Considering that the crimes Saddam committed were against his own people in his own country and long before the war, the attorney shouldn't have any chance of putting that one over. After all, the toilet cake wasn't on trial for war crimes, he was on trial for mass murder.
Considering his extra-curricular activities with paper shredders and electricity, if there was any true justice, rather than hanging him they would turn him over to the surviving relatives of the victims to do with him as they please.
