If I am a coach thinking about going to WVU, I have second thoughts after this ridiculous, psycho-ex girlfriend smear campaign.
Steve Fisher left the basketball program in shambles and gets a pat on the back on the way out the door. RR MAKES that program relevant and gets a paper bag with shit inside on his front door step.
If this is how they are acting, it is no surprise he left. These people area psycho, and ESPN will be more than happy to help them out while ignoring Reggie Bush.

Former or still lawyer. This was BS from the start, there is no way student records or anything else was shredded and no way if this were the case, WVU waits 3 - 4 weeks. Presumably, the football office still operated after Rodriguez left. Unfortunately, some lawyers have been weighing in muddling the legal issues. The real issue is this makes no sense whatsoever. One thing you learn in litigation, basically any side can make any allegation they want. The truth has nothing to do with it. I'll be holding my breath for the articles when this is resolved saying this was a smear job. I've got no particular brief for Rodriguez and rarely post, my litigator past leads me to believe, the bigger the claim, the less likely it's true. They are trying to pressure him to pony up 4M, he didn't, this is desperation. Sad really. Let it go, he's gone and all you are doing is reinforcing every reason why he left. Plus, after Stewart? flames out, what coach in his right mind would go there? Shortsighted. Welcome to 5-6 football.

Maybe they don't know proper business precedure in WVA.
There is a big issue about the daughter of the governor getting an MBA from the school when she only had half of the credits necessary (she is also currently working for one of the largest donors for WVU). They set up a council to investigate, but they needed a new chair because the old one had ties to the governor. If you want to look into further the Pittsburgh Post-Gazette has been tracking it.

This is the point. Whether or not they are being vetted by WVU lawyers is irrelevant since they are leaking through anonymous sources these allegations. You have 1st amendment protections, anonymous sources and nobody held accountable. If they make these allegations in the pleadings (which still really mean little) and allow witnesses to be deposed, I'd give it some credence. Never will come to that. Incidently, I find it funny when I read a WVU lawyer comment on removing the case to federal court - like this was a somehow suspect. First of all it happens all the time. Second, I worked in Chicago, I can only imagine the type of impartial justice RR would get in from of a WV local judge.
Reminds me of why I quit doing it.

WVU finally got the hint that RR didn't feel he needed to pay his buyout in full, called in the lawyers, who undoubtedly said, "Good luck getting all 4 mil. Not Gonna happen."
So WVU, (read: jilted lover (read: psychotic bitch)) wants some way, ANY way to make him pay. So, the lawyers figure they'll just toss some shit against the wall and see what sticks, hoping eventually RR gets spooked and says, "Ok, I give. Here's your 4 mil."

WFV is going to be a horrible program as long as Stewert is head coach. I mean come on, his first head coaching gig he doesn't win and then makes a racist comment and quits. Now he goes from SPECIAL TEAMS COACH to head coach because "he" won the game. Um excuse me that was RR's staff that called every play and RR's players that won that game. Stewert is old and scary looking, what top recruit is going to want to play for that clown. WVU fans know it which is why they are holding on the this RR stuff for as long as they possibly can because they dont want to bear the shame that their football team will bring that shitty ass state. This shredgate business is perfect for WVU – albeit transparently disingenuous. They can claim RR took/shred a bunch of documents. Everyone jumps to conclusions. It "looks" bad for RR and UM. But they don't have to lie about it since RR probably did take/shred a bunch of documents (it's just that whatever he took/shred was something they wouldn't think twice about if done by anyone else).
Rest assured, all of this will up and disappear like a fart in the wind once the buyout gets settled. And I'm 100% sure it will get settled before spring practices. Because what WVU really doesn't want is for RR to air the WVU AD's dirty laundry which is what will happen as this goes forward. Once both parties stand to lose something, an mutually acceptable agreement will miraculously appear. .

I'm a tax attorney, not a contract guy. But . . . I'm thinking that when a coach makes $2 million and year and a successful football team that makes big bowls brings in many many times more than that, a $4 million dollar "liquidated damages" provision doesn't really sound all that unreasonable.

Warning: legal explanation follows:
I have not read the contract, but I am sure it describes the buyout as a liquidated damages clause, which allow the parties to specify in advance an estimated value of how badly a party would be damaged if the other party breached the contract. They're typically only enforceable if the contract provides something like:
"the parties hereto hereby agree that in the event of a breach by either party that the nature of this Agreement would prevent an accurate measurement or estimation of the actual damages incurred by the nonbreaching party" and "that the parties hereto hereby agree that $xxx,xxx.xx is a fair and reasonable estimation of damages resulting for a breach and that the nonbreaching party shall be entitled to this amount in liquidated damages in the event of a breach." (disclaimer, I did not draft that liquidated damages clause and the foregoing does not constitute a legal opinion from Baconpants, Esq which may be relied upon by any party for any reason)
Even if a judge found the buyout ie liquidated damages clause to be unenforceable, RR would still be on the hook for actual damages if the judge determined he breached the K, but since they won their bowl game and hired a new coach already, those damages would likely be minimal.

WRT RR - When he accepted the UM job, didn't he put his resignation at WVU for 1/02/08? Later WVU came back and gave a date that he was effectively not employed by them anymore. All the calls in the article were, IIRC, during the time he had accepted the UM job, but was still at WVU. Maybe one of you with some extra time on your hands could make a timeline of all the random events alleged in this continuing saga.
BTW: In NC, the popular opinion is that RR is fine, but WVU is nuts!

the way i see all this is, Michigan is that guy in high school that stole wvu's girlfriend, TWICE, in an effort to get back at girlfriend number 2 little wvu has tried to spread rumors that she has an STD, come to think of it she had it when she was with wvu as well but he managed to ignore it. it wouldnt make sense in that situation and it doesn't in this real one either. at the end of the day little wvu will get his while Michigan drives off into the sunset with his new girlfriend and her new rings

I think that the reason WVU settled for less on the Beilein buyout is that 2.5mil was not going to be enforceable had it ended up in court, based on their actual damages. He left after recruiting was over, he made less money, they got a coach with similar or better credentials. The damages with RR's breach, based on those criteria, would be much more significant, however, I have a hard time seeing a judge allowing damages beyond a year of RR's salary at WVU.

I think a public comment from Bill Martin in defense of his new coach would be a nice gesture, and possibly warranted at this point. I understand wanting to keep his distance from manners that don't involve him - but the messier this gets, the more his coach can't focus on his duties, the more this becomes Bill Martin's problem. Plus, sticking up for RichRod now, could certainly go along way to foster some loyalty in this relationship...

Re: the $4 million - I don't see how that is a reasonable estimate of damages. RR left in December, more than a month and a half before recruiting season ended. They hired a coach who won a major bowl game at a salary far lower than what they are paying RR. Had they been willing to spend RR's salary, they could have gotten a coach with similar credentials. In my mind, the only damages that occurred were any costs incurred from the time RR resigned to when they hired Stewart. So costs of interviewing candidates, etc. At most also include costs of hiring replacements for assistants he took. No way that approaches anywhere near $4 million.

Seems to me you have two sophisticated parties (in a legal sense no WV jokes please). If everything else was on the up and up in the contract, I don't really see a court substituting its opinion of the contract under some sort of unfairness theory for the opinion of the parties reached after negotiation. In my uninformed opinion, RR will probably have to pay the 4M and UM should have worked this out before they hired him. I guess they felt it would be a Beilien situation where they would just take some cash and be done with it. Can anybody contact Lionel Hutz? He might have some insights.

I really gained a lot of knowledge for business stuff because he relates all of the football stuff to life and business. I'd read it again and make everyone of my employees read if I had employees.

It would be nice -- and reasonable -- if the media started to turn this around on West Virginia. RR is not the first coach to leave before a bowl game -- and remember he offered to coach it, but WVa (rightly) said never mind. He did nothing wrong except take a better offer at a more prestigious school and football program. How many of these reporters who are skewering RR would turn down an offer from say the New York Times or SI? WVa is acting absurd and someone should call them on it.
Regarding the liquidated damages, there are all kinds of issues including whether WVa lived up to the agreement in the first place. Also, at this time, it appears the suit is at best premature. RR hasn't said he won't pay it and the money isn't due yet. Just because individuals have said RR is going to contest it, doesn't make that contest a fact.

After all the crap Houston Nutt took at Arkansas--while he was still their head coach--I'm not surprised that Coach Rodriguez did clean out his office and destroy some of the records there. Seeing the reaction coming out of West Virginia--from the university, the athletic department, the governor, Senator Rockefeller, the general public and the press--I don't blame him a bit for trying to protect himself.
We're already seeing an article published in the newspaper about his emails, text messages and phone calls around the time he left West Virginia for Michigan. Can you imagine what might have been publishedin the WV newspapers if they had access to his personal notes, etc. on the football program?

Ukraine, regardless of the equal sophistication of the parties, since this is an employment contract, I think the court will look at it differently. Forcing RR to pay 2 years worth of salary after taxes to get out of an employment contract reeks of indentured servitude. Courts don't want to enforce contract terms that would essentially force people to stay in their jobs. Just my 2 cents.

I read what he wrote and understood it. There are two things which continue to concern my regarding recruiting, even still.
1) The fact that WVU is hellbent on finding and proving wrongdoing. Just because that hasn't happened yet, doesn't mean it won't. Hardly anyone is perfect when they're under a microscope...
2) Public perception of this program (be it accurate or inaccurate) is taking a beating because of the aforementioned misunderstandings. You can say that none of that matters as long as NCAA sanctions aren't imposed, but I'm not satisfied with the reputation of the program being unjustly tarnished.

Michigan Law 96 -- just my take on the 4 mil in the K. It's liquidated damages, or so WVU will argue, negotiated and agreed to by both parties. That being said, I just got a $500,000 settlement for a client who sued under a defamation by implication theory. Wonder if RRod would like my firm's services? He'll pay about 2 mil, and move on.

The WVU/RR employment agreement, second amendment, provides:
"Unless Coach terminates his employment under this Agreement due to a permanent retirement from the University and all other employment with any coaching responsibility with an institution of higher education, in addition to all other forfeitures and penalties provided herein, Coach will pay University the sum of . . .(b) Four Million Dollars ($4,000,000.00), payable, as further described below . . . . This sum shall be deemed to be liquidated damages . . . "
I am not cherrypicking - to me "forfeitures and penalties" smacks not of a liquidated damages proviso but rather a penalty clause.

@J lichty, I totally agree. I think that RR definitely left because he was unhappy at WVU, not because he is greedy. The way that WVU fans are acting now shows why he had to get out. I just wish that he hadn't said that he would be there for a long time.
The main issue with Jim Carty is that he expects all coaches to be upfront and grant full access to the media. That's why he had so many issues with Carr. One thing in the article that illustrates this is Carty's disapproval of RR's refusal to speak about his convo with Michigan in Toledo on that Friday in December. Not only did RR do the right thing, but just about everyone else in the media agreed that he did
the right thing by not speaking or lying. That was actually one honorable thing he did in all this. But Carty appears to think otherwise because of his ludicrous expectations of coaches. The guy, IMO, shouldn't be a reporter if he expects all avenues to just open up for him.

@Nick, I also heard Wilbon call Carr a neanderthal during the BCS drama last year when Carr said that Tressel's decision not to vote in the coaches' poll was "slick." As much as I like Wilbon and Kornheiser, Wilbon (self-admittedly) hates Michigan. It's an Illinois thing. (He roots for Illinois in basketball if I'm not mistaken.)
Carr is the classiest coach around. Kornheiser and Wilbon are so reasonable on many issues but Wilbon's dislike of Lloyd is ridiculous.

I'm with you in principle but in practice courts are extremely reluctant to mess with contracts under any theory. Fairness has little to do with it, sadly. It's also pretty hard to argue indentured servitude when your client is making 2M a year. I mean to us he's sympathetic, to others he's a guy that just screwed over his alma mater. The other thing is judges do not like to get smacked down on appeal. Easiest thing to do is find that RR broke the contract. I'm sympathetic to him, WVU is clearly the vengeful party and treating him unfairly but in my opinion, the law is on their side. Again, why "leak" the shredding crap. Classless.

WVU does NOT want to litigate the $4 million buyout. No way, no how, uh-uh, not gonna do it.
Here's why: Whether a specified remedy is liquidated damages or a penalty is always a tough call, and think about the position WVU would have to take in asserting that $4 million is a reasonable approximation of their damages in this case. Basically, they have to get up and argue that RR is a god and their new coach is, well, garbage I guess -- otherwise, how in the world do you get to $4 million in damages from RR leaving?
Now, they may or may not win that argument, but regardless, think about the effect that would have on: (1) recruiting, (2) boosters, (3) current players, (4) fans, (5) the existing coach, (6) basically everything having to do with their program.
RR (and any other coach who has a buyout provision like this) is in the catbird seat when it comes to fighting these things out.

El guapo, I don't necessarily agree that WVU does not have the better case on the merits, I think they do but hey, my knowledge is based on well, nothing really. WVU does not want to litigate this since they do have to argue absurd positions for a football program - like you stated. The we are totally screwed without RR argument might be a legal winner but I can't believe that is what they want to do. Thus, the BS you destroyed WVU property argument. Only thing I would mention, never underestimate the total insanity of an opposing party that feels totally, completely, and irreparably aggrieved. I think WVU is close to that point. Let me first say: I am with you on WVU's behavior being bush league; no coach who leaves a place after seven (7!) years of service deserves this.
You are wrong about a couple of things, however. First, "Anything that only Rodriguez had was by definition a personal file" is not true. Nor is the issue whether WVU had other copies (not legally, anyway, though it does expose the lie). Legally speaking, the issue is whether Rodriguez destroyed (or took with him to Michigan) files compiled in such a way that they belonged to WVU. This isn't an NCAA rule, it's a common law principle in every state -- a fiduciary duty to one's employer. Of course, I don't say RichRod violated any law, or took any files, WVU's credibility here is nil.
Second, you seem to have lost sight of the fact that none of this angry (and did I mention bush league?) crap from WVU would be happening if Rodriguez weren't trying to get out of the buyout clause of his contract. Four million dollars is a lot of money, and maybe he shouldn't have to pay, I don't know. But this isn't just WVU being childish. This is WVU trying to create an argument for Rodriguez paying them.

Let's give the Toledo Blade some credit. They were a little off on the Mallett story but got it before anyone else. This was a good piece today. The Blade has won at least a couple Pulitzer prizes in the last few years for investigative reporting. It's not an excellent paper, but it's OK (and yes, I'm from Toledo).
The other thing you should realize is that Toledo is populated by about half UM fans and half OSU fans. It's intense. So there's no wonder that anything relating to Wolverines OR Buckeyes features prominently in the paper.
Toledo was also almost the site of a small civil war, because both Michigan and Ohio wanted the city as part of their state and they were ready to fight over it. The President intervened and Michigan lost its claim to Toledo, but it got the UP as a consolation. Let's hope history doesn't repeat itself, OSU wins Pryor, and in return we get another 6'6'' ogre at QB.

Not necessarily. Keep in mind that these bafoons have been accused of having no compliance department by their own donors. Ukraine - the key is that the breach by WVU must be material to excuse performance. THe list I saw of things that they had purportedly not done, seemed minor, so RR will have to show that these items were in fact material. Basically, the law abhors breaches of contract and will tolerate subtantial performance of contracts.
The issue usually cannot be determined by a judge as a matter of law, but rather as a matter of fact by a jury (or judge if jury trial waived or not permitted). Thus RR will get fucked if this gets to a jury.
I think it helps RR that this contract was just renegotiated, i.e. negates a "waiver" or estoppel defense which would be that RR had basically accepted non-compliance by continuing to perform under the contract.
I do not think WVU will settle. This is personal. They would rather lose the money and they think that they have a slam dunk home field advantage.
Out of state defendants will nearly universally remove a case to Federal Court to avoid elected judges and homer juries from the very county where the plaintiff has chosen to file, but bear in mind that he is still in court in WV with a WV jury and a judge who was a political appointee who most likely came from the ranks of WV lawyers. I have been screwed in Federal Court just as much as in State Court, so removal is no guarantee against a stacked deck.

Nicholas Cage was good in Adaptation (and to a lesser extent Matchstick Men) so people continue to give him lead roles in films. He is a great actor when you give him a role that he has to over-act to make convincing. But giving him something like Ghost Rider (which was admittedly doomed to failure from the start) shows his absolute reliance on overacting. I think there is a Celebrity Jeopardy that has someone making fun of Nick Cage in it. I forget who it was, but it was dead on.

"Face Off" had two good scenes. Where John Travolta gets stabbed in the leg by the girl with the butterfly knife. And when Nick Cage owns him with the speargun. Outside of that it was a festering pile of asscrap. Much like West Virginia.
If I remember correctly "The Family Man" was a good one too.

Every time I think of Toledo, I remember the role it played in demolishing a job interview.
i was busy building great rapport with the boss-to-be when I mentioned that getting a new job would mean that I could no longer have to spend winters attending conventions in "places like Toledo and Rochester."
To which she immediately replied, "I'm from Toledo."

Face Off just couldn't survive the Nick Cage/ John Travolta hackfest that it served up. Kind of like "Broken Arrow" but without the ultra slimy Christian Slater. Both of these movies need to be locked in some sort of vault and only released at the event that the story line from Idiocracy becomes true. Then they'll win Oscars.

Cage definitely over-acted in The Rock. It was saved by a pretty good storyline and Sean Connery. They could've gotten a better actor for Cage's character and it would have been a much better movie. Tom Cruise was kind of at the height of his power then, but I guess he wouldn't have fit into the whole nerdy scientist guy that Cage plays.

1. "the way i see all this is, Michigan is that guy in high school that stole wvu's girlfriend, TWICE, in an effort to get back at girlfriend number 2 little wvu has tried to spread rumors that she has an STD, come to think of it she had it when she was with wvu as well but he managed to ignore it. it wouldnt make sense in that situation and it doesn't in this real one either. at the end of the day little wvu will get his while Michigan drives off into the sunset with his new girlfriend and her new rings" = exactly right.
2. The case has been moved to federal court, but it still might end up in the D.C. region, so biased judges and juries are still possible.
