This is a nightmare. Geneva Conventions apply? I mean… I am going to be ill.

Do we have to capture Bin Laden to bring him to Federal Court before we kill him, or can we get permission from the Liberal justices to kill him on the goddamn battlefield?

Gravatar The military tribunal issue is annoying, but not the main problem. The way I read the commentary, so far, we can clap these people in jail till doomsday without trouble.

The Geneva Convention problem is HUGE...and I see no immediate cure for it, other, than, possibly, jurisdiction-stripping legislation, or preferably, legislation binding the courts to interpret treaties and international agreements in the manner specified by the attorney general.

I think all of us know the answer if the Dems have a sufficient majority in Congress.

SCOTUS is nearly untouchable--our Founders never saw that possibility because they assumed that justices would go by the rule of law. Well, now that legislate from the bench.

And the problem is one that is not so difficult to overcome. If Congress legislates a proper role for these Tribunals, we're all the better.

David: This won't offer the moonbats much sustenance. It's likely to be a temporary fix. Just another bit of crumbs tossed to the fools that don't realize we are at war, or that BUSH is the problem.

If Congress supports the moonbat view that these detainees are entitled to rights under the U.S. Constitution, I'll be surprised. After the latest blow back for the rights of illegal emigrants, I cannot imagine any bill getting through Congress that would further undermine the rights of citizens in favor of terrorists.

El Jefe: We'll have to follow up on the problem of Geneva Conventions that are a one-sided protection for the human rights of terrorists. No one who has read those Conventions can conclude that terrorists are permitted to violate them and be protected by them at the same time.

Gravatar The Al Qaeda bandits are not a State, much less a State-party, as far as the Geneva protocols are concerned. They do not follow the applicable conventions for irregular forces...and consequently, we would be justified in hanging them as pirates or shooting them out of hand.

I am just sick over this - it was if the SCOTUS took the libs' talking points when writing their opinion. BTW - CCR is also one of the big sponsors of the impeachment teach-ins. How convenient, huh?


Gravatar As others have pointed, Justice Stevens just gave Preisdent Bush a reason to keep Gitmo open. Until the proper venue is determined to handle the detainees at Gitmo that is where they will stay, period. And it looks like Congress is going to address this usse. So even as they think they strike at Bush they give him an assist.

Though they do mis-read the relevant Geneva Conventions in regards to what are combattants. Terrorists who blend into crowds, wearing no recongize uniform, and belonging to no recongized military are spies who are subject to summary execution on the spot.

So expect captures to fall off unless the thug in question has some high grade information. And it will be because the Supreme Court decided to re-interpret international treaties to suit their political whims.

Anonymous, Pandora's box has been wide open by having people without even basic fairness detained for undetermend period of time and no legal or other course to defend themselves. This is not the American way, even if it is your way (that includes the most of you commenting here).

Anna puna, surely you do not suggest that inocent people should be held in custody indefinitely, without hearing why they are there, without any legal means to prove their inocence etc. Those who are quilty should be dealt accordingly but so far even your government has granted freedom for dozens of innocent bystanders. No human should be totally without the standards that we Westerners claim to uphold. This has nothing to do with going soft on bad guys and everything to do being just, lawabiding, civilized and different from those we have an axe to grind.

Fact, at Abu Graib prision we had 13 year old boys raped in front of their fathers in order to break them down. Photos were taken to humilate the families and for black mail (you keep infroming on the insurgency or we release the photos of Omar getting sodamized).

How would you like it if China invaded the US and then found a former US army general and had his son raped in front of him until he talked about any resistance plans to the occupation. Sound peachy?

Fact we beat many prisioners to death in the prisons we know abuout (Bagram, Abu Graib), who knows what has happened in the "secret black prisions".

Fact, the government is incompent and you should not trust it (One of the first rules of true conservatism). Probably half of these people in Gitmo were just in the wrong place at the wrong time.

And I see in fine form too. Maybe we should adopt a European model and treat our prisoners like oh, say, I don't know... How about if we treat the Gitmo inmates like the Russians treated the Finns, or the Poles, or the Romanians, or the Hungarians, or the Czechs that fell into their hands during World War II and beyond???

You Europeans always offer us such a level of sophistication and a fine example from your own history.

much of the US torture in the Iraq prison system was by US servicemen following the instructions of Israeli trainers who have been practising on Palestinians for 50 years and are supposedly "experts" in dealing with a "shame-based" culture.

As Israel has not known peace, if the US continues taking its cue from it in dealing with the Moslem/Arab world, the US will not know peace either.

The Supreme Court decision was a mild measure. Most of the Gitmo
inmates were turned in for rewards (another unethical device used by the Bushies) to settle personal feuds and are guilty of nothing.

Actually Mike you don't even have to look back that far in European history. Europe has camps set up for illegal immigrants right now. Some of these people have communicable diseases and at one camp this has been transmitted to half the camp guard population. Cheery aint it.

Of course Georgia does not specify the time frame of that abuse at Abu Gharib, the implications is the US naturally. But feeding people into shredders, raping daughters in front of parents, electro-shock to the genitals were part&parcel of the reign of Saddam Hussein whom it seems these progressives prefer running Iraq instead of an elected by the people government.

Funny the mention of China. China invaded Tibet, is Georgia protesting that? Or does it matter? Or that China has several hundred missiles now aimed at Taiwan, an island full of people who do not want to be part of the People's Republic of China.
