The corporate policy compliance questions were originally raised by myself (if you will please forgive the self-congratulations) as speculation tjat Bagley/Brynes could not possibly be in compliance with these policies.h Sam Antar then picked up this thread and proved it as fact.
In addition to the Reg FD troubles, there is also appears to be Sarbanes-Oxley component to Overstock's failure to enforce these policies.
Individually, one would react to any one of these infractions as a minor matter that does not rise to the level of active regulatory enforcement. However, the volume of infraction, and the manner of execution in this case is quite remarkable, and does rise to actionable violation in my opinion. And if my opinion turns out to be fact, then the SEC’s credibility is on the line if they opt to do nothing.
I would still like to know if the Overstock Sr. Human Resources executive reported these policy violations directly to the Board of Directors, as many - if not most - public company now require in a post-Sarbanes world.
As we all know, the failure of the Board of Directors of Overstock.com, Inc. at Corporate Governance is no less egregious than it’s rogue CEO and his minions.

Yes Yahoo should be investigated to see why they deleted all my accounts and messages and allowed SRA International or its investor-posters to delete my comments.Not to mention immediately deleting all my OSTK message board posts on a Sunday only moments after confronting a touter who spelled the as 'teh' just like David Patch.....
The established media in the form of Dow Jones' Barrons magazine hasn't noticed that the CIA's investment SRA International,or SRX, that has a virtual monopoly on federal 'IT' and spies on citizen protesters in its spare time and brags about giving the CIA and W Bush its daily briefing, also allows its own worthless shares to be touted and manipulated by Bellador Group of Kuala Lumpur and Dubai,etc. ?
Next Christopher Naked Shorts Cox will be getting his 'briefings' from little voices speaking inside his head and still he'll be getting more
'information' or 'intelligence' than listening to a bunch of cheap penny stock touters like his CIA advisers. I almost forgot,Chris Naked Shorts Cox is part of the CIA, Cerberus, etc.,etc. international war and securities fraud operation. But,hey,it's news to Barrons.

Herb Greenberg's story about the Overstock drafted Anafantis testimony to the USA Senate is poorly sourced. Or if it's sourced well, Herb doesn't explain it using short sentences even I can understand.
Exactly where the document supposedly documented by overstock comes from is not completely clear. What I would like to see is an email from a staffer saying that she understands there is a question where the document comes from, so she she checked her inbox, and found it there with the Overstock fingerprints on it. Greenberg hasn't produced an email like that.
Of course I am sure Overstock is guilty of anything it's ever been accused of because its principals have only the fuzziest idea of what offends Earth humans and they are clumsy and get caught at everything they do. So I'm the choir Herb is preaching to. But nobody else is going to believe that story.

About a year ago, Demetrios Anifantis testified before the Senate Judiciary Committee about his days as the relationship manager for Camelback, later known as Gradient, the research firm alleged to have distorted its reports on the bidding of short sellers.
Karen Hinton, a flack for Gradient, sent out an e-mail to a number of reporters (Herb was one of them, I was another) saying that Gradient had a copy of the PDF file presented to the committee, giving Mr. Anifantis's testimony. Gradient's e-mail included an attachment of that file. If one opens it, clicks "File" at the upper left hand corner, then "Properties" on the dropdown menu, one gets a box listing the author of the document as "mgriffin" and mgriffin's company as Overstock.
Mark Griffin is the name of an attorney at Overstock.com.
Hinton said that Gradient had brought this to the attention of the committee staff and was "disappointed that no one on the committee asked Mr. Anifantis today what role Overstock.com played in writing his testimony and coaching him for the hearing."

Thanks for the background NotNasser. What I've not seen is something that shows that the supposedly Griffin authored document wasn't really made by Karen Hinton. It's not that I believe that she did it, it's just that I don't have any evidence that she didn't.
