The insinuation that he shredded evidence of NCAA violations is the most absurd. On one hand, they're saying "We know he shredded all our info about recruits, discipiline, S&C, etc!" and on the other saying "We know that he shredded information of violations, but we had no idea about the violations!"....uh, then how do you know that's what he shredded?

It would depend on the circumstances. If, for example, Pryor was expecting Rod to call, Rich wouldn't have had much choice. Not calling would be viewed by WVU fans as Rich deliberately stiffing a recruit to piss him off, while it would be dishonest NOT to mention he was leaving once they were in contact.
Since we don't know the circumstances of why the call was made, I'm withholding judgment on the matter.

After sleeping on this story, I've come around and now agree this probably won't be a big deal when all is said and done.
As for WV, maybe they should've stopped TALKING about how RR was their first citizen and favorite son and started encouraging the WVU AD to take more ACTION as far as keeping RR happy.
WV's behavior really reminds me of my psycho ex-fiancee, who attempted to frame me for stealing her purse and cell. I wound up letting city cops search my place and had them escort her out when they couldn't find anything.

The WV Gazette columnist was pretty good on Valente and Foster earlier. He said that he doesn't believe anything will come of this legally or be investigated by the NCAA. The guy actually defended Rich Rod in that aspect saying that there isn't any evidence that he destroyed anything that could get him or WVU in any trouble. However, he did say that he believes Rich Rod has a significant ego and and felt like the WV AD didn't appreciate him. He also said that he believes Rich Rod shredded all of these documents to spite the administration. That was his main point. Why does Rodriguez seemingly want to hurt his former program and his alma mater? I agree with the columnist that this raises serious questions about Rich Rod's character and if he did this to his alma mater, what makes anybody think he wouldn't do it to us?

A former WVU wide receiver was working on a software program for Mike Barwis to implement in the WVU weightroom so that data could immediately be entered into the computer system, rather than writing it on paper and entering it later. So most information probably still exists, but apparently the hard files are missing.

I apologize for singling you out. That was wrong of me to do that. However, it seems as though that myself and a couple of others who are skeptical of Rodriguez are immediately thought of as bucknut or WV trolls. Nothing could be further from the truth. I just want to see our program back on top and know it is done the right way. I have no doubt in Rich Rod's coaching ability. I just can't help but wonder if he is having such a pissing match with his own alma mater, which he has professed his love for, what would happen to us if he ends up leaving one day? Admittedly, the contacting of TP & JJ before telling his own team is what has me really bothered. Michigan has always done things on the up and up when it comes to recruiting. That just seems shady and unethical to me. I hope I am just overblowing everything. We'll just have to wait and see. Take care and GO BLUE!

I've interviewed Rod enough to know he's an egomaniac, so I think he was probably just spiting the WVU administration with whom he couldn't get along. I've stood next to the WV journalist who broke the story enough to know he's a jerk. The WVU President who dealt with Rod over the last 7 years and retired in Sept is one of my professors and is clearly bitter toward Rod. The video coordinator who assisted Rod in cleaning out his office taught one of my undergrad classes and is a blunt/rough guy (when calling on a female he would just point and say "girl"). Great teacher to have though... only slightly harder than a Jim Harrick Jr. class.
This story will go away. Rod and the administration went through an acrimonious divorce. Rod stuck it to WVU by shredding files. WVU stuck it to Rod asking for a declaratory judgment.

Jay- ask yourself this: Has our AD ever done anything wrong to our coaches? Has our AD not given our football coaches what they needed to succeed and given them a LOT of time to be successful (i.e. even if they lose big games a lot, they aren't worried about keeping their job and getting fired off of a knee-jerk reaction?)? If the answer is yes to any of that, then yes, I am afraid of RR doing "the same to us" as he did to WVU.

Any word on facility upgrades besides the stadium? I had someone tell me that Herbstreit was saying on the radio a while back that Michigan's facilities (weightroom, locker rooms, etc) were in need of an upgrade. Not that they were horrible just to keep up with the arms race in college football. Anybody know anything?

The MSM is reporting that counsel for RR has lodged a motion to remove the case to federal court. The support offered in favor of the motion appears strong. I truly hope that the case gets removed from local yocal jurisdiction to an impartial federal judge. The bile-driven idiocy should terminate a lot sooner if it is and everybody can get on with the game of football itself.

Thanks for the update. I'm 22 and feel too old for Facebook so I don't use it either. Equipment and technology is all that should matter. I agree, my HS weight room was underground and had low ceilings and it was/is my favorite spot to work out when I'm back home.

I'm from Kalispell, MT which is right by Glacier Nat'l Park. The big ski resort up there is Big Mountain. Whitefish is the town at the base of the mountain and it's pretty cool. Kalispell is 20 min. from Whitefish and might have cheaper hotels. Big Sky is south by Bozeman, it has the same skiing but has a bigger area to ski than Big Mountain. My dad was just at Big Sky and said it was awesome. Bridger Bowl is in Bozeman too and I hear is pretty fun.

It's just mind-boggling to me that:
1) WVU can suggest that RR's shredded files were the single source for academic records, scholarship records, financial information into their football camp, etc, and NO ONE in the media actually questions this. If there's a flood in RR's office, and his paper-records get destroyed, the all information of them vanishes? Come on.
2) WVU can insinuate that RR may have shredded evidence of NCAA transgressions, and simultaneously contend that they have no idea what the transgressions may be. That's literally impossible.

Michigan has a problem. The WVU smear campaign appears to be working. Today on Rome I heard Dan Shaunessey and Mark Whicker, both of them saying that RR is basically scum and players going to Michigan should be worried that he'd be shredding their files. They have swallowed the WVU version of the story (sponsored by the Charleston paper) whole.
It's time for the University to put its reputation on the line and do battle with WVU -- if RR did not commit any criminal or unethical act. They have gone too far.
West Virginia is an embarrassment as a university.

Given that WVU is already locating copies of the allegedly missing docs, I think it's more and more looking like a smart smear campaign to ruin RR's recruiting efforts. The perpetrators know that eventually it will be shown to be hogwash, but it will take several weeks for that to occur. Meanwhile, recruiting is going on right now, and for the next two weeks every other coach going head to head against UM is saying "Ma'am, you don't want your kid playing for Rodriguez... he'll order Barwis feed your son into the shredder feet first. I agree with FloridaGoblue that Michigan needs to do something. But I'm not concerned about the recruiting issue as much as I am about the reputation of the program (and of the school, generally). RR hasn't done anything wrong. I don't believe that he had any hint of a scandal while at WV, even though he did take some chances on some questionable characters (Pac Man, Henry, Devine). But he's being dragged through the mud by his scorned ex-employer and Michigan, whether it realizes it or not, is getting muddied in the process. This is ridiculous. Michigan and RR at some point need to speak up publically. If they don't, this crap will blow over, but people will always consider RR (and the program by association) shady. In today's idiotic soundbite age, whomever speaks loudest and last wins.

BTW, I feel stupid now for reacting at all to the document-shredding story from yesterday. The more that comes out, the more this thing is obviously just another FU from WVA.
Talk about a psycho ex-girlfriend. They are basically saying "what, are we not good enough for you? We're plenty good enough for anyone." And then they are completely freaking out and showing exactly why RR was right to leave in the first place. Why leave? Because you guys are f-ing NUTS and you clearly have HUGE self-esteem issues.
That video was so totally appropriate it was hilarious.
Interesting legal question, though. If you are a coach, and you develop plays while at a university, does the university "own" those plays and the playbook? And if so, could you take those same plays to another university without asking permission?

Surprised that no one has mentioned this: IIRC, during one of his earliest interviews, RR said he's not "a computer person," or something to that effect. So he probably keeps hard copies of everything, and knowing that the University's files on a computer would be perfectly safe, he disposes of stuff that's unnecessary to keep.
Either that, or he's a dirty, rotten scoundrel.

The usual disclaimers apply. I am not your lawyer, I am muffintop in Cosmokramerville.
It depends. If the U protects the playbook as a trade secret and/or registers it with the copyright office then the U can legitimately claim ownership in the playbook and, possibly, even the performance rights to the plays if reg'd under copyright. Note that it's possible to copyright some trade secrets without disclosing the substance of the trade secrets by filing redacted registration application specimens. In addition it may be possible to obtain method- and system- type patents on the methods and systems claimed in the playbook or related materials and, in particular, S&C methods which demonstrate tangible results. These may be of dubious validity in the current legal environment but does a coach really want to spend the money to be vindicated? No, most will fold, which is one of the reasons why you haven't read much on IP issues in sports coaching and training; however, given the increasing stakes in CFB programs, it would not surprise me if future IP claims against admin/coaches/players are made someday. I've prosecuted patents relating to teaching methods fwiw.

I think that this is the same thing as professors developing course content at a university. The university does not own said content and the professor can sell it, take it to another place, etc.. In fact, a faculty usually packs up everything except for the files stored in the main office and sometimes even negotiates equipment that can be moved that he purchased. A university is different than an average workplace in this respect and the autonomy of the academic force is usually greater than other places.
Just my 2 cents.

A university *can* choose to own said "content" if it takes appropriate steps. Even to the exclusion of the author/inventor/originator. You are correct, however, that universities do not take these steps consistently, in part, because they have styled themselves historically as "open institutions." Professors in the social sciences receive different treatment typically than do academicians in life sciences and engineering areas. There is a trend though toward locking up rights where the money is via university technology commercialization and brand licensing offices. So be careful making assumptions based on perceived practices - the ball is moving. My 0.02

Good point and understood. I was mainly referring to course material and not research output. As far as I know, the universities have not cracked down on making course material portable, aka workshops or textbooks or even taking content with you when you leave. However aCharlieWeisStomachStaple above refers to a case that I don't know about. They probably have the right, but at least for now it is not practice to restrict this. Though I am not a lawyer so will defer to others.
I see the course work as more akin to the play book question, IMO. However, they may be lax only because there is not enough money in teaching yet and it maybe the research parallel is more apt.

My 2 cents as an IP attorney: under U.S. copyright law, the employer owns the copyrights in (and indeed, is treated as the legal author of) all copyrightable works created by an employee acting within the scope of his employment. Thus, RR would be infringing WVU copyrights if, for example, he made unauthorized copies of school records and took them with him (e.g., address lists of prospects). I don't think personal notes would qualify. Destroying copyrighted works does not constitute copyright infringement, but might constitute a breach of his employment agreement if such an act was specifically prohibited. I agree that the bigger question is whether copies of what RR destroyed exist anywhere else; if so, then no harm, no foul.
This whole thing reminds me of the way the Senate Judiciary Comte went after AG Gonzalez: you fired six J.D. attorneys, you had the right to do that for any reason, but we're going to subpoena you and and see if we can find anything wrong, although there isn't a shred (excuse pun) of evidence to suggest it.

Just wondering why faculty do not have thier university affiliations on textbooks in many ocassions and the university does not get any kickback on royalties on these. There seems to be a distinction with these works as opposed to research output.
And just so that this has any place on a football blog, what is the legal parallel to the football plays - coursework or research output or neither. Just interested.

Absolutely and positively F - A - L - S - E. You sweep with too broad a brush. Only a very limited number of copyrightable works fall under the work made for hire doctrine. Nothing connected to a college football program -- exceptions for campus/stadium maps or commissioned sculptures -- qualify. This is a very common misconception; you need to self-educate beginning with Title 35 itself. You would flunk the copyright course I taught if you made this argument and I have actually flunked students (Dean supravened to keep the money flowing, natch).

Well, let's keep some sanity here. Rich prob didn't do anything illegal. But to deny that there are very apparent and gross ethical problems with his actions is folly.
His reputation is very, very tarnished. Michgan fans got a good coach, but one with obvious ethical issues. It's embarrasing for all of us. And some WV fans are taking it too far.
But please don't be so biased in your reporting that you can't see that he is a man of dubious morality. That is simply a fact.
And remember, you have a lot of people in WV who read your blog, before and after the Shred Offense Guru's departure. I have always liked your blog, but please don't get too personal with us, we have pride just like you guys.

Really, this is ridiculous. I admire the good faith effort by some on this board to analyze if RichRod did anything illegal/unethical, but please- this is not a good faith accusation by WFV! There is no need to honor a bad faith FU from a spurned university.
I would be shocked if anyone from WFV decided to take legal action on this. And I would welcome it.

I think both sides are a little screwed up at this point. WVU is making this seem much worse. But if it did happen Rich Rod shouldn't have done it. So the blanket defending him by UM fans should not be done either. Obviously there was something he didn't want to be seen. Probably something that would hinder his fighting the 4 million lawsuit. Either way no one is clean, but they are a little dirty.

Michigan fans are necessarily biased for their new coach and we're biased against him (not because he left, but how he left).
So there's little point in discussing the truth on a blog that is so brazenly one-sided and stereo-typically insulting to the people of West Virginia. Congrats to the open-minded and fair fans of Michigan.
