference?
state legislatures don't want more authority, they want more money.
