Malkin your an idiot. could you please address the problem of drunk driving as opposed to the irrelavent fact he was illegal? Do you actually think its better to be killed by a drunk driving citizen then a illegal immagrant. Your such an idiot Michelle. Seriously how do you make it through the day?

Shawn, maybe you should look into a mirror when you are trying to identify fools and idiots. The incidence of drunken Mexicans driving w/o licenses in the US is much greater than US Citizens. But it really doesn't matter, one US citizen killed by a illegal alien is one to many!

Oh but it does matter. Many of these ilegal immigrant drunk drivers are second and third offenders. Not only do they get caught DUI, they are released back into our country to do the same thing again. It does matter that these individuals should be booted the hell out of our country. They don't deserve to be here..period!

Hey, just doing the burglary, drunk and disorderly, and now vehicular homicide that US citizens won't do.
Can we build a fence now? And then actually hold our "guests" accountable for their actions when they behave badly?

Wait a minute...shouldn't the drunk and disorderly conviction have been an obvious violation of probation, and therefore have led to more than 7 days incarceration?

At the same time, police were quick to point out that Benitez, whose physical identification was issued in Texas, was on two separate occasions convicted of a total of four criminal charges in Nashville.
He was arrested in February 2006 on three counts of car burglary and two counts of attempted theft. Two months later he was convicted of one count of car burglary and sentenced by General Sessions Judge Casey Moreland to one year of supervised probation.
On Nov. 5, 2006, Benitez was rearrested on charges of public intoxication, disorderly conduct and resisting arrest. The following day he was convicted of all three charges and sentenced by General Sessions Judge William Higgins to seven days in jail.
In April, the Davidson County Sheriff’s Office officially launched what they called a public safety program to run instant immigration checks on every foreign-born person booked into the Metro jail, regardless of the arresting charge.
The program was sought in response to multiple fatal DUI crashes committed by illegal aliens, many of who had been previously arrested and convicted in Nashville but not identified as illegal.

Thank you for that insight. Jocelyn, was my cousin. When my her mother is able to deal with the legal matters, I will be sure to discuss this with her. Our family is devastated over this tragedy. I have read hundreds of comments in various websites and a member of her family, we would like to say thank you for caring. All that I can say is that the judicial and political system has failed another life. But in this case, our family will not let her death be in vain.

While thoughts run through my mind of all the hate-filled things I'd like to shout at this rat right now, while I imagine the pleasure of a moment alone with him, while he's sober, I can't restrain the feeling of utter despair at yet another loss for this family. To lose Jocelyn this way only amplifies the pain. If we don't wake up and do something at the polls, we'll never see a change...
