Good point about the 'tick test' but what you don't emphasize enough or at all is that not only has Christopher Naked Shorts Cox or his SEC not caught or charged one person,broker or market maker with illegal 'naked shorting' - but he has also not convicted,much less even charged James Dale Davidson,Grant Atkins, Brent Pierce or David Patch,et.al. of NAANSS and NCANS,ETC.,with alledging being 'naked short selling' victims while knowingly participating in illegal pump and dump scams that they claim to be victims of 'naked short selling'. And any fool would know that if naked short selling really occured it would mimic an illegal dumpung scam.
So attorneys such a Wes Christian dumped while telling investors it was 'naked short selling'.Much more cruel and criminal than any pump and dump scam,however vile,alone.
Yes all these purposefully lieing statements and actions of the ponzi
scheme connected Cox actually prevent
real victims of the fraud such as myself from ever getting justice and it rewards the likes of attorneys O'Quinn,Christian,ex SEC attorney Brent Baker,and their clients Patrick Byrne,Endovasc Genemax and thuis James Dale Davidson to be rewarded and encouraged to commit more fraud and probable money laundering and anonymous offshore account activities.

I don't think in this day and age that the Tick Test offered any real protection. If a large money pool like a hedge fund wants to get around it, all they would have to do is hit the ask enough times to drive the stock price up, then mercilessly short without restraint. Our best protection against manipulation is software technology that detects manipulative trade patterns (which is available) and good enforcement of the rules.
