See-Dubya,
You are spot on. This would be a terrible precedent. Yes, the NYT set is going to badmouth conservatives for not demanding Mr. Delay's delivery to Abu Musab Zarqawi over this but whats right is right (and no matter what we do the NYT set is only going to badmouth us).
I will admit a conservative might have much to not like about Tom DeLay the guys in Congress at all levels and parties love to spend our money, but to demand his resignation in a moment of politically inspired abuse of DA powers is not the way to oust him.
The Dems had better think about if they really want what this. They screamed and hollered during Watergate for an special prosecutor law and got it, boy did they come to hate that one.

I think your position is the closest to mine on this. Delay was right (and obligated) to step away from his leadership duties. But if all it takes to force the resignation of an effective politician is to get some ambitious county DA to file BS conspiracy charges, well, that's just an invitation to abuse of the judicial system.
Jim Trafficant didn't step down until he was found guilty. And he was really frickin' guilty. That's the precedent, and it ought to be.
