Free speech is one thing, but if you look at it the states and Congress have made many laws abridging it and the free exercise of religion. Recently we have even seen efforts to ban so called 'hate speech' at both the state and federal levels. Once again, as darwin noted, if the left thinks the speech is offensive to them or counter to thier agenda, then it is not protected. If it serves thier purposes, then you can say what ever you want.

I would argue that the 1960's First Amendment cases (both on speech and Establishment Clause - although my feelings are a bit mixed on the latter) were really the watershed moments for the level of protection political speech receives today.

It would appear that prior interpretations focused more on the Blackstonian interpretation of prior restraint, meaning you can say something but it doesn't necessarily mean you won't get prosecuted (my understanding is that both Jefferson and Madison opposed this position).

There was a rash of WWI First Amendment cases that resulted in rulings I can only describe as abominations and legitimizing a "clear and present danger" doctrine that ran so afoul of our first principles that one would have to have their head in the sand to find any substantive value to it.

I was responding to VW's comment on the 1960's. I happen to think the Court finally started to understand that "no law" really does in fact mean "no law".
