I hate lawsuits; in my opinion only twelve percent of the total is really necessary. We had a woman in Hamilton who sued the hospital because she had a painful childbirth that "scarred her emotionally for life", can you IMAGINE! I can't believe that even made it to the court level.
Having said that, were these terrorism "suspects" or "convicted" terrorists? Some might say it doesn't matter, but it does. We had a Middle Eastern man here who was branded a terrorist by the RCMP based on circumstantial evidence and heresay, WITHOUT being tried. He was deported back to his native country (I can't remember what that is now, I'll have to look it up), and tortured almost daily for a year. Finally, new facts came forward that cleared his name completely, and he got an official apology from the RCMP - too late.
If these guys were convicted, then hell yes.. Send them back where they came from and let them face the consequences of their choices, but if they were merely suspects, then detain them, keep an eye on them, give them a trial, but should they have just been shuttled away - I don't think so.
A lawsuit is bullshit in this case, hold an inquiry, discipline internally...

There is a little known law (I need to relocate it) that says something to the effect "any case brought against the federal government shall be compensated by said government”, meaning the ACLU attorneys get paid by the federal government for any case they bring against the federal government no matter the outcome. All they need is a plaintiff. The question here is who is the plaintiff? I don't believe it is the ACLU, though I suppose it could be.
Truth not withstanding, I'd also like to know who spilled the beans, though I'm sure if this is true, their life insurance better be paid up for fear they succumb to an acute sickness like ‘lead poisoning’.

I agree that our legal system has gone bonkers. We would do well, for once, to follow the UK model where the loser in a civil lawsuit would have to pay the court costs of the loser.

This guy was convicted on heresay simply because of where he happened to be at the time and the colour of his skin. Seven months later he was proven beyond doubt to be innocent, but by then he'd been subjected to so much shit.
I'm all for ridding the Western countries of haters, who plot illegal activity and refuse to make any effort to integrate into our society, but I can't condone the case above, simply because it was an innocent guy, and our police service didn't even bother to review the facts before they sent him away to hell. Sure, send them away, but give them a fair trial and convict them of something first!

Lawyers and judges do tend to suck when they decide cases in a way that conservatives disagree with. There have been plenty of bad books on the subject over the last couple of years (see Mark Levin's Men in Black).
By the way, the law which the ACLU argues it has a basis on is the Alien Tort Statute, and given current case law, they may have a valid jurisdictional case, although I know nothing of the merits, if there are any.

However, having said that, why shouldn't convicted terrorists be shipped back to their home countries? If those people are going to engage in those sorts of activities, well, their actions have consequences.
I was very privileged to be able to immigrate to Canada, and it's extremely aggravating to see people immigrating here who have no desire to respect the laws/customs of this country. I'd imagine it would be the same in the U.S.
