Gravatar What a disturbing slant in that editorial.

A Florida law firm sued on behalf of 10 residents, had the case upgraded to a class-action suit on behalf of 7,000 residents in the area, and won.

"The judgment was nearly $400 million once punitive damages of $196 million and medical monitoring of $130 million were added. The lawyers were awarded $135 million."

"It noted that DuPont had shared drafts with the governor's office before Goodwin filed the governor's brief. The story also said Goodwin had been with the law firm of Goodwin and Goodwin before joining the governor's staff, and that the firm was a consultant for DuPont in this case.Duly noted. But so what?

The thesis: Governor Manchin is heroic in his effort to take on out of state lawyers who jacked up the claimant numbers and pocketed a whole bunch of cash off punitive damages.

They seem to forget the thousands of West Virginians who suffer ill effects from that contamination. And whether it's serious effeects or minor effects, the result is a decreased quality of life caused by greed, and allowed to linger from more greed.

Gravatar It asks the court to clarify what right of appeal the company has in West Virginia.

Seems like a Freudian slip here - if Joe's really looking out for all the citizens and wants to ensure "fairness," then shouldn't he want to clarify the right of appeal that any party has in West Virginia?

Focusing on the company's rights looks, you know, like taking sides.

Something fun to ask - if it's so usual and matter of course to file amicus briefs to ensure cases get reviewed, where are all the ones Joe's been doing for four years? There are lots of cases out there - civil and criminal - that won't get reviewed.

But, again, just picking out this one case looks an awful lot like taking sides, Joe.


Gravatar What is it with Manchin anyway? Why does he feel he has to stick his nose in everything? From f**king with WVU's negotiations with RichRod to this, Manchin seems to think that he has the power to do anything.
