Gravatar I am going to agree with you Chris to me it looks like Hain has used this oppurtunity to release Kelly because he knows his lack of credible evidence for arresting him in the first place will be over shadowed by the statment.

In essence he is doing it to save his own skin. For anyone new to this site I am no fan of the IRA or particularly of Mr Kellys. If the evidence to have Kelly locked up permanently was not available he should not have been arrested.

again, let's nail these -

Kelly was NOT arrested. His 'parole' was revoked entirely legally under the terms of the agreement negotiated by Sinn Féin themselves on behalf of these prisoners.

there is NO obligation for Hain to produce "credible evidence" in the legislation, Kelly's only option - again under the terms ahgreed to on his behalf by SF - was to ask for a review. There was nothing in the agreement negotiated on behalf of Kelly and his like by Sinn Féin which meant that the SOS had to produce admissable evidence to that review.

Chris provided a link yesterday to the relevent legislation. Unless there is yet another under the counter secret deal, this is dishonesty from the republican movement.


Gravatar Chris - I don't think it was a sop to anybody on my side of the fence - his release, despite his being deemed a risk, if anything has been a slap in the face to the Unionist community.

My reading of it was that the RM as usual pushed to and beyond the limits and a warning was sent. Those out on parole were sent a message that there were limits to how much leeway they were to be given. I hope they have taken it on board.
